Moore-sentencing-lwb92xpd

December 16, 2011       1:31 pm

After evading capture for more than two years in what prosecutors called “a brazen disrespect for the law,” Colton Harris-Moore pleaded guilty Friday to more than 33 counts of burglary, theft and other charges in a two-year crime wave that earned him an international cult following as the “Barefoot Bandit.”

Rejecting defense claims that Harris-Moore was a psychologically crippled young man victimized by a tumultuous childhood, prosecutors in Washington state painted a picture of an ingenious criminal mastermind who taught himself to fly stolen planes and artfully set up his burglary victims to become repeat targets of future crimes.

“Not only did he keep homeowners under surveillance to determine how and when to break in, but we believe he kept the police under surveillance as well, which helped him evade capture for so long,” Island County prosecutor Greg Banks said at Friday’s hearing in Coupeville, Wash.

Banks said Harris-Moore, now 20, stole computers, credit cards and Social Security numbers during burglaries, then used them to order merchandise to be delivered to those same homes and offices — only to break in again and steal it once it was delivered.

He stole a crowbar and bolt cutters from an Ace Hardware store on Orcas Island, then used the equipment to try to break into the store again later, San Juan County prosecutor Randall Gaylord told the court.

“It shows planning, sophistication, premeditation, all the kind of things that run counter to what…some of the other experts may say about him,” he said.

He said Harris-Moore surveyed citizens’ homes on Camano Island, where he previously lived with his mother, and nearby Orcas Island, to gauge when homeowners would be gone — at which time he would break in and help himself.

“He would eat their food, take their shoes, put on their clothes, and make that place his own during the time that they weren’t there,” Gaylord said.

In one case, when sheriff’s deputies were waiting for him at a house he had previously burglarized, Harris-Moore showed up with a key to the house and entered, he said. “He was ID’d, but before they could get a hand on him, he sprayed pepper spray and was gone. He was on his way out the door almost as fast as he came in.”

Harris-Moore’s two years on the lam came to an end in July 2010, when he was recognized at a resort in the Bahamas and arrested. He had flown to the islands in a plane stolen from Indiana.

Judge Vickie I. Churchill was expected to impose a sentence of up to 10 years Friday afternoon, after defense lawyers finished presenting their case.

Harris-Moore’s attorney, John Henry Browne, warned that imposing a lengthy prison term could ruin the young man.

“Colton has a tremendous spirit. And I’m afraid…that his spirit will be killed and destroyed by a lengthy sentence,” he told the court. “Yes, punish him. But make the punishment proportionate to who he is and what he’s done.”

Rebecca Leigh Crimmins

October 31, 2011     11:19AM

A BARMAID who threw a wet tampon at a McDonald’s worker “for a laugh”
says the drunken prank has ruined her life.

Rebecca Leigh Crimmins, who pleaded guilty to common assault in the Noosa
Magistrates Court, said she had “pretty much lost everything” since the
tampon-tossing incident in the early hours of September 25.

She accused some people of over-reacting to the incident.

The court last week heard a drunk Ms Crimmins had dabbed a McDonald’s
worker’s hand with a wet tampon, before throwing it at him, when she went
through the restaurant’s drive-through at Noosaville.

The confessed “27-year-old hooligan” said the tampon was only wet with
cordial.

The promotional model, who was sacked from the Noosa Surf Life Saving Club
over the incident, said the fast-food staff had “made a mountain out of a
molehill”.

“When the police came around, I thought ‘you’ve got to be kidding’,” she
said.

But victim Luke Clareburt said he was shocked by the incident. “I didn’t know
what was on the tampon,” he said.

“She deserves everything she gets. She’s got no one to blame but
herself.”

Ms Crimmins, originally from Rockhampton, said people needed to “lighten
up”.

“All my friends think it’s hilarious,” she said. “My parents have been
answering the phone saying ‘hello, tampon tossers’.

“I have fun but I’m not a bad person.”

An employee of the American food giant Cargill Inc. stands next to the company logo. Canadian Kexue Huang stole a key component to make a new food product from the company and gave it to a student in China.

A Canadian scientist pleaded guilty to economic espionage and theft for sending U.S. trade secrets on a pesticide and a new food product to China and Germany, federal prosecutors said Tuesday.

Kexue Huang, 46, entered the pleas in U.S. District Court in Indianapolis. He faces a possible maximum prison sentence of 25 years.

Chinese-born Huang was indicted in June 2010 and charged under the Economic Espionage Act, which was passed in 1996 after the U.S. determined other countries were spying on private businesses. His was the eighth case nationwide under the 15-year-old law.

Huang from 2007 to 2010 delivered trade secrets on an organic pesticide he helped develop at Dow AgroSciences in Indiana to persons in Germany and China and used the stolen materials to conduct unauthorized research with the intent to help foreign universities linked to China, the Justice Department said in a news release.

After joining Minnetonka, Minn.-based Cargill Inc. in March 2008, Huang stole a key component to make a new food product and gave it to a student at Hunan Normal University in China, according to an indictment unsealed Tuesday.

The total loss from the charges Huang pleaded guilty to came to approximately $17 million Cdn, but Justice Department spokesman Tim Horty said Huang was responsible for a total of $305 million in losses.

Assistant Attorney General Lanny Breuer said “Huang used his insider status at two of America’s largest agricultural companies to steal valuable trade secrets for use in his native China.”

“We cannot allow U.S. citizens or foreign nationals to hand sensitive business information over to competitors in other countries…These crimes present a danger to the U.S. economy and jeopardize our nation’s leadership in innovation,” Breuer said.

Jason Ara Erpinar

August 22, 2011     2:56 pm

A Yorba Linda man pleaded guilty Monday to raping three women, two of whom he met on a social networking website, officials said.

Jason Ara Erpinar, 22, is expected to be sentenced Wednesday to 15 years in state prison.

Orange County prosecutors say he met two of the women, one 18 and the other 22, on MySpace, asking them on dates and then raping them when they got drunk.

The third woman was Erpinar’s ex-girlfriend, who told authorities he was physically abusive when they were dating and forced himself on her when she was a minor.

One of the women Erpinar met through MySpace allegedly had a cracked tooth and several scrapes on her face when she woke up the morning after their encounter.

An 85-year-old Chula Vista woman accused of illegally bringing immigrants into the U.S. through San Diego pleaded guilty Friday to charges that she led the family-operated smuggling ring.

Thomas Matthews confirmed Friday that his client, Felicitas Gurrola, pleaded guilty in federal court to conspiracy to bring in illegal aliens for financial gain.

As part of the operation, migrants would meet Gurrola at a Tijuana hotel, where they were given immigration documents that belonged to others and told to memorize the information, according to an April 1 affidavit by U.S. Immigration and Customs Enforcement. The migrants were then taken to a beauty salon, where they would undergo makeovers to look more like the people pictured on the documents.

ICE officials said Gurrola’s guides would take the migrants through the San Ysidro border crossing and then to the Los Angeles area via commercial bus. After the migrants arrived in Greater L.A., their families would pay guides cash for the trip, usually about $3,500 a person, the affidavit said.

The group typically brought in 60 to 80 people a month during high traffic times, the affidavit said, and 40 to 60 people during slow months.

Gurrola, who was indicted for immigrant smuggling in 1992 but fled to Mexico, was charged in April with smuggling, along with 10 others, including her daughter, the affidavit said. On a wire intercept from a recent ICE investigation, Gurrola says she had been smuggling immigrants for more than 40 years.

Matthews said his client faced a maximum of five years in prison. But prosecutors said they would seek a punishment of between 2 1/2 years and three years and one month.Matthews said his client’s case was unusual because it was an “old school” smuggling operation done in a safe manner compared with the more dangerous operations common now. Gurrola and her guides would take migrants through the border’s crossing points rather than try to sneak them through the countryside, and no one was ever injured in the process, he said.

“You don’t really see that anymore. This wasn’t a case where people were dying of starvation in the hills … or suffocating in cars,” Matthews said. “This was one of the only old traditional operations that’s been unveiled.”

“This was all done in a very safe, efficient, traditional manner,” he added, saying he believed that would work in his client’s favor when she is sentenced Nov. 9.

Hammer murder ... Fergal Patrick Downey.

August 18, 2011   2:32PM

A MELBOURNE man who once attacked former Victorian premier Jeff Kennett in a pub has admitted murdering a friend in a frenzied hammer attack.

Fergal Downey, 36, killed his friend Kenneth Rolfe, 53, by hitting him more than a dozen times with the hammer in the garden of Mr Rolfe’s Bentleigh home in the early hours of January 6, 2010.

He then smashed his way into the house and attacked Mr Rolfe’s wife Carol Hellman, leaving her with serious head injures.

As she lay on the floor Ms Hellman traced out the letters F-E-R-G-A-L on her leg to inform police.

Police arrested Downey at his home a short time later.

In 2006, Downey attacked Mr Kennett, who was recovering from a hip replacement, by knocking him off a bar stool and ramming him into a wall at a Richmond hotel.

He was ordered to perform 120 hours community service over 12 months.

Mr Kennett was left distressed and in pain after the incident.

Downey had pleaded not guilty to Mr Rolfe’s murder on the grounds of mental impairment at the start of his Victorian Supreme Court trial on Monday.

But today he pleaded guilty to murder and intentionally causing serious injury.

A third charge of armed robbery, relating to money Downey was alleged to have stolen from the home, was dropped.

On the night of the killing, Ms Hellman and Mr Rolfe, 53, had heard a noise and got up to investigate.

Ms Hellman said she saw a bicycle on the verandah and then saw Downey.

“He looked at me and then he went straight for Kenny,” she said.

“The way he looked, he looked really angry, I think.”

Mr Rolfe’s 15-year-old grandson was in the home and witnessed part of the attack but he escaped to a neighbour’s house and raised the alarm.

In a statement to the court, he said his grandfather was hit more than four times.

“A man came around the corner and I saw him hitting Pop in the upper body with a hammer,” the boy said.

“I heard Pop say, `What are you doing?’ and try to protect himself by blocking the hammer with his hands.”

Before the attack Downey had visited a pub with another friend and then smoked the drug ice. It gave him a buzz and left him feeling warm, the trial heard.

Downey told his friend it was the first time he had taken the drug.

A pre-sentence hearing will be held next Wednesday.

Each letter of the first name rules 9 years of life.  Ages 27 to 54 are ruled by the sum of the fourth, fifth, and sixth letters of the name.

Fergal Downey

7 (g is the 7th letter of the alphabet) + 1 (a is the 1st letter of the alphabet) + 12 (l is the 12th letter of the alphabet) = 20

So the number 20 rules his ages twenty-seven to fifty-four.

20 = Court. Accusations. Charges. Plea. Trial. Deliberations. Verdict. Sentencing. Judges. Adjudicate. Confession. Admission. Guilt. Punishment.

Eugene Lockhart Jr. is scheduled to plead guilty in a mortgage fraud case this afternoon before a federal judge.

He faces up to 10 years in prison after filing paperwork late Thursday indicating he was pleading guilty to conspiracy to commit wire fraud.

Lockhart, who got the nickname “Mean Gene the hitting machine” as a linebacker with the Cowboys from 1984 to 1990, was to go on trial Monday.

He and 10 others are charged with arranging approximately 54 home closings in Murphy, Rowlett, Plano and McKinney that resulted in the funding of $20 million in fraudulent loans between 2001 and 2005.

So far, six have pleaded guilty.

Lockhart had been free awaiting trial since charges were first brought against him in 2009. Last summer, he was briefly jailed for failing a court-ordered drug test, but was released and told to stay out of trouble.

Last fall, he got in trouble again. In October, Addison police arrested him after discovering him drunk in the back seat of an Cadillac Escalade with a woman parked at an office building. He tried to hide the arrest from federal authorities, but when they found out, a federal judge ordered him jailed in March.
