Andy Murray claimed his seventh straight win as he dispatched US Open champion Marin Cilic 6-1, 6-4 in the China Open quarter-finals Friday.

Murray will face world No. 1 Novak Djokovic in Saturday’s semifinals. It will be the pair’s 22nd meeting, and Djokovic leads by 13 winnings. The Serb has won both their contests this season, in four sets in the US Open quarter-finals and in straight sets in the Miami quarter-finals.

“It’s always difficult against Novak,” said Murray. “His form here, he’s never lost, which is very impressive.

“I’m aware it’s going to be an extremely difficult match tomorrow. But it will be very good for me to get that match and see if I can make some improvements from the US Open.

“If I play like I did at the US Open, I’ll definitely give myself an opportunity in the match. It’s going to be a good test and I look forward to it.”

Djokovic beat Grigor Dimitrov with a 6-2, 6-4 victory in the very same day as he improved to a 22-0 mark at the China Open.

“Every time I play Andy, it’s a huge challenge. It’s a very physical match. A lot of long rallies, exchanges. I do not expect anything less than that tomorrow,” said Djokovic.

Each letter of the first name rules 9 years of life.  Ages 27 to 54 are ruled by the sum of the fourth, fifth, and sixth letters of the name and the day of birth.

[Since his first name only has five letters and he has no middle name, the first name is repeated].

Novak Novak Djokovic          May 22nd, 1987

1 (a is the 1st letter of the first name) + 11 (k is the 11th letter of the alphabet) + 14 (N is the 14th letter of the alphabet) + 22 (born on the 22nd of the month) = 48

So the numbers 22 (born on the 22nd of the month), 26 (sum of the fourth, fifth and sixth letters of the name), and 48 (22+26=48) rule his ages twenty-seven to fifty-four.

22 = Lucky.  Joking.  The joker.  Being silly.  Clowning around.  You’ve got to be kidding me.

26 = Popular.  Speech.  Speaking.  Communicating.  Television.  The media.  Reporters.

February 6, 2014              12:08 p.m.

Bizarre cold-weather phenomena called frost quakes — which generate shaking and ear-splitting sounds likened to exploding bombs — have blasted towns across the Northeast and upper Midwest during this extraordinarily frigid winter.

Thanks to social media reports, researchers have been able to study frost quake reports submitted from Minnesota, Indiana, Illinois, Missouri and Canada and talk to those who felt and heard the unsettling booms and shakes.

King lives on the top floor of a 15-story Toronto building and likened the sound to two bowling balls being knocked together.

“People here are used to hearing regular cracks and pops in the winter as the cold weather causes pipes and structures to expand and contract,” she said. “These frost quakes sound much louder and deeper.”

Another apparent frost quake awoke her around 5 a.m. the next day, she said.

“I went on Twitter (https://twitter.com/lovethinkplay) and found several tweets from people who were awoken by the same thing, at the same time, around the same area as my apartment building,” she said.

Frost quakes have a scientific name: cryoseism. The term also includes the cracking and slipping of glacial ice and the fracturing of frozen lake ice, said Clifford Thurber, a geophysics professor at the University of Wisconsin Madison.

He guesses that the frozen water tables are tens of meters long. The most intense frost quake he’s seen was a magnitude 1.5.

“Even though their source sizes are small, the shaking they cause at the surface can be large because they occur so close to the surface,” Thurber said in an email to the Los Angeles Times. “But typically they will not be felt very far away.”

And social media have given researchers a new way to study the little-discussed temblors.

“Since frost quakes are rare, localized, cannot be monitored and tend to cause only minimal damage, the scientific community has very limited amount of information,” said University of Toronto Scarborough Climate Laboratory researcher Andrew Leung.

They might crack roadways and building foundations, but that kind of result is rare.

Frost quakes can strike after a pounding of rain or when the rapid melting of snow saturates underground streams. When temperatures suddenly reach near 0 degrees, the water table expands and starts cracking the soil and smashing nearby rock formations. Witnesses have described the sounds as being similar to gunshots, exploding bombs and falling trees.

Since the beginning of the year, Leung has tracked numerous frost quakes in freeze-gripped parts of the Midwest.

While visiting Texas during Christmas, King heard news reports of “booms” in her hometown and turned to Twitter to see what people were saying. She assembled a Google Map to allow users to pinpoint and describe their own frost quake experience.

“It amazed me how gracious people were to have a Web page where they could see that other people were hearing and feeling the same strange events as them,” King said.

“Soon enough, it appeared to everyone that these noises were not random due to the sheer volume of reports,” Leung said.

King’s map shows frost quake markers in states such as Maine, New York, Ohio, and Wisconsin. As recently as Sunday, 911 operators in Illinois and Missouri took reports from callers who said they heard booms.

Leung suggested that in addition to social media reports, frost quakes have garnered extra attention becuase they have occurred in a major city, Toronto. It’s more typical to hear of booms once every few years in rural areas of states such as Wisconsin and Massachusetts.

Could she be a future FORBES 400 lister? Well, let’s not get ahead of ourselves. Still, a 15-year-old burgeoning captain of industry from Galveston, Texas named Madison Robinson (or “Maddie,” as she prefers) is on track to make a serious profit in the clothing industry.

Robinson’s company, Fish Flops, makes apparel for children and it all began with her designs for flip flops which she’s been thinking up herself since coming up with the idea in 2006. Most recently, pitching her wares to retailers, her company has signed a deal with both Macy’s and Nordstrom JWN +1.24%.

You’ve got to hand it to the young lady for knowing to strike while the iron’s hot. Her product line has exploded into an all-out brand, featuring hats, t-shirts, kids books she writes herself and what appears to be an upcoming video game or app that takes place under the sea. Holy hamburgers, this kid’s got moxy!

The shoes go for about $25 a pair and Robinson has sold more than 60,000, according to a report. Word is she’s designing a new line for adults for Macy’s. Her ascension came with help from her father, Dan, and good ol’ family financing (the best angels there are).

As far as cash pileup is concerned, right now the money Robinson is making is being set aside to pay for her college education (apparently she has already earned enough to pay for schooling) with the guardian to her mini fortune being her father.

When she does go to college, Madison says she’d like to study business. Should she continue to grow her company as she’s done, she’ll likely accrue more real world business experience by the time she turns 18 than any of the other students in her future classes and then some. Perhaps she should propose to teach a class once she gets to business school. Or at least volunteer to be a TA.

When people ask Carlos Lucero what he does for a living, his answer often stops them in their tracks.

“I throw people off the Stratosphere,” he says jokingly.

Lucero is the man who stands between a person taking the 855-foot plunge to the second level of the Stratosphere Hotel and Casino, or turning away from the controlled fall and taking the Walk of Shame back to the gift shop.

Lucero is the Sky Master, the man who checks the harnesses and straps before thrill-seeking tourists endure the Sky Jump, a ride that opened here in April 2010 and, Lucero says, holds the Guinness World Record for highest commercial decelerator descent.

Think of him as part sky-dive instructor, counselor, bartender and priest.

Many jumpers are panic-stricken. Lucero says soothing things.

Jump masters can’t physically touch any customers to help them jump off; people have to do that on their own power. Instead, he talks to them, making them feel comfortable enough to do something they might be attempting on a dare from friends.

“There is really only two things a person can do — it’s either step off or dive out, and when people try to dive out they hesitate a little bit when they realize how high up they are,” Lucero told the Los Angeles Times.

Most people jump — and are glad they did.

“It’s cool to see some of those clients come back up and say thank you so much for talking me down because that was amazing,” he said.

Sky Jump is different from a bungee jump, where participants can get a running start, jump upside down and do flips. On a Sky Jump, a person is limited to going off the edge of the balcony or leaping off, but Lucero said either way, the adrenaline rush is the same.

Lucero went through three interviews, just to determine what he might do in emergency situations, such as if a person were stuck. He then went through eight weeks of training, learning things like how to apply the harness, and how to be a motivator to get people to jump off a building.

Building the attraction was quite a ride in itself.

Director of Ride Engineering Patrick Brinckerhoff said the challenge came with erecting something on the 108th level of the skyscraper, and there isn’t a cherry-picker tall enough to reach that height. Workers had to take the structure piece by piece in the elevators. It took a year to complete. The ride goes 45 mph while jumpers get a picturesque view of the famed Las Vegas Strip.

Since 2010, 100,000 people have jumped off the Stratosphere to the bull’s-eye that that looks like a small dot from 855 feet up but gets progressively bigger the faster a rider plummets.

Lucero says only 13 people have decided not to take the 17-second plunge down to the bull’s-eye, where jumpers are greeted by onlookers reclining in pool chairs.

His biggest challenge is trying to calm fearful riders who literally cling to the balcony’s steel railing for dear life. Not jumper Kirk Applejohn.

“I work in high places, and the most nerve-racking part of the ride is the first step off the balcony,” the Canadian electrician told The Times. Applejohn said he took the leap during his first visit to Las Vegas. “When I was at the bottom, my first thought was I never wanted this to end.”

Up on the top of the building, Carlos Lucero is smiling.

Dwyane Wade surprises Miami teen as her prom date

Dwyane Wade, the Heat superstar who is trying to help Miami win a second consecutive NBA championship this spring, surprised a Miami teenager when he showed up unexpectedly at her senior prom on Friday night.

Nicole Muxo made a YouTube video last month inviting Wade to be her date at the Archbishop Coleman Carroll High prom.

She got no reply, though.

Then Wade showed up at the La Jolla Ballroom in Coral Gables, Fla., on Friday night with roses in hand, much to the surprise of Muxo and her classmates.

May 13, 2013           2:51 p.m.

Los Angeles County coroner’s officials released the name of the third man who died in a quadruple shooting Friday in Harbor Gateway that killed three and left one wounded.

Authorities identified the third victim as Courtney George Murray, 44. The other two who died were Laurent Kenroy Latty, 33, of and Dwayne Damion Cover, 33. All three were from Torrance.

Officials said police received a 911 call about 5:35 a.m. Friday from a resident who reported hearing eight or nine gunshots in an apartment building in the 1600 block of West 205th Street. Officers found three of the victims there.

About a block away, police found a fourth shooting victim, covered in blood and walking near Del Amo Boulevard and Western Avenue, said Officer Christopher No. That person was listed in serious condition at a hospital, LAPD Capt. Nancy Lauer said.

Authorities said a red Dodge Charger and a gray Ford Explorer were seen speeding away from the scene. No arrests have been made.

The attack did not appear to be random, police said, and investigators are looking into whether a dispute over drugs led to the shooting.

“This is not gang-related, this is not race-related,” Sgt. Rudy Lopez said. “It appears all the individuals knew each other. It was an argument gone wrong.”

The neighborhood is a mix of houses and apartment buildings, most of them surrounded by wrought-iron fences and many with flowers in the frontyard.

Police said residents in the neighborhood have nothing to fear.

“There is no additional danger to the community members in the area,” LAPD Capt. Nancy Lauer told reporters Friday morning.

One mom got the surprise of a lifetime live on “Good Morning America” this morning, as she was not only shocked by Emeril Lagasse showing up on her doorstep to deliver a very special breakfast in bed, but also meeting her 3-year-old’s bone marrow donor, the woman that saved her leukemia-stricken daughter’s life.

“I can’t believe it,” Nicole Moore, 31, Emeril’s Breakfast in Bed winner said, wiping tears from her eyes. “This is amazing.”

Moore’s mother-in-law, Sally Moore, submitted her for Emeril’s Breakfast in Bed contest, to celebrate Moore on Mother’s Day for caring for her daughter and holding her entire family together through the hardest time of their lives. But she never imaged “GoodMorning America” and chef Emeril Lagasse would actually select Moore, a mom from Sanford, Fla., as the winner.

“A120-word submission and a picture, and ABC heard our story,” Sally Moore told Emeril this morning. “We have made our mess our message, and I’m so proud of my daughter-in-law. She is amazing and worked so hard to get her family through this. I couldn’t be happier. Thank you so much.”

Emeril took the deserving mother, Nicole Moore, by the hand to lead her outside, where she was greeted by special friends, family, fellow church members, nurses from her daughter’s hospital, and even Mickey and Minnie, waiting in her front yard.

“But there’s somebody very special in the crowd,” Emeril explained. “You are about to meet for the first time the young mom that saved your daughter’s life. Kristen, the bone marrow donor.”

The two women immediately embraced, as Moore mustered the words, “Thank you so much,” with tears streaming from her eyes.

“There are no words to describe how grateful I am for her,” Moore said. “What she did for a complete stranger is just amazing. She’s my hero and I just love her so much.”

Her 3-year-old daughter, Lauren, adorned in her Mickey Mouse ears, wrapped her arms tightly around Kristen Eisinger’s neck, the woman who saved her life, knowing exactly who the stranger was and how important she is to her family.

“Everyone just needs to go sign up [to be a donor]. It’s so important,” Eisinger said.

And as if the moment couldn’t have gotten any sweeter, Emeril added the icing on the cake by serving Nicole Moore, her daughter Lauren, and her daughter’s donor, Kristen Eisinger, a breakfast of blueberry pancakes, fresh fruit and more in a bed on her front lawn.

Diagnosis Shatters Family’s Perfect World

After Nicole Moore married her high school sweetheart, Lee Moore, in April 2007, the couple welcomed daughter Lauren, an energetic bundle of joy, into their lives, and in the summer of 2011 had another baby on the way.

“We always had the same goals,” husband Lee Moore said, “We always knew we wanted a family.”

It should have been the happiest time in Nicole Moore’s life.

Nicole Moore was overjoyed to add an addition to their family, but as summer came to an end,her seemingly perfect world quickly and painfully began to fall apart. After weeks of being sick, Lauren, almost 2, wound up in the emergency room.

“We were able to do some blood work fairly quickly and found out that she had leukemia,” said Dr. Eslin of the Arnold Palmer Hospital for Children in Orlando, Fla.

Lauren was diagnosed with T-cell leukemia in August 2011.

It was such a shocking diagnosis that Nicole Moore started going into early labor. As her young daughter lay in the oncology ward, Moore was rushed to the Winnie Palmer Hospital for Women & Babies right across the street.  Miraculously, her early labor stopped and she returned to Lauren, who would have to undergo chemotherapy. Nicole Moore quickly became an expert on Lauren’s rare form of leukemia.

“Nicole, all along, had dedicated herself right from the beginning to make Lauren well,” her mother, Cathy Wise, said.

A few weeks later, Nicole Moore gave birth to a healthy son, Tommy.

Now, she was juggling her sick daughter and caring for a newborn.

“That supernatural mother instinct kicked in and she completely took over. She was always just so determined that this is going to work and I’m going to give everything I got,” husband Lee Moore said. “It focused everybody.”

Despite rounds of chemo, it became clear that would not be enough for Lauren. While 99 percent of children with leukemia go into remission at the end of their first month of chemotherapy, Dr. Eslin said, Lauren was not responding to the treatment. Her only hope was a bone marrow transplant.

“I think that was probably the scariest time,'” sister-in-law Sarah Moore recalled. “It was terrifying because they basically told us, ‘It’s this or nothing. If this doesn’t work, we don’t have the answer.'”

A bone marrow transplant on a now-3-year-old is no easy task, and no one in the family was more than a 50 percent match.

With steely determination, Nicole Moore researched the best centers to take care of her baby girl, staying up late into the morning hours researching hospitals. Finally, the family decided on Seattle Children’s Hospital – thousands of miles away from home.

“The toughest part was that we had such an amazing support system here and we couldn’t pick a farther place away to go than Seattle from Orlando, basically,” Lee Moore said.

Finally, the family received some good news: Doctors had found a “perfect match”for Lauren from a 24-year-old anonymous donor in the National Bone Marrow Registry.

In April2012, just eight months after her diagnosis, Nicole Moore and her family held their breath as Lauren got her transplant.

“One day, I got a text and it said, ‘Lauren has counts,’ which meant the bone marrow’s working. And that was a big deal – a big deal,” father-in-law Tom Moore recalled.

Eventually, they were able to leave the hospital, but Nicole Moore’s job wasn’t over.

“She had to keep her away from other children,” mother-in-law Sally Moore said.”She had to take her to the doctor weekly, sometimes more than weekly, she had blood drawn on a regular basis and she does this with the baby.”

A year later, Lauren is thriving.

“Last year at this time, I think Nicole’s only thought was, ‘I just want her to have a third birthday,’ and now she gets to think about college and getting married and all those things that you’re supposed to get to think about,”sister-in-law Sarah Moore said.

Nicole Moore’s ability to hold her entire family together through the roughest patch of their lives earned her family’s deepest respect, thanks and admiration.

4:50 p.m. EDT              May 10, 2013

New Rutgers men’s basketball coach Eddie Jordan signed a five-year, $6.25 million contract to replace embattled and fired coach Mike Rice back in April.

Jordan’s background as an NBA coach and alum of the school forecasted little, if any controversy with him on the Rutgers sidelines.

That changed Friday.

Jordan, a former star player for the Scarlet Knights in the 1970s, said upon his hiring that Rutgers is “a great place to be. It’s a great degree.”

However, Jordan has not received his degree from the school, an official from the Rutgers Registrar’s office confirmed to USA TODAY Sports on Friday afternoon. Deadspin first reported Jordan’s lack of a degree.

The athletic department is not incorrect in calling Jordan an “alum” because regardless of degree, if you attend a university, that title is adequate by definition. Being an alumnus or alumna of a particular school does mean that you attended said school. It doesn’t necessarily mean you graduated. Technically, one can be an alumnus of two schools without a degree.

Jordan’s bio on the school’s website, however, is incorrect.

RU’s all-time leader in both assists (585) and steals (220), “Fast Eddie” scored 1,632 career points and earned honorable mention All-American honors as a senior in 1977 before earning a degree in health and physical education.

According to Jordan’s transcript, he went on to take additional classes in 1978, 1981 and 1985 after attending the school for an undergraduate degree from 1973-77.

Rice was fired in April after video footage surfaced of the coach physically abusing players. Athletic director Tim Pernetti resigned a few days later.

May 7, 2013            9:58 AM AT

A Cape Breton, N.S., man killed in Alberta is being remembered as a star athlete and academic who leaves behind a young family.

Craig Kelloway had been working in Calgary for six years. He and his wife, who is also from Nova Scotia, have a five-month-old boy. He was a science and math teacher at David Thompson Middle School.

Barry Verbeski is a close family friend. He watched Kelloway grow up in Glace Bay and coached him in high school hockey.

“Craig was very bright, very intelligent,” he said Tuesday morning. “He was very popular with the staff and the students loved him.”

Neighbour charged with murder

Verbeski and his wife were in Halifax when Kelloway died. Harvey Kelloway, Craig’s father, asked them to return to Glace Bay to be with them.

“We were just devastated,” Verbeski said. “We were in disbelief.”

He and his wife drove home in a daze. They found the Kelloway house busy with friends, family and police officers coming to lend support. Harvey Kelloway is a retired police officer. Verbeski said Craig’s mother, Monica, is distraught.

“Harvey’s doing much better, but Monica is not doing well at all. She’s really suffering,” he said. “Harvey told me he didn’t know what he’d do without the police and the relatives that have been visiting.”

Kelloway and his family recently moved to a new area of Calgary. Police say he was murdered during a neighbourhood social gathering.

Nicholas Rasberry, 30, was arrested and charged with second-degree murder. He is due in court Wednesday.

Emergency crews discovered Kelloway’s body after police were called to a home in the 100 block of Auburn Springs Close S.E. at around 11:30 p.m. MT Saturday.

Rasberry was taken into custody without incident at the scene, officials said.

Police said the two men met at Kelloway’s home Saturday afternoon. Police say Kelloway went to Rasberry’s residence Saturday evening and an altercation took place between the two.

Police say other people were present at the home earlier in the evening at the social gathering.

Students remember ‘phenomenal teacher’

Verbeski said the Kelloways are a well-known and well-liked Glace Bay family. Craig learned to swim in his pool with Verbeski’s two sons. “We loved them. They were like two of our own,” he said.

He described Kelloway as a young teacher making his mark in Calgary. “He had so much to offer. It’s very sad and very shocking,” he said. “[His parents] want him home.”

A Facebook memorial page to Kelloway is filled with photos and memories from friends and students.

“Mr. Kelloway was a phenomenal teacher, man and father,” wrote one former student.

Another called him the “best science teacher ever” and thanked him for “pushing me to be my best when no one else in the school would.”

Marina Monro, chairwoman of the David Thompson Parent Council, said the community is shocked and saddened by Kelloway’s death.

“He was wonderful with the kids. He was well liked by everyone at the school and he was by far everyone’s favourite science teacher, and he was one of the favourite teachers,” she said.

“He could teach to their level and was very supportive and made science fun.”

Rob Kardashian charged

May 8, 2013              1:54 p.m.

Rob Kardashian, charged Friday with misdemeanor battery and petty theft, pleaded not guilty Wednesday to the charges stemming from a scuffle with a photographer in March.

While prosecutors had asked that bail be set at $21,000, L.A. Now reported, Judge Marsha Revel (one of the many judges Lindsay Lohan appeared before) let Kardashian go on his own recognizance.

Now maybe the weight-challenged reality star can get back to working out, which is kind of what got all this started in the first place: Kardashian, who’s been working to drop the pounds, wasn’t cool with surprise photos being taken of him shirtless in the parking garage of a West Hollywood gym.

Kardashian was already sued in civil court over the incident, in which he is accused of roughing up the paparazzo who took said pictures while grabbing her camera and taking out the memory card to prevent the pics from ever seeing the tabloid light of day.

Photographer Kassandra Perez, real name Andra Viak, alleged that she was hit in the face and suffered injuries to her arm and chest and said her memory card was worth approximately $30,000, according to April 30 court documents obtained by E! News. The card contained 1,200 pictures of celebs and about 300 freelance photos, the docs stated.

It looks as if Rob’s taking the criminal proceedings seriously: He was represented Wednesday by Robert Shapiro, TMZ said, one of the attorneys in the O.J. Simpson murder case, on which Kardashian’s late father also worked back in the day.

One of the women who survived a weekend limousine fire, killing a bride and four of her friends celebrating her wedding, says the driver did too little to save her friends, which he has denied.

“When he get out from that car, he just opened the door, that’s all he did,” Nelia Arellano, 36, told ABC News affiliate KGO-TV. “I even ask the driver, ‘Open the door, open the door.’ He didn’t do anything.

“I even ask him, ‘Help me, help me,’ because I bring out my head from that compartment and say, ‘Help me,’ so I could squeeze myself over there and slide myself,” she said Monday.

But limousine driver Orville Brown has a different story, saying that he did everything he could to save his passengers.

“I don’t know what we could have done differently to save them,” Brown said in an interview.

Brown, 46, was driving a 1999 Lincoln Town Car limousine Saturday night when it burst into flames as it crossed the San Mateo-Hayward Bridge near San Francisco.

Arellano, one of the four surviving passengers, says she tapped on the partition to alert Brown to the inferno building in the back of the limo where she and eight other women were celebrating the recent nuptials of Neriza Fojas, who died in the blaze.

“I said, ‘There’s already a fire. Stop the car. Stop the car,'” Arellano, 36, told KGO.

Brown told the San Francisco Chronicle he believed the tapping on the partition was the women asking to smoke.

When he finally pulled over, he helped pull Arellano and the other survivors through the limo’s 3 foot by 1 ½-foot partition and out the front door, according to The Associated Press.

Three good Samaritans, including an off-duty California Highway Patrol sergeant, also jumped in to assist.

“Two cars helped us,” Arellano recalled. “I said, ‘I need to go back and save them,’ but the man said, ‘No, you cannot go back anymore.'”

Brown, who escaped unharmed, said one of the survivors did go back to the limo and opened a door, possibly inflaming the fire by providing oxygen.

“When they opened the door, that let the fire get oxygen, that oxygenated the fire, it allowed oxygen to get to the fire and that fire spread so fast,” Brown told KGO, noting there was no explosion or boom along with the fire.

Brown has said in interviews he believes the cause of the fire was electrical, noting it, “could have been smoldering for days.” Authorities have said it is too soon to pinpoint the cause.

The victims’ bodies were found huddled near the partition separating the driver’s section of the car and the rear passenger area, suggesting they were trying to escape the fire, according to San Mateo County Coroner Robert Foucrault.

Fojas, 31, and a second dead passenger, Michelle Estrera, were both nurses at Community Regional Medical Center in Fresno, Calif.

Fojas was recently married in the United States and was planning a second ceremony in the Philippines next month. Fojas and her friends were on their way to the Crowne Plaza Hotel for her bridal shower, where her husband was waiting, according to the San Francisco Chronicle.

Another dead passenger, identified by KGO as Jenny Balon, was a 39-year-old mother of two children.

Her husband, John Balon, says he was told by Arellano that just prior to the fire, smoke poured in from the back of the limo cabin.

“Jenny was all the way back so she wasn’t able to pull her out before the car was engulfed in flames,” he told KGO.

The three survivors hospitalized were identified as Jasmine Desguia, 34, of San Jose; Mary Guardiano, 42, of Alameda; and Amalia Loyola, 48, of San Leandro. Arellano Oakland, was treated and released.

California Highway Patrol Capt. Mike Maskarich said the limousine was over capacity Saturday night.

“This particular vehicle was licensed to carry eight or fewer passengers. As we know, there were nine people in this vehicle,” he said.

The California Highway Patrol is expected to officially release the names of all five victims involved in the limousine fire tragedy today.

It won’t be the happiest Mother’s Day for “The Simpsons” creator Matt Groening. Homer and Marge Simpson can spar forever in animation, but according to a paid obituary in the Oregonian, Groening’s mother, Margaret “Marge” Groening, has passed away in Portland at age 94.

Her husband — cartoonist and presumed lover of donuts, Homer Groening, of course — passed away in 1996. Groening has said that the critically renowned and culturally worshipped show was based on his own family and that he created the show to provide an alternative to the “mainstream trash.” His plan worked. Audiences have adored watching Homer and Marge tangle with their children Bart, Lisa, and Maggie for 24 seasons and counting. Yes, Groening has two sisters: Lisa and Maggie.

There aren’t many pictures of Margaret Groening available out there, but the photograph accompanying her obituary shows a beautiful woman with a bright smile and brown (not blue) hair. Born Margaret Wiggum (another “Simpsons” reference!), the high school English teacher’s accomplishments include being named high school valedictorian as well as May Queen of Linfield College. She married Homer, her high school classmate, “because he made her laugh the most.”

Portland native Lawrence Jackson’s signature on the guest book noted Margaret’s importance to “Simpsons” fans: “You gave the world much joy through your son Matt. You were, in a way, a Mom to us all.”

A Toronto-area man is at home recovering after he was allegedly punched by a rival hockey team fan at a recent NHL playoff game in Boston.

Kyle Hay travelled to Boston with a group of friends to watch the Maple Leafs take on the Bruins at the TD Garden on May 4 in the second game of the current playoff series.

“It worked out that the game was actually on my birthday as well, so we were all pretty pumped about it,” Hay told CBC News in a recent interview.

The 23-year-old remembers hearing a group of rival fans throwing peanuts and empty beer cups at him and his friends.

Hay, who was wearing a Leafs jersey, as well as a blue mask and mohawk, said his group didn’t return the taunts. He said he and his friends focused on celebrating after each goal.

The last thing he remembers is someone hitting him.

“I didn’t see it coming or anything like that,” said Hay.

The blow knocked him out. Hay said he was out for about three to five minutes.

Hay now has three staples in his head. He is awaiting the arrival of his medical bill from the U.S.

Lester Stiggers

2:04 PM             May 7, 2013

Lester Stiggers has been a wanted man for 43 years, but he hasn’t been hiding.

He lives in a one-bedroom apartment, window blinds partly closed, along a busy road in Warren. He gets by on $700 a month in Social Security benefits, usually making trips outside only to see a doctor. He needs an inhaler and 10 pills a day for his diabetes, high blood pressure and other ailments.

A stocky man with thick arms, Stiggers grappled with sewer lines as a plumber until two strokes ended his working days, and also made his speech difficult to understand. He now passes time on the couch, bouncing a companion’s granddaughter on his lap while a children’s show glows from the TV.

Since he fled prison in Arkansas in 1970, Stiggers, a convicted murderer, has been a quirk of justice, living openly in one state while wanted in another. But his time as a free man may be coming to an end as the result of a twist in a decades-old saga involving the dark history of one state’s prison system and the social views of another state’s governor.

Stiggers was one of two young black men given asylum in Michigan in the 1970s by William Milliken, a Midwestern governor who believed in using his powers broadly to address injustice. The fugitives claimed they were victims of unfair treatment in the South.

The cases have largely been forgotten over the years and, until this spring, Stiggers thought he had been, too.

By sending a letter seeking Stiggers’ return, Arkansas abruptly renewed its efforts to bring him back to prison where he was sentenced to spend the rest of his life. And Michigan is considering it.

The man at the center of the tale is now 63. He was astounded when reporters from The Associated Press knocked on his door and told him of Arkansas’ request.

“I’m an invalid now. I’m half dead,” Stiggers said. “What would their interest be to have me back?”

Stiggers’ life is entwined with the history of Arkansas’ prisons in the 1960s. The brutality and horrific conditions were documented by penal reformer Thomas Murton and inspired the 1980 Robert Redford movie “Brubaker.”

Stiggers was sent to a state prison farm at the age of 15 after he was convicted of killing his father, whom he said beat him and his mother regularly. Stiggers said he never talked about the abuse at his trial because his lawyer advised him not to testify. The AP couldn’t reach anyone involved in the trial.

When Stiggers was allowed a five-day furlough for good behavior — a privilege no longer available to those convicted of such serious crimes — he went to Michigan, where his mother lived. He’s been there ever since.

When Arkansas requested his return at the time, Milliken refused, citing, in part, the “cruel and unusual treatment” in Arkansas’ prisons.

At the sprawling Tucker prison farm where Stiggers was held, inmate “trusties” guarded prisoners working the fields. Stiggers said he was forced to pick cotton and endured beatings.

“I’d probably be dead right now,” Stiggers said, if he hadn’t absconded.

The year he fled, a federal judge, Jesse Smith Henley, declared the state’s entire prison system unconstitutional, writing: “In a very real sense, trusty guards have the power of life and death over other inmates.”

Milliken’s decision to rebuff’s Arkansas’ extradition request was in character for the moderate Republican who held the office from 1969 to 1982. Milliken, a soft-spoken white businessman from the northern Michigan town of Traverse City, built a relationship with Detroit’s fiery black mayor, Coleman Young, and boosted state assistance to the city during a time of intense racial strife.

“No purpose would be served now by sending that man back,” Milliken, who is now 91, said in an interview. He said he does not remember Stiggers but, “Knowing how distressed I was about the shameful state of race relations in our country, I would have wanted to give that man another chance.”

Over the years, Arkansas made more requests for Stiggers’ return, but they were unsuccessful.

Michigan’s current governor is Republican Rick Snyder. A spokesman, Caleb Buhs, said Snyder has no timeline for reviewing the new request, which came after Stiggers’ Social Security benefits put him back on Arkansas’ radar.

M. Gerald Schwartzbach, who represented the fugitive years ago in Michigan, says it would be “an enormous tragedy” to incarcerate him now.

“How is this justice?” he asked.

Prisons officials in Arkansas say getting him back behind bars is a matter of principle.

“I understand the argument, ‘Well, he’s been out for all these years, he hasn’t reoffended,’” said Shea Wilson, spokeswoman for the Arkansas Department of Correction. “But the fact still remains that he was convicted of first-degree murder in Arkansas. He served a minimum of his sentence and he has been a fugitive from justice for all these years.”

Stiggers may be in trouble. The Supreme Court clarified extradition law in 1987, creating a precedent that forced Michigan to return Phillip Chance, a convicted murderer also given sanctuary by Milliken, to Alabama in 1996.

“To the extent that he deserves mercy, it’s up to Arkansas to show mercy. Michigan’s hands are tied,” said Curt Benson, a law professor at Thomas M. Cooley Law School in Grand Rapids, Mich.

Stiggers said he has justified Michigan’s faith in him.

“I don’t smoke. I don’t drink. I don’t do nothin’,” he said during an hour-long interview. “I walked away from a lot of fights. … They told me to stay out of trouble.”

Stiggers said his wife, Arnetta, died in 2010, and they had no children. He worked as a press operator for Chrysler for five years before becoming a plumber.

Retired, he lives with a companion, Delphine Hopkins, and they help each other keep track of their medications.

“One of us always has a doctor’s appointment,” she said.

In 43 years, Stiggers said, he’s never set foot outside the state he fled to — and he hopes he never will.

Earlier this year Vladimir Tretchikoff’s portrait Chinese Girl, often referred to as The Green Lady, was sold for almost £1m ($1.5m) at auction in London – a reflection of its status as one of the most popular prints ever made. The model, Monika Pon-su-san, recalls what it was like to be thrust into the limelight.

One day in 1950, a curly-haired stranger walked into my uncle’s laundry in Cape Town, where I worked.

He stood there as I served a customer, his eyes fixed on me the whole time. He only spoke when we were alone together in the shop.

“Hello!” he said. “I’m Tretchikoff. I’d love to paint you.”

At that time Vladimir Tretchikoff wasn’t very famous but by chance I had read about him in a newspaper just the Saturday before.

So I was a bit nervous, but I said Yes. He picked me up after work and took me back home.

I was given his wife’s gown to put on. It was silk chiffon – beautiful, beautiful stuff. It wasn’t yellow like in the painting – that was his own invention.

A lot of people ask me: “What is that stern look you had on your face? What were you thinking about?” And I always say: “Well you know, one gets tired sitting and just looking.”

Monika Pon-su-san

All the time I was thinking about Tretchikoff’s life. Because he had had a miserable life – during the war he’d been on a boat for three weeks without food, after his ship was bombed. Then he was imprisoned by the Japanese.

He had lost contact with his wife and daughter. Thinking they were dead he took a lover, but they weren’t dead and as fate would have it, they went to Cape Town, which is where he ended up too. So they got back together again.

I liked him very much. He was a funny man – we always laughed a lot. In all, I was paid six pounds and five shillings for the work.

He had a class of about 20 pupils. All the time I was sitting for him they could see me but I was never allowed to see the painting – it always had its back to me.

Monika Pon-su-san

I would nag him: “What are you going to call it?” He said that a name would come to him later on. It was only at the end of the six or 10 weeks – I can’t remember exactly how long it took – on the night his exhibition opened that he said it was called Chinese Girl. I thought that was very ordinary.

Monika Pon-su-san

  • In her late teens when she posed for Tretchikoff
  • Sat for two portraits – in the other her tunic is shown in its real colours (blue and pink)
  • After school, she got married and moved to Johannesburg, where she had five children
  • Worked in the family fish and chip shop, and as a shipping clerk
  • She never posed for another painting

And when I saw the painting I was so shocked. I thought I looked like a monster from a horror film. I pulled an ugly face and said “Ugh – green face!”

Right away people started to recognise me. I remember going to a supermarket and a woman shouted, “Look at this girl! She looks just like the painting!”

I decided I had to buy a print. By the time I went to him Tretchikoff had run out, so he gave me one he had used in London when he was on tour. I’ve got it in my lounge.

Monika Pon-su-san

There was a block of flats in Cape Town, filled with artists. The man on the ground floor was a sculptor and one day he asked Tretchikoff, “Can I borrow your model?” He wanted to cast a bronze of my face. But Tretchikoff said: “Certainly not!”

I had so many modelling offers but – stupid me – I went and got married and had children, so that was that. I didn’t socialise much, with five children to look after, so I was hidden away from Cape Town’s artists. The offers stopped coming.

I was so disappointed to miss the auction recently. My daughters said to me: “The painting’s sold! The painting’s sold!” And when I found out it had gone for £1m, I jumped up and down, up and down!

Everybody’s fascinated by that painting. I don’t know what it is about it really.

Monika Pon-su-san

One of my daughters -the second youngest, who is supposed to look like me – said: “I wish I had a lot of money and then I would buy that painting and keep it forever in my own house.”

When I was asked by a journalist if I would let another artist paint me at this moment in time, I said No… but if Tretchikoff were alive, I would let him paint me again.

Police in Freeport, Texas say a high school teacher’s illicit relationship with a student was brought to light after the teacher showed up at an after-prom party with tattered clothing and no shoes.

Nikki Scherwitz, 25, has been charged with sexual assault of a child and improper relationship between educator and student, WREG reported. She has also quit her position as 10th-grade English teacher at Brazosport High School, KTRK reported. It was her first year on the job.

Investigators say Scherwitz had been involved with the 16-year-old for several weeks.

“The relationship started with text messaging, which led to explicit text messaging, which led to the relationship,” Officer Raymond Garivey told KTRK.

The investigation began after the teacher allegedly showed up at an after-prom party at another student’s home on April 20, KHOU reported.

“She was wearing no shoes when she showed up . . . like a cut up, cut-off shirt and everything,” a student told the station.

Garivey said that Scherwitz had been drinking, and one of the students at the party asked her to leave. She allegedly did leave — with her alleged victim.

Five women killed in a bizarre limousine fire Saturday night in the Bay Area were part of a bachelorette party that included the bride-to-be, according to authorities and local media reports.

The victims have not been identified, pending notification of relatives, authorities said. Four other women and the driver of vehicle managed to escaped the burning vehicle, which was crossing the San Mateo Bridge at the time.

San Mateo County Coroner Robert Foucrault told the San Jose Mercury News that the limousine picked up the women in Oakland and was taking them to a hotel in Foster City as part of a bachelorette party. The bride was among those killed, the paper reported.

A dispatcher for Limo Stop, the limousine’s operator, told the reporter that the company was cooperating with the investigation.

“We are very shocked,” Limo Stop dispatcher Pam said.

The surviving passengers — Jasmine Desguia, 34, of San Jose; Amalia Loyola, 48, of San Leandro; Nelia Arellano, 36, of Oakland; and Mary Guardiano, 42, of Alameda — were taken to area hospitals where they were treated for moderate burns and smoke inhalation, authorities said.  The driver, Orville Brown, 46, of San Jose, was not injured in the accident.

Authorities said it could take days to determine the cause of the fire.

“This is not something that gets rushed through,” said CHP Officer James Evans.

2:00 p.m.            Sunday May 5, 2013

It was the biggest beehive that that Ogden beekeeper Vic Bachman has ever removed — a dozen feet long, packed inside the eve of a cabin in Ogden Valley.

“We figure we got 15 pounds of bees out of there,” said Bachman, who said that converts to about 60,000 honeybees.

Bachman was called to the A-frame cabin last month in Eden, Utah. Taking apart a panel that hid roof rafters, he had no idea he would find honeycombs packed 12 feet long, 4 feet wide and 16 inches deep.

The honeybees had been making the enclosed cavity their home since 1996, hardly bothering the homeowners. The cabin was rarely used, but when the owners needed to occupy it while building another home nearby, they decided the beehive wasn’t safe for their two children. A few bees had found their way inside the house, and the hive was just outside a window of a children’s bedroom.

They didn’t want to kill the honeybees, a species in decline that does yeoman’s work pollinating flowers and crops.

So they called Bachman, owner of Deseret Hive Supply, a hobbyist store that can’t keep up with demand for honeybees. Bachman used a vacuum cleaner to suck the bees into a cage.

“It doesn’t hurt them,” he said.

The job took six hours. At $100 an hour, the bill came to $600.

“The bees were expensive,” said Paul Bertagnolli, the cabin owner. He was satisfied with the job.

Utah calls itself the Beehive state, a symbol of industriousness. Whether this was Utah’s largest beehive is unknown, but Bachman said it would rank high.

“It’s the biggest one I’ve ever seen,” he said. “I’ve never seen one that big.”

He used smoke to pacify the bees, but Bertagnolli said honeybees are gentle creatures unlike predatory yellow jackets or hornets, which attack, rip apart and eat honeybees, he said.

“They just want to collect nectar and come back to the hive,” he said. “Most people never get stung by honeybees — it’s a yellow jacket.”

Bertagnolli reassembled the hive in a yard of his North Ogden home, while saving some of the honeycomb for candles and lotions at his store. He left other honeycombs for the cabin owners to chew on.

“We caught the queen and were able to keep her,” Bertagnolli said. “The hive is in my backyard right now and is doing well.”

PHOTO: Ramineh Behbehanian was arrested in San Jose, Calif. for attempted murder after she put poison in an orange juice container at at Starbucks on April 29, 2013.

May 1, 2013

The woman accused of putting tainted bottles of orange juice in a Starbucks refrigerated display is a professional chemist, said police who also told ABC News that she is refusing to respond to police questioning about why she allegedly put poisoned bottles in reach of customers.

Ramineh Behbehanian, 50, of San Jose, Calif., works in the research and development department of a pharmaceutical subsidiary of Johnson & Johnson.

San Jose Police Department spokesman Officer Albert Morales told ABC News that Behbehanian refused to speak to officers following her arrest and requested an attorney.

“There is no information at this time that there were any associates,” said Morales. “We’re searching for answers.”

Greg Panico, a spokesman for the J&J subsidiary Janssen Pharmaceuticals confirmed to ABC News that Behbehanian was currently an employee in the company’s research and development department in Fremont, Calif.,

Panico could not confirm how long she has worked for Janssen. According to her LinkedIn profile, she has been there since August 2006, and has expertise in “drug delivery and controlled release technologies,” among other things.

Her LinkedIn profile also states that she has a master’s degree in physical chemistry and chemical engineering from Lehigh University in Bethlehem, Pa. The university did not immediately respond to ABC News’ attempts to verify Behbehanian’s educational history.

Behbehanian was booked on charges of attempted murder and poisoning for allegedly swapping bottles of a Starbucks-owned orange juice brand with contaminated bottles from her purse. She was arrested Monday after a customer in a San Jose Starbucks spotted her switching bottles, said police.

As the witness was notifying Starbucks employees of the woman’s suspicious activity, police said, the suspect apparently overheard the conversation and fled.

The San Jose Fire Department responded to the store after Starbucks employees examined the bottles and found the contents had a toxic smell to them. The bottles were tested with hazardous materials equipment and were found to contain a mixture of isopropyl alcohol, or rubbing alcohol, police said.

A Starbucks employee was able to record the license plate of the woman’s car. Later Monday evening, Behbehanian was taken into custody after she was found to be the owner of the car leaving the scene, police said.

Starbucks spokesman Zach Hutson said no one consumed the contaminated juice and that all of the juice in the store was destroyed “out of an abundance of caution.” Hutson said that other stores in the area were asked to check juice bottles’ safety seals to make sure they weren’t tampered with.

Behbehanian is being held without bail at Elmwood Complex Women’s Facility in Milpitas, Calif. Her arraignment is scheduled for Thursday, Morales said.

It is unclear if Behbehanian has an attorney.

Mingo County Sheriff Eugene Crum was fatally shot Wednesday outside the Mingo County courthouse, WCHS reports.

The courthouse was evacuated and placed on lock down, WSAZ reports.

WCHS reports that a suspect has been taken into custody.

The suspect was shot but is “alert and talking,” and has been taken to the hospital, according to the Charleston Daily Mail.

Crum was eating lunch when a suspect drove by and fired at him, a county commissioner said, according to the Charleston Daily Mail. West Virginia House Delegate Justin Marcum said Crum enjoyed having his lunch in a place where he could see a former “pill mill,” the paper reported.

While campaigning for Mingo County Sheriff, Crum made drug control a central part of his platform, according to Charleston Gazette. House Finance Chairman Harry Keith White said Crum had been “aggressive” in combating drugs during his brief time as Mingo County Sheriff.

“Eugene Crum has exceeded my highest expectations as Mingo County Drug Enforcement Investigator and now as Mingo County Sheriff,” said Mingo County prosecutor C. Michael Sparks in January, according to WOWK-TV.

Short-track fans at Daytona International Speedway and a national television audience were treated to a dramatic late-race duel between Kyle Larson and C.E. Falk in the NASCAR All-American Tour Late Model race on Monday night. Larson won the race but controversy raged to kick off the two-day Battle at the Beach short track event at the World Center of Racing.

Larson trailed Falk with six laps to go and appeared to make his move too soon, getting under Falk and passing him off the exit of turn two. Falk immediately ducked under Larson and retook the point, going into turns three and four. Larson closely trailed Falk until the last lap when, using the lap car of Trey Gibson as a pic, he got behind Falk and turned him before the start/finish line.

Larson crossed the line first and Falk scrambled to finish third, just behind the surging Ben Rhodes who led the most laps and beat Falk to the checkered flag. Falk had every right to be furious but was surprisingly calm following the race.

“Look, I’m not a 15-year-old kid anymore,” Falk said. “I’m 25 years old and I want to be in this sport for a long time. I can’t get there by acting like a spoiled brat. I had a moment to vent when I walked over to turn 1 and that was it. When you have the cameras on you like this, you need to be a professional. Kids were watching this race, especially on Speed on a Monday night, and they’re looking for someone to look up to.”

Ultimately, Falk believes there wasn’t much more he could have done. He wishes Larson hadn’t turned him but, on the last lap at a short track, Falk said that anything goes.

“I was staying on the brakes as long as I could,” Falk said. “I’ve been short track racing for a long time and on the last lap, when you’re two car-lengths ahead, you’re pretty much free game up front — you’re just a sitting duck… I just tried to protect the bottom best I could and tried to cut the corner and get around that tire barrier but he got into me once, thought I would be OK, and the wheels were just spinning.

“He got into me that last time and he turned me at the line. I wish he hadn’t done that but on the last lap, it’s anything goes.”

Larson admits that he was too aggressive at the end – dirty even – but did what he had to do to win the trophy, a replica of those handed to the winner of the Grand National races held on beach circuit in NASCAR’s youth.

“I don’t do a lot of short track racing,” Larson said. “But every video I’ve ever seen of it, the second-place driver wins in this scenario. I did what I think C.E. would have done to me if the positions were reversed.”

Both drivers had used up most of their brakes at the end of the race, with Larson saying he had to lean back into the seat just to put pressure on his brake pads. Decreased brakes forced the drivers to let off the throttle early to get a better entry and thus resulted in some of the contact between the two at the end.

“I hit the center of his bumper and got up underneath him and just turned him around,” Larson said. “I feel bad for him but we were coming to the finish line.”

February 7, 2013

The fired California cop who set off a region-wide manhunt after allegedly shooting three police officers this morning — one fatally — had initially gone to a yacht club near San Diego where police say he attempted to steal a boat and flee to Mexico.

Police say that former police officer Christopher Jordan Dorner, 33, who officials believe posted an online manifesto outlining his plan to “terminate” his former colleagues and their families, is armed with a long gun and might have several other guns and high-capacity magazines. He is also believed to have access to military uniforms because he has served in the Navy.

“We are considering him armed and dangerous,” Lt. Julia Engen of the Irvine Police Department said.

Police allege that he went to the yacht club Wednesday night at Point Loma, Calif., near San Diego to steal the boat. He aborted the attempted theft when the boat’s propeller became entangled in a rope, law enforcement officials said. It was at that point he is believed to have headed to Riverside, where he allegedly shot two police officers.

“He pointed a handgun at the victim [at the yacht club] and demanded the boat,” Lt. David Rohowits of the San Diego Police Department said.

Police say the rifle marksman shot at four officers in two incidents overnight, hitting three of them: one in Corona, Calif., and the two in Riverside, Calif.

Sgt. Rudy Lopez of the LAPD said two LAPD officers were in Corona and headed out on special detail to check on one of the individuals named in Dorner’s manifesto. Dorner allegedly grazed one of them but missed the other.

“[This is an] extremely tense situation,” Lopez said. “We call this a manhunt. We approach it cautiously because of the propensity of what has already happened.”

The Riverside Police Department said two of its officers were shot before one of them died, KABC-TV reported. The other is in stable condition with two gunshot wounds, police say.

“They were on routine patrol stopped at a stop light when they were ambushed,” Lt. Guy Toussant of the Riverside police department said.

In the manifesto Dorner published online, he threatened at least 12 people by name, along with their families.

“Your lack of ethics and conspiring to wrong a just individual are over. Suppressing the truth will leave to deadly consequences for you and your family,” Dorner wrote in his manifesto.

A badge and identification belonging to Dorner have been found in San Diego, according to San Diego police Sgt. Ray Battrick. Dorner’s LAPD badge and ID were found by someone near the city’s airport, and turned in to police overnight, The Associated Press reported.

Police around Southern California are wearing tactical gear, including helmets and guns across their chests. The light-up signs along California highways show the license plate number of Dorner’s car, and say to call 911 if it is seen. The problem, police say, is that they believe Dorner is switching license plates on his car, a 2005 charcoal-gray Nissan Titan pickup truck.

Los Angeles Police Department Chief Charlie Beck said today that 40 protective details have been deployed to protect officers and their families.

“We are taking all measures possible to ensure safety of our officers and their families,” he said.

Dorner is also believed to be responsible for the weekend slayings of an assistant women’s college basketball coach and her fiancé in what cops believe are acts of revenge against the LAPD, as suggested in his online manifesto.

Lawrence was found slumped behind the wheel of his white Kia in the parking lot of their upscale apartment complex in Irvine Sunday and Quan was in the passenger seat.

“A particular interest at this point in the investigation is a multi-page manifesto in which the suspect has implicated himself in the slayings,” Maggard said.

Police said Dorner’s manifesto included threats against members of the LAPD. Police say they are taking extra measures to ensure the safety of officers and their families.

The document, allegedly posted on an Internet message board this week, apparently blames Quan’s father, retired LAPD Capt. Randy Quan, for his firing from the department.

One passage from the manifesto reads, “I will bring unconventional and asymmetrical warfare to those in LAPD uniform whether on or off duty.”

“I never had the opportunity to have a family of my own,” it reads. “I’m terminating yours.”

Dorner was with the department from 2005 until 2008, when he was fired for making false statements.

Randy Quan, who became a lawyer in retirement, represented Dorner in front of the Board of Rights, a tribunal that ruled against Dorner at the time of his dismissal, LAPD Capt. William Hayes told The Associated Press Wednesday night.

According to documents from a court of appeals hearing in October 2011, Dorner was fired from the LAPD after he made a complaint against his field-training officer, Sgt. Teresa Evans, saying in the course of an arrest she had kicked a suspect who was a schizophrenic with severe dementia.

After an investigation, Dorner was fired for making false statements.

Myles Wilkinson won a fantasy football contest to attend Super Bowl XLVII, but his dreams of going to the big game went up in smoke because of a 1981 pot bust.

According to a story by the CBC, the 50-year Canadian man was denied entry to the United States this week because of a conviction for possession of two grams of marijuana over 30 years ago.

Wilkinson, a Seattle Seahawks fan from Vancouver Island, beat out almost four million other players to win the trip to see the San Francisco 49ers play the Baltimore Ravens. But when he got to the airport on Thursday, U.S. customs agents brought up an arrest the man had when he was 19. They denied him entry to the country and ended any chance of making it down to New Orleans for a memorable weekend.

“I had two grams of cannabis. I paid a $50 fine,” Wilkinson told CBC. “I can’t believe that this is happening, for something that happened 32 years ago.”

CBC said Bud Light Canada, who sponsored the contest, invited Wilkinson to their Super Bowl party in Vancouver after hearing about his unfortunate situation.

That’s a nice gesture and Vancouver is a very beautiful city, but let’s be blunt: It’s also the most depressing consolation gift ever.

THE third most senior member of Julia Gillard’s team, Senate leader Chris Evans, will announce his shock resignation as a minister and Attorney-General Nicola Roxon is reportedly about to resign from the cabinet.

According to the The Australian newspaper, Ms Roxon will step down from her cabinet portfolio and retire from politics at the September 14 election.

Ms Roxon’s apparent departure comes on the heels of news that the government leader in the Senate, Chris Evans, will resign from the ministry on Saturday. His departure could lead to a battle to replace him as Senate leader between Communications Minister Stephen Conroy and Finance Minister Penny Wong.

The shock resignation of Ms Roxon, a solid Gillard supporter, created a storm of commentary within ALP ranks late last night as the word spread she was stepping down and not expected to contest the next election.

One senior Labor MP told The Weekend Australian late last night that “Rome is burning”.

Attorney General Nicola Roxon

Attorney-General Nicola Roxon is expected to announce her shock retirement from politics, in another bombshell blow to Labor.

Amid speculation in Labor circles last night, it was understood Ms Roxon’s portfolio would be given to Mark Dreyfus, The Australian reported.

The reports of her resignation were supported by tweets from Sky News host Peter van Onselen and Seven Network’s Mark Riley.

Attorney-General Nicola Roxon has become the second senior Labor MP to resign from cabinet.

“Nicola Roxon to resign from cabinet early tomorrow,” van Onselen tweeted late on Friday.

In the Senate, the party leader is elected by MPs and traditionally from the party’s Left faction. Senator Conroy has been deputy leader for five years but is from the Right faction.

Last night there was a suggestion Senator Wong would support Senator Conroy and become deputy to replace Mr Evans, although some MPs were urging her to run for the top spot. A ballot would be held on Monday, if required.

Senator Evans is Minister for Tertiary Education, Skills, Science and Research. One option being considered by Ms Gillard is giving that post to Immigration Minister Chris Bowen with his nightmare portfolio going to Small Business Minister Brendan O’Connor.

Ms Gillard was still working on the changes last night and is expected to finalise the line up today.

Small Business is tipped to stay in Cabinet and some believe Treasurer Wayne Swan should add that portfolio to his job to elevate the importance of the sector ahead of the election.

Mental Health and Ageing Minister Mark Butler may pick up Mr O’Connor’s other portfolios of Housing and Homeless.

It is unclear if there will be a new Cabinet minister but there will be a new junior minister. Victorian Mark Dreyfus or Mike Kelly from NSW are among those who could be promoted.

There was no response from Senator Evans’ office last night but his WA Senate colleague Mark Bishop confirmed his departure on Twitter.

“Resignation of Chris Evans a loss. Serious, hardworking competent minister. Unassuming, consistent and effective senate leader.”

The low-profile Senator Evans has also been minister for industrial relations and as immigration minister dismantled the Pacific Solution, which Ms Gillard was forced to resurrect last year. He has been an MP since 1993.

Senator Evans’ WA Senate colleague, Mark Bishop, told AAP the senator’s Perth colleagues had been aware for “some time” that the commute to Canberra was taking its toll.

“I think the actual timing is a surprise,” he said on Friday night.

“Chris has been commenting to people for some time that he is tired.”

He said the resignation could have serious organisational and political “consequences” for Labor in WA.

“Chris had access to everyone who was important in Western Australia … the government will lose that inside edge,” Senator Bishop said.

Christopher Pyne, manager of opposition business in the House, said Senator Evans’ resignation “spoke volumes” about the state of federal Labor nearly eight months from the election.

“The information that I have is that Chris Evans has resigned not because of ill health, which was my first thought, but because he’s just had enough,” Mr Pyne said.

“And for the Senate leader and a cabinet minister to decide that he’s just had enough speaks volumes for a dysfunctional Labor government.”

He said he believed more resignations would follow.

“I don’t want to speculate that this might be part of a (Kevin) Rudd push for the leadership, but it seems particularly odd that two days after the prime minister has fired the starter gun for an election campaign, her Senate leader has resigned, Craig Thomson has been charged with 149 offences, and one would have to say that the election campaign has got off to a very rocky start,” he said.

Caleb Moore, an innovative freestyle snowmobile rider who was hurt in a crash at the Winter X Games in Colorado, died Thursday morning. He was 25.

Moore was being treated at a hospital in Grand Junction since the Jan. 24 crash. Family spokeswoman Chelsea Lawson confirmed his death, the first in the 18 year history of the X Games.

“He lived his life to the fullest. He was an inspiration,” Lawson said.

A former all-terrain vehicle racer, Moore switched over to snowmobiles as a teenager and quickly rose to the top of the sport. He won four Winter X Games medals, including a bronze last season when his younger brother, Colten, captured gold.

Caleb Moore was attempting a backflip in the freestyle event in Aspen when the skis on his 450-pound snowmobile caught the lip of the landing area, sending him flying over the handlebars. Moore landed face first into the snow with his snowmobile rolling over him.

Moore stayed down for quite some time, before walking off with help and going to a hospital to treat a concussion. Moore developed bleeding around his heart and was flown to a hospital in Grand Junction for surgery. The family later said that Moore, of Krum, Texas, also had a complication involving his brain.

Colten Moore was injured in a separate crash that same night. He suffered a separated pelvis in the spill.

The family said in a statement they were grateful for all the prayers and support they have received from people around the world.

X Games officials expressed their condolences and said Moore, a four-time X Games medalist, would be remembered “for his natural passion for life and his deep love for his family and friends.”

B.C. Vaught, Caleb Moore’s agent for almost a decade, said he first saw Moore when he was racing an ATV in Minnesota and signed him up to star in some action sports movies.

Later, Moore wanted to make the switch from ATVs to snowmobiles and Vaught helped him. A natural talent, it only took Moore two weeks to master a difficult backflip.

Moore’s brother also got involved in snowmobiling, the close-knit duo pushing each other to become better.

Moore honed his skills in Krum, a town about 5,000 people 50 miles northwest of Dallas that rarely sees snow. Instead, he worked on tricks by launching his sled into a foam pit. After a brief training run on snow ramps in Michigan, he was ready for his sport’s biggest stage – the 2010 Winter X Games.

In that contest, Moore captured a bronze in freestyle and finished sixth in best trick. Two years later, his biography on ESPN said, “Caleb Moore has gone from `beginner’s luck’ to `serious threat.'”

That was hardly a surprise to Vaught, who said, “Whatever he wanted to do, he did it.”

Vaught said Moore didn’t believe his sport was too extreme, but rather “it was a lifestyle.” He was good at it – along with ATV racing – as he accumulated a garage full of trophies.

Fellow snowmobile rider Levi LaVallee recently described Moore as a “fierce competitor.”

“A very creative mind,” LaVallee said. “I’ve watched him try some crazy, crazy tricks and some of them were successful, some of them not so much. But he was first guy to get back on a sled and go try it again. It shows a lot of heart.”

X Games officials said in a statement that they would conduct a thorough review of freestyle snowmobiling events and adopt any appropriate changes.

“For 18 years, we have worked closely on safety issues with athletes, course designers and other experts. Still, when the world’s best compete at the highest level in any sport, risks remain,” they said, noting that Moore was hurt performing a move he had done several times before.

Numerous charges have been filed against a New York woman who was allegedly drunk and wearing only an unzipped jacket when she crashed her car into a stone retaining wall in New Jersey and then drove off.

The crash occurred early Friday in the northwestern New Jersey community of Sparta Township.

A township officer stopped the car just minutes after the crash. The driver, 36-year-old Catherine Giaquinto, of Warwick, allegedly told police she couldn’t remember the accident or where she was going.

After noticing some clothes in her car, officers asked Giaquinto to get dressed, which she did after several minutes.

It’s not known if Giaquinto has retained a lawyer. A phone number for her could not be located Monday.

January 20, 2013                5:54AM

ALGERIA’S four-day hostage standoff came to a bloody end overnight when the country’s special forces stormed the remote desert gas plant and killed 11 militants, but not before they in turn executed seven hostages, the state news agency reported.

The report, quoting a security source, didn’t specify if any hostages or militants remained alive or give the nationalities of the dead.

“The (army) assault took place mid-morning. Eleven terrorists lost their lives along with the foreign hostages,” the security source told AFP.

“We think they were killed in retaliation” for the army attack, the source said.
Algerian authorities estimated that around 30 militants occupied the Ain Amenas on Wednesday and with 18 already reported dead, it appears the hostage crisis involving hundreds of plant workers is finally over.
Experts have begun to clear the complex of bombs planted by the Islamists, says Sonatrach, the Algerian firm that runs the gas plant jointly with Britain’s BP and Norway’s Statoil.
British Defence Minister Philip Hammond calls the loss of life appalling and unacceptable. He says “it is the terrorists that bear the sole responsibility for it.”
Mr Hammond was speaking at a news conference with US Defence Secretary Leon Panetta, who said much remains “sketchy” but “we know that lives have been lost.”
Mr Panetta refused to criticise Algeria. “They are in the region, they understand the threat from terrorism … I think it’s important that we continue to work with (Algiers) to develop a regional approach.”
“We’re pressing the Algerians for details on the exact situation,” said Mr Hammond.
British Foreign Secretary William Hague said Britain must prepare itself for “bad news,” and that “the large majority” of Britons originally caught up in the crisis were safe, with “fewer than 10” at risk or unaccounted for.
France said no more of its nationals are being held hostage. French Defence Minister Jean-Yves Le Drian said on France 3 television that a Frenchman had been killed in the attack and other captured French nationals had been freed.
Mr Le Drian said he could not confirm that a French national, who he said used the surname Le Guen, was among the attackers at the Algerian gas plant but that he expected to find out soon. He said Le Guen had been in neighbouring Mali for the past several weeks.
The French national killed in the assault has been named as Yann Desjeux, a former special forces soldier who was also the co-owner of a restaurant in the southwestern beach town of Anglet.
President Francois Hollande said French troops would stay in Mali as long as is needed “to defeat terrorism” in the West African country and its neighbours.
There was no official count of how many hostages were still being held by the final group of militants holed up in the gas refinery overnight, but the militants themselves had reported they were still holding three Belgian, two Americans, a Japanese and a Briton.

Earlier, Islamist gunmen remained holed up with an unknown number of foreign hostages at a gas plant in the Algerian desert, amid uncertainty over what the army was doing to free their captives.

A Romanian national has been killed and another injured in the Algeria hostage crisis, Romania’s Prime Minister Victor Ponta says.

“We have just had confirmation of the death of one of the five Romanians held hostage in Algeria,” he told a press conference on Saturday.

Foreign Minister Titus Corlatean said authorities in Bucharest did not yet know how the hostage died.

ALGERIA-MALI-CONFLICT-KIDNAP

Two freed British hostages identified as Peter (centre) and Alan (left) with an unidentified Norwegian hostage outside a police station in Ain Amenas, Algeria.

The foreign ministry is keeping the families of the five Romanians abreast of events as they develop.

The ministry had previously announced that three Romanians had been freed, but did not say if any others were still being held by Islamist gunmen at a remote gas plant in the Algerian desert.

The final raid came after the situation appeared to be at a stand-off. More than 72 hours after the heavily armed militants staged a deadly raid on the complex, and two days after Algerian special forces launched a botched rescue bid widely condemned as hasty.

On Friday, a security official said troops were trying to reach a “peaceful” end to the crisis, before “neutralising the terrorist group that is holed up in the plant and freeing a group of hostages still being held there.”

Earlier, The gunmen, cited by Mauritania’s ANI news agency, said they were still holding three Belgians, two Americans, one Japanese and a Briton, although Belgium said there was no indication that any of its nationals were being held.

Amid the virtual news blackout in Algiers, harshly criticised by the local media, world leaders were taking a tough stand on insisting that the remaining hostages be freed.

Freed Algerian hostages arrive at Algiers airport after they were released by Islamist captors from a gas plant in In Amenas. Seven foreign hostages and 11 Islamist gunmen were killed on Saturday when the desert stand-off ended in a bloodbath.

US Defence Secretary Leon Panetta said Washington would “take all necessary steps to protect our people” from the threat of al-Qaida-affiliated militants in north Africa.

“Whether or not that involves assisting others with military operations, whether it involves developing in a cooperative way operations there, those are areas that I think remain to be decided,” he told the BBC.

On Friday, Mr Panetta had said Washington was “working around the clock” to secure the safe return of Americans, after at least one was confirmed dead.

A US official said a military aircraft had begun to help evacuate survivors, but gave no estimate of the number of US hostages.

Earlier, US Secretary of State Hillary Clinton said at a news conference with Japanese Foreign Minister Fumio Kishida that Washington remained “deeply concerned about those who remain in danger. Utmost care must be taken to preserve innocent life.”

Mr Kishida urged Algeria to place the “utmost priority” on ensuring the remaining hostages’ safety.
In Tokyo, Prime Minister Shinzo Abe ordered his government to do everything possible to ensure the safety of those Japanese unaccounted for in what he called “an extremely despicable” incident that “can never be forgiven.”

“I would like you to do your best to confirm the safety of the Japanese and rescue them by using every possible means,” Mr Abe told top government officials after cutting short a trip to Southeast Asia.

The UN Security Council “condemned in the strongest terms the terrorist attack” and “underlined the need to bring perpetrators, organisers, financiers and sponsors of these reprehensible acts of terrorism to justice.”

Algerian news agency APS quoted a government official as saying the kidnappers, who claimed to have comefrom Niger, were armed with machineguns, assault rifles, rocket launchers and missiles.

They belong to a group known as “Signatories in Blood,” led by a Algerian Mokhtar Belmokhtar, a former senior al-Qaida commander in north Africa. The group is demanding an end to French intervention in neighbouring Mali, Mauritania’s ANI news agency quoted sources close to Belmokhtar as saying.

Belmokhtar also called for exchanging American hostages for the blind Egyptian sheikh Omar Abdul Rahman and Pakistani Aafia Siddiqui, jailed in the US on charges of terrorist links.

But US State Department spokeswoman Victoria Nuland said “the United States does not negotiate with terrorists.”

Philippine worker Jojo Balmaceda, employed by British oil giant BP which operates the In Amenas gas plant jointly with Norway’s Statoil and Sonatrach of Algeria, recounted overnight how he escaped.

Mr Balmaceda and three fellow Filipinos were taken at gunpoint as they arrived for work, tied up and thrown into a truck along with Japanese and Malaysian hostages, the GMA network reported in the Philippines.

He escaped when the truck was hit by an explosion but sustained a gunshot wound to his head which had affected his hearing, the station added.

An official in Manila said 34 Filipinos had been evacuated from the gas field and were on their way home.

The fate of two Malaysians believed to have been caught up in the crisis remains unknown, the foreign ministry said, while three others were safe.

France said two of its nationals had returned safely but it had no word on two more, and Romania said three of its citizens had been freed.

Earlier, Algeria informed France that a French citizen was killed in the hostage rescue operation at a remote gas plant seized by Islamist militants, French Foreign Minister Laurent Fabius confirmed today.

“One of our countrymen, Yann Desjeux, has unfortunately lost his life. Three other of our citizens, who were also at the site during the attack by the terrorists, were saved,” Mr Fabius said.

As criticism mounted over the haste of an Algerian military assault on the Sahara desert site, APS news agency said earlier that special forces had freed more than 670 hostages, among them 573 Algerians and about 100 foreigners.

“Around 100 foreigners out of 132 hostages seized by a terrorist group that attacked the Tiguentourine gas plant on Wednesday have been freed,” APS cited a security official as saying.

British Prime Minister David Cameron warned the In Amenas gas plant was a “large and complex site and they are still pursuing terrorists and possibly some of the hostages in other areas of the site.”

An AFP photographer saw trucks delivering empty coffins to the hospital at In Amenas, where the wounded had been taken.

Some of those who had escaped or spoke of their ordeals said explosives had been wrapped around their necks. Others hid, petrified, under beds, in gaps above ceilings or wherever they could.

Algeria Kidnapping

Alexandre Berceaux, who works for France’s CSI Catering, said he hid in his room before being freed by Algerian troops on Thursday evening.

“I was under the bed and I put boards everywhere just in case,” Mr Berceaux said.

“I had a bit of food, a bit to drink. I didn’t know how long it would last.”

Algerian special forces launched their rescue bid on Thursday, a day after kidnappers seized the plant to avenge what they said was Algiers’ support for French air strikes in neighbouring Mali.

The kidnappers said 34 captives were killed in the army assault, but an Algerian security source called that “fantasy,” saying 18 of more than 30 Islamist gunmen were killed.

“We left the complex by a back door the terrorists didn’t know about,” said one freed Algerian.

“We waved a white cloth so the army would know we were workers.”

Another Algerian, who works for US firm Halliburton, described the Islamist assault.

“There were around 300 or 400 of us, employees of BP and other firms. They gathered us all together, Algerians and foreigners, in the canteen which they rigged with explosives,” he said.

“The army moved in at about midday” on Thursday.

Britain’s Mr Cameron said he was “disappointed” not to have been told in advance about the rescue bid, and said “significantly” fewer than 30 Britons remained at risk at the field, operated jointly by BP, Norway’s Statoil and Sonatrach of Algeria.

BP said a “small number” of its staff remained unaccounted for, adding it had evacuated hundreds of workers from the complex and other fields. Japanese plant builder JGC said it had accounted for 17 of its employees, but not another 61. Statoil said the fate of eight Norwegian workers was unknown.

A Northern Ireland man, Stephen McFaul, escaped. His brother said he fled when the convoy he was in came under army fire.

ONE of the five men to stand trial in a fast-track court on charges of gang-raping and murdering a student on a bus in New Delhi, has allegedly been tortured in jail.

One of the defence team, A.P. Singh told reporters that his client Vinay Sharma, a gym instructor, had been badly beaten up in jail by fellow prisoners and was in agony when he appeared before the district court on Thursday.

“Vinay Sharma was badly tortured in jail by other inmates who pounced on him. He was not in a position to stand up in court because he was in great pain,” Mr Singh said.

“It is sad the jail authorities cannot provide security to them,” he added.

India Gang Rape

Ajay Prakash Singh, centre, a lawyer for two of the accused, speaks to journalists outside the Saket district court complex where the accused are to be tried.

A magistrate sitting at a district court in the Saket area of southern Delhi committed the five defendants to a more senior sessions court which is authorised to handle such case and which will begin its hearings next Monday.

“The magistrate has committed the case to the sessions court which is fast-track,” Sadashiv Gupta, the lawyer for fruit-seller Pawan Kumar, told reporters outside the court.

The court would hold its first hearing on the case on January 21, Mr Gupta added.

Kumar and four other adults are all accused of murder, rape, robbery and kidnapping in connection with the attack on the 23-year-old medical student on December 16.

The case against a sixth defendant, who says he is 17, is being heard separately by a juvenile court.

The victim, who cannot be named for legal reasons, died 13 days later in a Singapore hospital from intestinal injuries sustained during the assault in which she was also violated with a rusting iron bar.

A male companion, with whom she had spent the evening at the cinema, was also badly injured in the attack which ended when the pair were thrown off the bus.

The gang-rape triggered mass protests across India and shone the spotlight on the shocking levels of sexual violence against women.

Prosecutors say they have DNA evidence, including blood stains, linking the six defendants to the killing as well as a host of witnesses.

The defendants’ lawyers have said that their clients were beaten by police and forced into confessing.

The government, stunned by the mass protests over the case and criticism of India’s notoriously sluggish justice system, has promised that the case will be dealt with swiftly.

If convicted, the adult defendants could be sentenced to death and many of the protesters who rallied in the aftermath of the attack demanded that all rapists be hanged.

The prosecution had requested the five adult defendants to be handcuffed while in custody on the grounds that they were dangerous, but defence lawyer Mr Gupta said the court had rejected such a move.

“The handcuffing of the suspects has been rejected as per our application opposing handcuffing,” he said outside the court.

A wide ranging gagging order has been imposed on reporting of proceedings inside the courtroom.

It is not yet known whether those restrictions will remain in place throughout the trial.

This is the explicit sign that Wayne Dobson has had to place on his front door explaining in detail why he doesn't have the presumed stolen telephones For the past two years Wayne Dobson's life has become a misery as faulty GPS cellphone towers have directed all lost and missing phone users to his home

January 13, 2013            1:59 a.m.

Wayne Dobson doesn’t have your cellphone.

Even if it looks like he might.

In the past two years the 59-year-old retiree has been pestered by people showing up at all hours of the day and night at his house, demanding their phones. They’ve yelled, shown him evidence, called the police – sworn that their phone is in his house.

But he’s no thief.

“It’s very difficult to say, ‘I don’t have your phone,’ in any other way other than, ‘I don’t have your phone,’ ” Dobson said.

What has become a powerful tool for police hunting down bad guys and people who lose their phones or who call 911 has backfired on Dobson. An unexplained glitch with at least one cellphone company is directing people with missing phones to his North Las Vegas home.

And the glitch is also affecting police, who have twice been wrongly directed to his house on domestic violence calls. That has forced Dobson to post a sign on the front of his house telling people he doesn’t have their phone.

The situation is one that has puzzled experts.

“That’s crazy,” said John B. Minor, a communications expert who specializes in cellphone tracking. “This sort of thing I’ve not seen.”

The problem appears to be limited to some owners of Sprint phones. Company officials said they are researching the problem, which has forced Dobson to sleep near his front door on weekends so he can answer the door quickly at all hours.

“It’s a hell of a problem,” he said. “It would be nice to be able to get a good night’s sleep.”

‘I HAD A PROBLEM’

Dobson’s misadventure started in 2011, with a knock on the door around midnight on a weekend. He opened the door and found an upset young couple demanding that he turn over their phone.

Dobson was confused.

“I’m standing there and I’m thinking, ‘What are they talking about?’ ” he said. “They might as well have said, ‘Give me my horse back.’ ”

After debating back and forth, both sides called police. When officers arrived at his home, near Craig Road and Donna Street, Dobson expressed his confusion.

“I just said, ‘I don’t know these people; I don’t go where they go.’ I’m 59 years old. I don’t care about these technology pets they have.”

The couple left without their phone, and he never heard from them again. It wasn’t long before he realized he had a bigger problem on his hands.

He saw a woman wandering through his backyard. But before he could talk to her, she jumped over the wall. A few minutes later he heard a knock on the door.

“Please give me my phone,” she said.

When he explained that he didn’t have it, she became insistent.

“I’ve got pictures of my grandchildren,” she said. “I can’t replace them. I need them. All I want are my pictures.”

He told her to call the police and invited her to come inside and search. In the meantime, he called the woman’s cellphone provider, Sprint.

A technician there explained the problem, but didn’t provide a solution, he said.

Dobson was told that cellphone GPS systems don’t provide exact locations – they give a general location of where to start your search. And for some reason his house is that location for his area.

“I knew then I had a problem,” he said.

AN IMPERFECT SYSTEM

All cellphones today have a form of location-tracking, often using a combination of satellite GPS and “triangulating” a signal between nearby cell towers. For most smartphone users, that allows turn-by-turn driving directions, a list of nearby restaurants and real-time weather updates.

Those are all convenient services, but location-tracking has a more important purpose.

In 1997, cellphone users were roughly one in three callers to 911 dispatchers. And dispatchers didn’t know what to do in situations where the person couldn’t, or didn’t, provide their location. For land lines, dispatchers automatically knew where they were.

If you were in Chicago calling from a cellphone with a 702 area code, for example, Chicago dispatchers would forward the call to Las Vegas police.

That was unhelpful at the least and dangerous at the worst, said Ben Levitan, who spent 30 years designing cellphone networks and holds dozens of patents on the technology.

“There were some horrible situations which prompted the FCC to go, ‘Look, you’ve gotta fix this,’ ” Levitan said.

Cellphone companies came up with a way to locate the phones and instantly transmit their coordinates to dispatchers. Today, as 70 percent of phone calls to 911 are made by cellphones, dispatchers can see where they are calling from. The information must be accurate to within 50 to 300 meters, depending on the type of technology used.

The system has since spawned a host of other uses. Companies like Apple, Microsoft and various third parties all provide ways to track missing phones from a computer or tablet. When New York Times technology columnist David Pogue lost his iPhone last year, he used Apple’s software to track it to the backyard of a Maryland home. Police picked up the phone and returned it.

It’s also been useful for police. They have used it to solve crimes by showing a suspect’s phone was at the crime scene, although they have also been criticized for using the technology without a warrant.

Experts say the systems are not completely reliable. You don’t need to tell that to Dobson.

‘LUCKY ME’

It wasn’t until December that Dobson felt the situation had gone from a nuisance to a danger.

Four different groups of people had showed up at his house in the two years before. And North Las Vegas police showed up to his home once, in error, responding to a domestic dispute call.

But on Dec. 18, four young men banged on his door at 2:30 a.m., yelling for him to open up and give up a phone.

The phone’s owner had an application on a tablet computer that showed his phone was in Dobson’s house.

“He was … literally proving to me that I had his cellphone,” Dobson said.

About two weeks later he was awakened at 4 a.m. by a person prowling along the side of his house. Dobson followed a flashlight beam to his bathroom window. When he looked out, the person flashed the light in his face.

“I screamed at him, ‘Who are you? Get out of my yard!’ ” Dobson said. “And he said, ‘We’re the police, open the door.’ ”

North Las Vegas cops had received a 911 call from a woman on a cellphone who was arguing with a man. The argument was escalating, but dispatchers weren’t able to get a location from the woman.

They looked at the location of the phone and sent officers, who arrived minutes later at Dobson’s house. He was taken outside to his front yard and searched. When officers realized the mistake, they apologized.

Dobson said he is grateful that he didn’t confront the officers with a weapon.

“I would have been on the losing end, and it would have been because of that issue,” he said.

He now has a sign next to his front door telling people that he doesn’t have their phone and advising them to call police.

North Las Vegas police spokesman Chrissie Coon said the department rarely dispatches officers to locations based on cellphone GPS coordinates. It’s even rarer that those coordinates are wrong. And she had never heard of a situation like Dobson’s.

“We’re relying on the accuracy of the information that’s given to us by the carrier,” she said. “It’s just not a perfect technology.”

Coon confirmed that police have responded four times to Dobson’s house – twice for people who believed their phone was there. Each time the phone was a Sprint phone.

They now are going to flag any calls to Dobson’s home, but they will still send officers to the scene unless they can confirm that there isn’t actually a problem there.

Coon said Dobson’s example is a good reason why people should have land lines in their homes.

A Sprint spokeswoman said the company is researching the problem.

“We will research the issue thoroughly and try to get to the bottom of what is going on and if it has anything to do with our company,” spokeswoman Rachael Crocker wrote in an email.

Minor and Levitan, who both testify as expert witnesses in civil and criminal cases, said they don’t believe the problem is with the cell tower, which is close to Dobson’s home. They both said the problem is more likely to be at Sprint’s switchboard. A software problem is incorrectly translating coordinates to Dobson’s house.

And because there is clearly a problem with the 911 system, the issue is serious, they said.

“This isn’t the kind of error you would just shrug off,” Minor said. “They should be very diligent in preventing these types of problems.”

Dobson just wants the problem fixed. He is worried about potentially dangerous future encounters with angry cellphone owners.

“It’s like Pavlov’s response now; I dread the thought when I hear a car drive by that they’re going to be pulling in and knocking on my door,” he said.

Levitan said he has seen a lot of strange things in the cellular world, but, “I’ve never seen this specific problem come up.”

That’s little comfort to Dobson. “Lucky me, huh. I couldn’t be the multimillion-dollar winner. No. I’d rather have that problem.”

When is a floating home not a vessel? In a ruling on Tuesday, the U.S. Supreme Court told a Florida city its argument did not hold water and an abode on water was nothing but a home.

The court ruled that a floating home which its owner said was permanently moored to a marina in Riviera Beach, Florida, was not a vessel, depriving the city of power under U.S. maritime law to seize and ultimately destroy it.

The definition of “vessel” is particularly important, given that admiralty law imposes different obligations on owners with respect to such things as staffing and taxation.

Writing for a 7-2 majority, Justice Stephen Breyer said there was nothing about the home of Fane Lozman, a trader and former Marine pilot, that could lead a reasonable person to conclude that it was a vessel, but for the fact that it floated.

The case is Lozman v. City of Riviera Beach, Florida, U.S. Supreme Court, No. 11-626.

'My size was the only thing that saved me.' Ulanda Williams, who weighs 400 pounds, fell through a New York sidewalk on Friday night

16:18 EST           13 January 2013

A 400-pound woman who fell through a New York sidewalk claims that her size actually came to her rescue and that a slimmer woman may not have survived the accident.

Ulanda Williams, 32, of Queens, was attempting to shelter from the rain outside a restaurant on Manhattan’s Upper East Side on Friday night when the ground collapsed beneath her.

The six-foot-five woman fell about seven feet into a hollow basement, breaking her arm in two places and had to be rescued by the fire department with a crane.

But after being released from hospital a bruised Williams told the New York Post: ‘Thank God, they said that my size was the only thing that saved me.’

The social worker, from Springfield Gardens, had cuts on her face and neck and was wearing an arm brace as she left NewYork-Presbyterian hospital.

Williams said there were no warning signs indicating any possible danger before her fall: ‘It happened so instantly that I didn’t even recognize anything.

‘Cement was all over me, debris. They had a bed frame down there, broken pipes and wood pieces. It was a hollow place,’ she told the Post.

‘I was standing there approximately ten seconds and when that occurred, I just fell right through,’ Williams said.

City Department of Buildings inspectors found that a four-by-six-foot section of sidewalk had collapsed into the basement.

Williams ended up in the deep cellar of the Atomic Wings restaurant on the corner of East 60th Street and 2nd Avenue

Emergency Medical Services and the Fire Department were called to the scene and the woman was eventually pulled out of the hole.

FDNY Fire Chief Thomas Jemmott said that the woman had to be pulled up in a ‘high-angle rescue unit,’ which resembles a crane with cargo netting.

‘She is a very large person, but we were able to secure her and stabilize her and lift her out of the hole,’ Jemmott told the Post.

An unlikely player gave the Broncos the lead early in the third quarter of Saturday’s AFC Divisional game against Baltimore: Return specialist Trindon Holliday, who was released earlier this season by the Texans because he struggled with turnovers, has two touchdowns — a 90-yard punt return and a 104-yard kick return.

But it’s even more impressive than that:

Laura Evelyn’s tweet about the landlord’s amazing demands.

NO loud music, or parties, or drugs and no stealing.

These are pretty reasonable requests for a landlord in a share flat to make when interviewing prospective tenants.

But no pork?

And no visitors?

And any personal items left in communal areas will be thrown away?

My, that’s just plain inhospitable.

Got a landlord horror story? Please share it with us below. Remember: No names

Tenants expect  rules, but Laura Evelyn  didn’t expect to be handed a list of increasingly bizarre house rules, before even signing a contract.

The 31 instructions include limiting showering to 15 minutes, having visitors approved two weeks in advance and never using somebody else’s shampoo.

Any personal belongings left in communal areas of the flat in Wood Green, north London, would be “thrown out as junk'” the list says, and no food is to be eaten in bedrooms.

Laura was so amazed by the list, she did the only sensible thing: she posted the entire thing on the internet.

Her tweet has since gone viral.

You can see the demands below.

TWO Australian friends travelling in Laos have been found dead within days of each other after reportedly overdosing from the same batch of drugs.

Kane Scriven, 40, died in Laos after a night of partying and heavy drinking on New Year’s Day with his mate Nick Parkin, who is from Perth.

The NT News understands that Mr Parkin, 39, was found dead in his Sinnakhone Hotel room in the capital Vientiane on January 4, after Mr Scriven was found dead on January 1.

It is not clear whether the deaths of Kane Scriven and Nick Parkin are connected but the men, who were holidaying together in Laos, were found dead within days of each other.

The ABC is reporting that both of the Darwin-based men died from overdoses, likely from the same batch of drugs.

The Department of Foreign Affairs and Trade confirmed the deaths late last night but would not confirm if Mr Parkin was found in a hotel room or whether the deaths were connected.

Mr Parkin’s family in Perth have been notified.

Both men worked as crewmen for Workboats Northern Australia in Darwin and were holidaying in Laos.

Mr Parker’s brother Timothy posted a prayer mentioning the death on his Facebook page.

Jaimie Hildebrand, a friend of Mr Parkin, said she was hoping to hear this was a prank.

“Love you with all my heart,” she said.

Another friend, Luke Martin, said Mr Parkin was a great man and friend.

“Having known you has been an absolute pleasure and I’m sad to hear your (sic) gone, but so thankful for the fantastic memories,” he said.

The men’s employer also posted this tribute on its Facebook page for the pair: “Everyone at Workboats Northern Australia is shocked by the sudden deaths of Kane Scriven and Nicholas Parkin.”

“We are supporting their close friends who still work with us and are respecting their requests to grieve in peace.

“Our thoughts and condolences go to the families of Kane and Nick. RIP.”

On Tuesday, the NT News reported that friends had not heard from Mr Parkin since January 2 when he informed them of his friend’s death.

A mother has been found shot dead in the trunk of her car four days after her baby was abandoned in an apartment building.

The body of Ebony Jackson, 30, was discovered on Tuesday morning in her 2004 Mitsubishi Galant.

Police tracked the car to a quiet street in Breckenridge Hills, Missouri using the GPS system. The vehicle had been parked in front of a condemned building and was later towed to be scoured for evidence of her killer.

An autopsy today revealed that Miss Jackson had suffered a single, fatal gunshot wound behind her ear.

Police were sifting through her phone records for clues as to what happened to the young mother.

Her three-month-old baby boy Donavon Prom had been found in his car seat on January 4 in the hallway of an apartment building in St Louis, around 16 miles from where his mother’s body was later found.

The baby was discovered with his bottle and in good health. He is currently in the care of the state.

MailOnline was awaiting a response from the St Louis Police Department.

It had originally been suspected that Miss Jackson had abandoned her baby.

Relatives told the St Louis Dispatch that she had traveled to Missouri from her native Oklahoma on January 2 to visit relatives after leaving boyfriend Craig Prom a note saying she needed space.

Mr Prom came from Oklahoma to retrieve the child where he was ordered to undergo a paternity test. The results are pending.

Three Kurdish women activists – including a co-founder of the militant nationalist PKK – have been found dead with gunshot wounds in a Kurdish information centre in Paris.

The bodies of Sakine Cansiz and two others were found on Thursday.

French Interior Minister Manuel Valls said the killings were “intolerable”.

The motive for the shootings is unclear. Some 40,000 people have died in the 25-year conflict between the Turkish state and the PKK.

However, Turkey has recently begun talks with the jailed PKK leader Abdullah Ocalan, with the aim of persuading the group to disarm.

Locked doors

Who were the victims?

Sakine Cansiz: Founding member of the PKK, and first senior female member of the organisation; while jailed, led Kurdish protest movement out of Diyarbakir prison in Turkey in 1980s; after being released, worked with PKK leader Abdullah Ocalan in Syria; was a commander of the women’s guerrilla movement in Kurdish areas of northern Iraq; later took a lower profile and became responsible for the PKK women’s movement in Europe

  • Fidan Dogan: Paris representative of the Brussels-based Kurdistan National Congress (KNC) political group; responsible for lobbying the EU and diplomats on behalf the PKK via the KNC
  • Leyla Soylemez: Junior activist working on diplomatic relations and as a women’s representative on behalf of the PKK

The three women were last seen inside the information centre of the Kurdish institute on Wednesday afternoon. A member of the Kurdish community tried to visit the centre but found the doors were locked.

Their bodies – all three bearing gunshot wounds – were found in the early hours on Thursday.

Along with Ms Cansiz, a second woman has been named as Fidan Dogan, 32, who worked in the information centre. She was also the Paris representative of the Brussels-based Kurdistan National Congress.

The third, named as Leyla Soylemez, was a young activist.

Members of the Kurdish community demonstrated outside the information centre as Mr Valls arrived.

The three women were “undoubtedly [summarily] executed”, Mr Valls said, adding that the French authorities were determined to “shed light on this act”.

“In this neighbourhood, in this Kurdish information centre, in the 10th arrondissement [district] where many Kurds live, I also came to express my sympathy to the relatives and close friends of these three women,” he said.

A representative of the Federation of Kurdish Assocations in France (Feyka), Leon Edart, told the French BFM news channel that there were no CCTV cameras in the office.

The PKK took up arms in 1984, and demands greater autonomy for Turkey’s Kurds, who are thought to comprise up to 20% of the population.

It is regarded by Turkey, the US and European Union as a terrorist organisation, because of its attacks on Turkish security forces and civilians.

In 2012 it stepped up its attacks, leading to the fiercest fighting in decades, but violence has subsided during the winter.

A Texan student who refused to wear a badge with a radio tag that tracked her movements has lost a federal court appeal against her school’s ID policy.

The radio chips track attendance, which in turn helps secure school funding.

But Andrea Hernandez, 15, stopped wearing the badge on religious grounds, saying it was the “mark of the beast”.

After John Jay High School suspended her, she went to court and won a temporary injunction to continue her studies at the school, without the tag.

The federal court ruling overturned that, saying if she was to stay at the school, she would be required to wear the badge. Otherwise, she would have to transfer to a new school.

The new identification policy at the Northside Independent School District (NISD) in San Antonio, Texas, began at the start of the 2012 school year.

John Jay High School is one of two schools piloting the programme, which eventually aims to equip all student badges across the district’s 112 schools with radio-frequency identification (RFID) chips.

The badges reveal each student’s location on their campus, giving the district more precise information on attendance.

The daily average of the attendance is related to how much funding each school receives.

But Miss Hernandez said the badge was the “mark of the beast”, as described in chapter 13 of the Book of Revelation in the Bible.

rex tom findlay sculptor lightning strike thg 130107 wblog Stone Breasts Miraculously Survive Lightning Strike

In what seems like a precision strike, a lightning bolt crashed down from the skies over Australia into a voluptuous Venus de Milo statue, with the breasts the only part of the torso surviving intact.

On Jan. 4 Tom Finlay, the stonemasonry head at Finlay’s Stonemasonry in Yarrawonga, Australia, was standing in the courtyard when the white flash came from the sky, striking the nearly 5-foot-tall statue he had hand-carved.

“There was a clap of thunder and the sculpture blew up like a rocket-launcher had hit it,” he told the NT News. “The lightning looked like a serpent. Everything disintegrated but the breasts –all that’s left is what’s under her hips.”

The statue’s 66-pound stone breasts fell over 26 feet from the steel column it was perched atop, but miraculously did not shatter. The NT News reported that only one nipple was damaged.

Finlay said that he isn’t sure what to do with the surviving bosom.

“It’s still a bit raw,” he said. “I’ll leave the statue the way it is to show the force of nature … I might mount [the breasts] and hang them in my office.”

Millie Flamm was too sick to attend Justin Bieber’s concert in Salt Lake City, but she got the next best thing: a visit from the pop star in her hospital room.

Bieber showed up in the 7-year-old leukemia patient’s room at Primary Children’s Medical Center before his concert Saturday night.

Her mother, Amanda Flamm, told the Deseret News (http://bit.ly/SdSGQO ) that Millie’s “whole face just lit up” when Bieber walked into the room and gave her a big hug.

Bieber sang a song while holding her hand and gave her his guitar pick. Bieber also gave her a kiss on the cheek before leaving.

Family friends launched a social media campaign promoting the visit when Millie was forced to sell her concert tickets after suffering a relapse two weeks ago.

Sensational claims about Justin Bieber smoking marijuana on the day a paparazzo was killed attempting to photograph the star have resurfaced after pictures of the singer emerged smoking at a party.

The 18-year-old heartthrob is seen holding what TMZ suggests is a roll-up as he chats with friends inside a hotel room in Newport Beach, California.

According to the website, the pictures were taken on January 2 – the day after 29-year-old Chris Guerra was hit by an oncoming vehicle in Los Angeles after taking pictures of singer’s white Ferrari.

Cause for controversy: Justin Bieber was photographed holding a cigarette during a party in Newport Beach, California on January 2
Cause for controversy: Justin Bieber was photographed holding a cigarette during a party in Newport Beach, California on January 2

According to TMZ, Guerra claimed just hours before he died that he saw the pop star smoking cannabis through a pipe in the vehicle. Bieber was not behind the wheel at the time he was killed.

The singer’s friend, 19-year-old rapper Lil Twist, was reportedly driving Bieber’s $200,000 Ferrari and was stopped by police when Guerra rushed to the scene and was told by authorities to step back.

Sources at the Newport Beach party told the website Twist was also there.

Bieber seems little worried about the previous night’s tragic events, and was laughing heartily as he held the cigarette while his peers drank beer.

A fit of the giggles: Justin seemed to find something extremely funny as he laughed with friends
A fit of the giggles: Justin seemed to find something extremely funny as he laughed with friends

The insiders claim Lil Twist and his brother were rolling all cigarettes and passing them around, resulting in ‘a lot of pot smoke’.

It is also alleged no one seemed to mind the photographs being taken, despite security being present.

Bieber apparently complained about how tired he was because he’d been staying up late recently, and went on to ask about how he could find some late night fast food.

Controversy is surrounding the star as of late, with fresh claims Bieber has again split from longtime girlfriend Selena Gomez. Reports suggest a mystery girl slept in the hotel room the evening the photographs were taken, though it is unclear if anything untoward happened.

Freelance photographer Guerra was tailing Bieber’s white 458 Italia Ferrari when it was pulled over by California Highway Patrol officers in Los Angeles.

He got out of his car to take pictures but was struck by a Toyota Highlander SUV as he was running back to his own vehicle after being told to return to his vehicle repeatedly by police.

According to TMZ, the Bieber source at the time said there are multiple witnesses to say the only time Justin left the Four Seasons hotel on New Year’s Day was to go to Roscoe’s Chicken and Waffles in Hollywood for lunch.

Guerra is also said to have told a friend he saw a car belonging to Selena Gomez at the Four Seasons.

But the Bieber source claims this was another lie and that Gomez and Bieber had argued on December 30 after flying out to Mexico for New Year’s Eve and had subsequently split up.

Lindsay Ess slideshow

January 4, 2013

It’s the simplest thing, the grasp of one hand in another. But Lindsay Ess will never see it that way, because her hands once belonged to someone else.

Growing up in Texas and Virginia, Lindsay, 29, was always one of the pretty girls. She went to college, did some modeling and started building a career in fashion, with an eye on producing fashion shows.

Then she lost her hands and feet.

When she was 24 years old, Lindsay had just graduated from Virginia Commonwealth University’s well-regarded fashion program when she developed a blockage in her small intestine from Crohn’s Disease. After having surgery to correct the problem, an infection took over and shut down her entire body. To save her life, doctors put her in a medically-induced coma. When she came out of the coma a month later, still in a haze, Lindsay said she knew something was wrong with her hands and feet.

“I would look down and I would see black, almost like a body that had decomposed,” she said.

The infection had turned her extremities into dead tissue. Still sedated, Lindsay said she didn’t realize what that meant at first.

“There was a period of time where they didn’t tell me that they had to amputate, but somebody from the staff said, ‘Oh honey, you know what they are going to do to your hands, right?’ That’s when I knew,” she said.

After having her hands and feet amputated, Lindsay adapted. She learned how to drink from a cup, brush her teeth and even text on her cellphone with her arms, which were amputated just below the elbow.

“The most common questions I get are, ‘How do you type,'” she said. “It’s just like chicken-pecking.”

Despite her progress, Lindsay said she faced challenges being independent. Her mother, Judith Aronson, basically moved back into her daughter’s life to provide basic care, including bathing, dressing and feeding. Having also lost her feet, Lindsay needed her mother to help put on her prosthetic legs.

“I’ve accepted the fact that my feet are gone, that’s acceptable to me,” Lindsay said. “My hands [are] not. It’s still not. In my dreams I always have my hands.”

Through her amputation recovery, Lindsay discovered a lot of things about herself, including that she felt better emotionally by not focusing on the life that was gone and how much she hated needing so much help but that she also truly depends on it.

“I’m such an independent person,” she said. “But I’m also grateful that I have a mother like that, because what could I do?”

Lindsay said she found that her prosthetic arms were a struggle.

“These prosthetics are s—,” she said. “I can’t do anything with them. I can’t do anything behind my head. They are heavy. They are made for men. They are claws, they are not feminine whatsoever.”

For the next couple of years, Lindsay exercised diligently as part of the commitment she made to qualify for a hand transplant, which required her to be in shape. But the tough young woman now said she saw her body in a different way now.

Ages 0 to 27 are ruled by the sum of the first three letters of the name.

Lindsay Ess

12 (L is the 12th letter of the alphabet) + 9 (i is the 9th letter of the alphabet) + 14 (n is the 14th letter of the alphabet) = 35

So the number 35 ruled her first twenty-seven years of life (which is when she lost her limbs due to infection).

35 = Infection.  Immune system.  Perseverance.  Not giving up.

A class-action lawsuit has been filed against a former Utah Highway Patrol trooper and her superiors alleging that she filed false DUI charges during her career.

The department fired Lisa Steed in November for alleged misconduct related to her duties.

Attorney Michael Studebaker, who is one of the lawyers leading the class-action lawsuit, says he has been contacted by at least 40 people claiming Steed wrongfully arrested them on DUI or drug charges.

“Culture of corruption. The stories are just rampant,” said Studebaker, who filed the lawsuit Dec. 14 in District Court in Salt Lake County.

Lawyers have yet to determine exactly how much the plaintiffs will seek in monetary damages.

One of the alleged victims was Michael Choate, who says Steed pulled him over for speeding with his wife in the car.

“She said she clocked me at 73. I was going about 50, 52 at most,” Choate said.

Choate was arrested and charged with DUI, but the charge was reduced to having an open container of alcohol in the car after a blood test showed he was not drunk. Choate says he was forced to pay $3,000 in fines to get his car back.

Choate was also upset that his wife was forced to find her own way home after his arrest.

“They dropped her off at a Burger King,” he said. “She didn’t have any money, she didn’t have her cellphone with her. She had to borrow a quarter from a lady to make a phone call.”

Drunk Driving Numbers Surprisingly High Watch Video

Steed and her attorney have not responded to requests for comment. Utah Highway Patrol says it cannot comment on pending litigation.

She is under investigation by the FBI.

Studebaker also cites a dashcam video from a 2011 traffic stop that he says shows Steed’s pulling over a woman driver. The video shows the driver performing a series of sobriety tests. Studebaker says the unidentified woman passed all the tests with flying colors but was still arrested for DUI.

Charges were later dropped after a blood test found no alcohol in her system, Studebaker says. The driver has since joined the lawsuit against Steed.

Steed was named Utah Highway Patrol’s “Trooper of the Year” in 2007 for making more than 200 DUI arrests, a reward that Studebaker says should be taken away from her.

Steed herself has admitted in the past that she did not follow proper protocol while administering a DUI check. At a court hearing in May 2012, Steed admitted that, while she was administering a blood-alcohol test on Theron Alexander March 2010, she removed her microphone in order to perform an unauthorized action.

An attorney representing Alexander told ABC News last year that Steed’s actions could call all her cases into question.

“The cumulative facts may well have a significant ripple effect across every case she’s touched,” Salt Lake City attorney Joseph Jardine said in March. “This could become the basis for overturning multiple convictions in the past.”

Steed’s attorney, Greg Skordas, has said he does not believe that the incident is any reflection of his client’s credibility.

“It doesn’t affect her credibility. It affects the way she does things, her ability to follow instructions,” Skordas told ABCNews.com in March. “It doesn’t mean she’s dishonest.”

In 2009, dashcam video showed Steed stun-gunning Ryan Jones, a motorist who was later determined to be sober.

The case was settled in November 2011 when the state paid Jones $40,000 without admitting wrongdoing.

When asked about that case, Skordas said, “She took her lumps, she was reprimanded and we move on.”

A Stockton man prosecutors say lived with his girlfriend’s rotting corpse for several months has been convicted of murder.

Sacramento television station CBS-13 (http://cbsloc.al/ZVWcm8 ) reports that San Joaquin County jurors on Wednesday found Devon Epps guilty of murder, as well as murder by torture, rape and other charges.

Epps was arrested after an apartment manager found the badly decomposed body of 35-year-old Veronica Jones in a bathtub of the apartment when he went to evict Epps in December 2011.

At the time, Jones had been missing for six months.

The 37-year-old Epps is due back in court on Thursday for the sanity phase of the trial. Prosecutors say a judge ordered a mental evaluation for Epps the first time he appeared in court because of his behavior.

January 2, 2012

A newspaper based in White Plains that drew nationwide anger after publishing the names and addresses of handgun permit holders last month is being guarded by armed security personnel at two of its offices, the publisher said Wednesday.

The increased security comes as the newspaper, The Journal News, has promised to forge ahead with plans to expand its interactive map of permit holders to include a third county in the suburbs of New York City, and local officials there have vowed to block the records’ release.

The armed guards — hired from local private security companies — have been stationed in The Journal News’s headquarters and in a satellite office in West Nyack, N.Y., since last week, said Janet Hasson, the president and publisher of The Journal News Media Group.

“The safety of my staff is my top priority,” Ms. Hasson said in a telephone interview.

The newspaper prompted a national discussion and a torrent of rage online after it published an interactive map of handgun permit holders in Westchester and Rockland Counties on its Web site last month. The Journal News had gathered the information from public records after the school shooting in nearby Newtown, Conn.

Ms. Hasson declined to elaborate on any specific threats to the newspaper’s staff, beyond saying that the permit map had precipitated the security precautions. She did not describe the number of guards or the guns they were carrying.

But an editor at the West Nyack office told the local police that the newspaper had received “a large amount of negative correspondence” related to the publication of the map, according to a police report highlighted by The Rockland County Times on Tuesday. The police report said that e-mails received did not contain threats and that armed guards from a private security firm had not reported any problems at the office.

Despite the anger at the newspaper’s employees — some have had their addresses mapped by bloggers in retaliation — Ms. Hasson said the newspaper would continue to seek permit information for Putnam County.

But officials there, including the county clerk and a state senator, have said they intend to block the release of permit information.

The senator, Greg Ball, a Republican who represents the area, lashed out at the “asinine editors” at The Journal News who, he said, “have gone out of their way to place a virtual scarlet letter on law-abiding firearm owners throughout the region.”

“I thank God that Putnam County has a clerk with the guts to stand up and draw the line here,” Senator Ball said. “This is clearly a violation of privacy and needs to be corrected immediately.”

The county clerk, Dennis J. Sant, said he and other officials were meeting on Wednesday to discuss legal options for stopping the release of the permit information and would hold a news conference on Thursday.

“When these laws were conceived, there was no social media, there was no Google maps,” he said.

Mr. Sant said permit holders were “upstanding citizens” like retired police officers and doctors. “I can’t put these people in harm’s way like this,” he said.

Ms. Hasson said that despite the hectic atmosphere and increased security at The Journal News offices, the newspaper would go to court if necessary to obtain the public records. “Right now they’re denying it,” she said of Putnam officials. “We’re conferring to see what the next steps are.”

It was unclear whether the county officials had the authority to block the release. The permits are public records that were requested by the newspaper using the state’s Freedom of Information Law.

Robert Freeman of the State Committee on Open Government said the officials would be breaking the law if they refused to release the records.

The name and address of any handgun permit holder “shall be a public record,” he said, reading a section of New York State law. “In my opinion,” he added, “there is not a lot of room for interpretation.”

A 31-year-old woman was being held by the police on Saturday, authorities said, in connection with the death of a man who was pushed onto the tracks of a Queens subway station and crushed by an oncoming train.

The woman, Erica Menendez of the Bronx, will be charged with second-degree murder as a hate crime, according to a person in the Queens district attorney’s office. When Ms. Menendez was taken into custody by police early Saturday morning, she made comments implicating herself in the crime when questioned by detectives, according to Paul J. Browne, the chief spokesman for the Police Department.

A law enforcement official said that Ms. Menendez had “told the cops it was an act against Muslims,” and cited the Sept. 11 attacks. The victim, Sunando Sen, was born in India and, according to a roommate, was raised Hindu.

Law enforcement officials would not comment on Ms. Menesdez’s mental health.

The attack occurred around 8 p.m. on Thursday at the 40th Street-Lowery Street station in Sunnyside.

Mr. Sen was peering out over the tracks when a woman approached him from behind and shoved him onto the tracks, the police said. Mr. Sen never saw her, the police said, and had no time to react.

The woman fled the station, running down two flights of stairs and down the street.

By the next morning, a grainy black-and-white video of the woman who the police said was behind the attack was being broadcast on news programs.

It was not a lot to go on. The video was blurry and only a few seconds long.

Patrol officers picked up Ms. Menendez early Saturday after someone who had seen the video on television spotted her on a Brooklyn street and called 911, Mr. Browne said. She was taken to Queens and later placed in lineups, according to detectives.

Detectives had canvassed the area around the crime scene as well as homeless shelters and hospitals with psychiatric treatment facilities. On Saturday, however, Mr. Browne said the woman was not homeless.

Police Commissioner Raymond W. Kelly said Friday that according to witnesses’ accounts, there had been no contact on the subway platform between the attacker and the victim immediately before the fatal shove.

The case was the second this month involving someone being pushed to death in a train station. In the first case, Ki-Suck Han, 58, of Elmhurst, Queens, died under the Q train at the 49th Street and Seventh Avenue station on Dec. 3. Naeem Davis, 30, has been charged with second-degree murder in that case. A lawyer for Mr. Davis said his client had been trying to push Mr. Han away after an altercation.

The police said Mr. Sen was a 46-year-old immigrant who lived in Queens and had been raised in India. After years of toil, he had finally saved enough money to open a small copying business this year on the Upper West Side.

Ar Suman, one of four roommates who shared a small first-floor apartment with Mr. Sen in Elmhurst, said he was driving a client upstate when another roommate called and told him what had happened. Mr. Suman raced back to the city, only to find there was nothing he could do.

“He was a very educated person and quite nice,” Mr. Suman said. “It is unbelievable. He never had a problem with anyone.”

Mr. Sen’s roommates could not understand what might have led to the fatal encounter on Thursday. “This guy is so quiet, so gentle, so nice,” said M. D. Khan, a taxi driver who also lives in the apartment.

Three New Jersey police officers were shot and wounded on Friday at their police station, and one was in surgery for his wounds, a hospital official said.

Local TV news reported that the suspected gunman Eddie Jones III was killed in the exchange of gunfire at the police station in Gloucester Township, New Jersey, about 16 miles from Philadelphia. The TV report said the suspect had been brought in for a domestic incident.

“A violent struggle occurred while the suspect was being processed,” Gloucester Deputy Police Chief David Harkins said, according to Philadelphia TV station NBC10. The man was able to grab a gun and then opened fire.

The gunman was killed by police during the confrontation, Gloucester Police Chief W. Harry Earle said, according to the NBC10 report.

Gloucester Township Police declined to comment on the incident or to confirm the NBC10 report. An officer answering the phone said a press statement would be issued later, and a press conference was scheduled for Friday afternoon.

The three wounded police officers, two men and a woman, were brought to Cooper University Hospital shortly after 6 a.m. EST, hospital spokeswoman Lori Shaffer said.

Two of the officers suffered minor wounds, but one of the three, a male, required surgery, Shaffer said. She had no more information on the extent of the officer’s wounds.

Part of the Gloucester Township municipal complex, which houses the police department, was cordoned off by yellow police tape on Friday. Residents described it as a quiet community.

“It’s really a safe neighborhood,” said Kim Kavanaugh, 47, who lives across the street from the complex with her husband and two grown children.

Her husband Don Kavanaugh, 49, said he arrived home from his overnight work shift about 5 a.m. “About 6 o’clock I saw a bunch of flashing lights. I didn’t think nothing of it, I see flashing lights in and out of there all the time,” he said.

The incident follows several recent multiple shootings in the United States, and comes two weeks after a gunman killed 26 people, including 20 children, at Sandy Hook Elementary School in Newtown, Connecticut.

One week ago in western Pennsylvania, a man with a pistol fatally shot three people and then opened fire on police. Three officers were injured in that incident, one in a collision from a car chase with the gunman, another from bullet fragments to the face and a third who was struck with gunfire to the chest but survived because he was wearing a bulletproof vest.

A 24-year-old woman was arrested Friday and charged in connection with the Christmas Eve ambush slaying of two volunteer firefighters responding to a house fire in upstate New York.

Dawn Nguyen of Rochester faces a state charge of filing a falsified business record, State Police Senior Investigator James Sewell said. Nguyen also faces a federal charge; a news conference with the U.S. attorney in western New York was scheduled for 4 p.m. Friday.

Sewell said the state charge is connected to the purchase of an AR-15 semiautomatic rifle and a 12-gauge shotgun that William Spengler had with him Monday when firefighters Michael Chiapperini and Tomasz Kaczowka were gunned down. Three other people were wounded before the 62-year-old Spengler killed himself. He also had a .38-caliber revolver, but Nguyen is not connected to that gun, Sewell said.

The .223-caliber Bushmaster rifle, which had a combat-style flash suppressor, is similar to the one used by the gunman who massacred 20 children and six women in a Newtown, Conn., elementary school earlier this month.

Nguyen and her mother, Dawn Welsher, lived next door to Spengler in 2008. On Wednesday and again on Friday, shortly before her arrest, she answered her cellphone and told The Associated Press that she didn’t want to talk about Spengler. Her brother, Steven Nguyen, told the Democrat and Chronicle newspaper of Rochester that Spengler stole the guns from Dawn Nguyen.

A number listed in the name of her lawyer, David Palmiere, was disconnected.

Spengler set a car on fire and touched off an inferno in his Webster home on a strip of land along the Lake Ontario shore, took up a sniper’s position and opened fire on the first firefighters to arrive at about 5:30 a.m. on Christmas Eve, authorities said. He wounded two other firefighters and an off-duty police officer who was on his way to work.

A Webster police officer who had accompanied the firefighters shot back at Spengler with a rifle in a brief exchange of gunfire before the gunman killed himself.

Spengler spent 17 years in prison for killing his grandmother in 1980 and was barred from possessing weapons as a convicted felon.

Investigators still haven’t released the identity of remains found in William Spengler’s burned house. They have said they believe the remains are those of his 67-year-old sister, Cheryl Spengler, who also lived in the house near Rochester and has been unaccounted for since the killings. The Spengler siblings had lived in the home with their mother, Arline Spengler, who died in October. In all, seven houses were destroyed by the flames.

Investigators found a rambling, typed letter laying out Spengler’s intention to destroy his neighborhood and “do what I like doing best, killing people.”

He had been released from parole in 2006 on the manslaughter conviction, and authorities said they had had no encounters with him since.

A New York City woman has been arrested by federal authorities who say she tried to scam donors by posing as a relative of one of the children killed at a Connecticut elementary school.

Thirty-seven-year-old Nouel Alba was arrested Thursday and charged with lying to FBI agents.

Federal prosecutors say she used her Facebook account, telephone calls and text messages to seek donations for what she called a “funeral fund.”

Authorities say Alba denied seeking the donations when she was contacted by FBI agents investigating charity scams related to the shooting at Sandy Hook Elementary School in Newtown. A gunman killed 20 children and six adults there on Dec. 14.

Alba, of the Bronx, appeared Thursday in federal court in Hartford and was released on $50,000 bond. A number listed for her was not in service.

PHOTO: Firefighters were called to a house fire in Webster, N.Y. on Dec. 24, 2012, only to find a gunman.

December 24, 2012

A man who served nearly 17 years in jail for killing his grandmother set a house and car on fire this morning in upstate New York and then began shooting at emergency personnel who showed up, killing two firefighters, police said.

In all, William Spengler, 62, shot four firefighters, killing two and severely injuring two more after setting his “trap,” police said.

An off-duty police officer from Greece, N.Y., who responded to the scene early in the morning of Christmas Eve also was injured today.

“It was a trap,” said Webster, N.Y., Police Chief Gerald L. Pickering, “set by Mr. Spengler who laid in wait and shot first responders.”

Spengler, who was released from prison in 1998, was found dead at the scene following a shootout with police. He was believed to have killed himself with a bullet to the head.

As a convicted felon, Spengler would not have been allowed to own guns legally. Police were working to determine the types of weapons he used and how he obtained them, Pickering said.

Spengler was convicted of manslaughter in 1981 for “beating his 92-year-old grandmother with a hammer,” according to state prison documents.

Several weapons were used, Pickering said, and, “probably a rifle was used to inflict wounds of the first responders.

“I know many people are going to be asking if they were assault rifles,” Pickering said

There has been a week-long national debate about such weapons after one was used in a tragic school shooting in Newtown, Conn. on Dec. 14.

Four firefighters, two on a ladder truck and two more in their own vehicles, responded to 911 calls around 5:30 a.m. Monday morning. Spengler is believed to have hidden behind an elevated berm, shooting down on the firefighters and later police.

“Upon arrival, all [the firefighters] drew fire. All four were shot on the scene,” Pickering said. “One was able to flee the scene. The other three were pinned down.”

Police believe Spengler’s sister may have been inside the home, and that he set it on fire.

The blaze spread, engulfing three nearby homes and damaging three more on a sleepy street next to Lake Ontario that police described as a quiet vacation community. The fire was not put under control until late this afternoon.

SWAT team officers used an armored personnel carrier to evacuate 33 residents from homes in the area.

Among the dead firefighters was Lt. Michael Chiapperini, a 20-year veteran of the Webster Police Department and “lifetime firefighter,” according to Pickering. Chiapperini was a spokesman for the police department, ABC News affiliate WHAM reported.

Police identified the other firefighter killed as Tomasz Kaczowka, who also worked as a 911 dispatcher.

The chief, choking up, called the incident that shattered the quiet before 6 a.m. on Christmas Eve morning “terrible.”

“People get up in the middle of the night to fight fires,” he said. “They don’t expect to get shot and killed.”

Two surviving firefighters were in the intensive care unit at Strong Memorial Hospital in Rochester, N.Y. Both men were awake and breathing on their own after surgery and were in what doctors are calling “guarded condition.”

Joseph Hofsetter was shot once. He sustained an injury to his pelvis and has “a long road to recovery,” said Dr. Nicole A. Stassen, a trauma physician.

The second firefighter, Theodore Scardino, was shot twice and received injuries to his left shoulder and left lung, as well as a knee.

New York Gov. Andrew Cuomo released a statement calling the attack a “senseless act of violence” and the first responders “true heroes.”
