An executive at Tiffany & Co., who worked at the upscale jeweler for over 20 years, is accused of stealing more than $1 million in bling, including diamond rings and platinum pendants, according to the FBI.

Ingrid Lederhaas-Okun, 46, a vice president of product development, allegedly stole the jewelry over at least two years, reselling them to an unidentified Manhattan jewelry company, and then lying about their whereabouts.

Lederhass-Okun was arrested this morning at her home in Connecticut and charged with wire fraud and interstate transportation of stolen property. She faces up to 30 years in prison if found guilty.

“As alleged, Ingrid Lederhaas-Okun went from a vice president at a high-end jewelry company to jewel thief,” said Manhattan U.S. Attorney Preet Bharara. “She abused her access to valuable jewelry in order to steal and then resell over $1 million worth of items that she falsely represented as her own… Her arrest shows that no matter how privileged their position in a company, employees who steal will face the full consequences of the law.”

Lederhass-Okun allegedly stole 165 pieces of jewelry worth $1.2 million “including numerous diamond bracelets, platinum or gold diamond drop and hoop earrings, platinum diamond rings, and platinum and diamond pendants,” according to a criminal complaint unsealed this morning in federal court in New York.

Investigators, however, believe they will likely discover millions more in stolen merchandise.

Among the items recovered from Lederhass-Okun’s home were 32 diamond bangle bracelets, each worth $10,000, according to a source familiar with the investigation.

As part of her job, Lederhass-Okun had access to Tiffany designs and pieces which she could access and ship to manufacturers. That authority came with the ability to “write off” inventory that become unsalable because it had been damaged, according to the complaint. Those pieces should have been returned to the company to be destroyed, but instead were pocketed and sold to a third party.

“In deference to the US Attorney’s investigation, we are not in a position to comment at this time,” Tiffany spokesman Carson Glover told ABCNews.com.

Lederhass-Okun appeared in court today. She was released on her own, but must produce $250,000 bail by July 9 or return to jail. In the meantime she must surrender her passport and her travel is restricted to Connecticut and the great New York area.

The family of Brookelyn Farthing, the missing 18-year-old Kentucky girl, warned today that “if someone’s got her … it’s God that’s going to deal with you,” while police said they are still holding out hope that the girl could have dropped out of sight of her own free will.

Farthing was reported missing early Saturday after a couch fire ignited at the home where she was said to have been visiting. The couch was completely consumed as well as the floor beneath it, according Kentucky State Police spokesman Trooper Paul Blanton.

Police are still unsure if the fire had anything to do with Farthing’s disappearance, but it is being investigated as suspicious, he said.

Farthing’s family told ABC News affiliate WTQV-TV in Lexington, Ky., that they just want to see their daughter come back home.

“I want God’s will to be done, and I want Brooke found, and I think it’s God’s will that Brooke be found,” said Farthing’s father, Randal Walker. “It’s not just us, if someone’s got her, it’s not just us that you’re going to have to pay, it’s God that’s going to deal with you.”

Farthing’s family told WTQV that the home was occupied by a male friend of her ex-boyfriend. The home did not have electricity for a couple of weeks, according to the police.

“Our arson investigators say it’s not common for a fire to start without electricity. It’s usually from an electrical short or a lamp that fell over,” Blanton said. “But it doesn’t make any sense that the fire would start the way it did happen. We’re still looking at it as being suspicious.”

Blanton said investigators had questioned the owner of the home, but did not have a suspect or person of interest at this time.

Farthing’s family said all of her belongings were still at the home, including a packed bag. The only item missing was her cell phone, which Walker said is still ringing when called, but no one will answer. They have been unable to track the phone, her family said.

“By the fact that her personal property was still at the house, it makes you believe she is possibly in danger,” Blanton said.

But Blanton said he hopes Farthing is missing because she wants to be missing.

“We’ve had people, once we found them, they say, ‘Hey, I chose to not be in contact with those people,’ and we’ve had ones that turn into homicide,” Blanton said.

State police are asking for anyone with information to contact them. Blanton also said they’d like to hear from Farthing, even if she doesn’t want her family to know where she is.

“She’s 18, it’s up to her whether she wants to have contact or not, she can just contact us and let us know she’s OK,” Blanton said.

Farthing is described as 5 foot, 1 inch tall, with blond hair and brown eyes.

An Ontario man has been handed a fine of nearly $1 million and a prison sentence of more than seven years after he filed falsified tax returns for five straight years and netted millions in refunds he shouldn’t have received.

The Canada Revenue Agency issued a news release on Monday announcing that Roy Francis Smith, of Markham, Ont., had been sentenced to 92 months in prison and a fine of $935,506 after pleading guilty to a single count of fraud over $5,000.

The agency says that an investigation found that Smith filed fraudulent GST/HST returns from 2001 through 2005, which allowed him to net $9,836,052 in “unwarranted refunds.”

According to the agency, Smith managed to obtain information about a company that had been acquired by his employer. Smith then presented himself as a person who was authorized to communicate with the agency on behalf of the company.

The agency says its investigation determined that Smith created a company with a similar name along with a bank account he used to receive and cash the GST/HST refunds.

The agency says that Smith used the refunds “to live a lavish lifestyle,” which included renovating his Markham home and also buying property outside of the country.

Smith also failed to file T1 returns from 2002 to 2005, which meant that he did not report the income he had received through the fraudulent refunds. The agency says that by doing this Smith avoided paying $935,506 in federal income taxes.

In a statement, Darrell Mahoney, the agency’s assistant commissioner for the Ontario region, says his organization is “determined to hold tax evaders accountable for their actions.”

A Texas mother’s determination to keep her family out of danger drove her to battle an alleged carjacker until he fled from her minivan — only to be struck by her vehicle as she tried to “stop him so he didn’t hurt anybody else,” the woman said.

While Dorothy Baker and her 2-year-old and 5-year-old sons were shopping Friday at a CVS in Baytown, Texas, a man identified as Ismael Martinez allegedly hid out in her unlocked van, police said.

When the family got back into the car, Baker said Martinez “popped up out of the backseat and said that if I didn’t want my kids to get hurt, that I would do exactly what he said.”

Martinez, 54, allegedly pulled a knife on Baker while she was driving and demanded she stop at an ATM for money, she said.

When she refused, Martinez allegedly became violent, she said.

Baker said she fought back, refusing to compromise the safety of her children.

“She’s got a cut that goes across her chest, and she grabbed the knife and he bit her hand,” Baker’s husband, Charles Flugence said.

“I took my fist and I hit him in the face, and I told him to get out of my car,” Baker said.

Baker intentionally drove her van into a telephone pole in hopes of sending Martinez through the front windshield, according to the Baytown Police Department crime report.

Police said she managed to dial 911 while she grappled with the suspect in hopes that a dispatcher might hear what was going on in the car and find a way to help, ABC station KTRK-TV in Houston reported.

“I thought, ‘If you swerve and hit the pole, he’s not wearing a seatbelt, he’ll go through the windshield or at least hit his head, and you can stop him. You can do something to make sure that he doesn’t hurt your kids,'” Baker told KTRK-TV. “That’s all I was thinking of really, was just to get him away from my kids.”

Police said Martinez eventually jumped out of the van and tried to flee. But before Baker knew it, she had run her car into him.

“I didn’t mean to run him over,” she said. “I was just trying to stop him so he didn’t hurt anybody else.”

Martinez was airlifted to Memorial Hermann Hospital in Houston with serious injuries after the alleged attack. He is expected to face felony charges once he is discharged.

Meanwhile, Baytown residents have rallied around Baker’s bravery.

“She was trying to protect herself and her kids. I would do the same thing,” resident Joyce Sparks said.

But Baker said she is just glad her family is safe.

“You don’t come after people with kids,” she said. “I told him he messed with the wrong witch.”

Los Angeles police continued to search Sunday for a 46-year-old elementary school teacher who they said stabbed his estranged wife and left her to die on a quiet residential street in West Hills as neighbors rushed to her side.

Michael Rodney Kane forced his way into a home in the 7100 block of Deveron Ridge Road, where his wife, Michelle Ann Kane, 43, was staying with friends after he acted erratically, vandalized his family’s house and violated a temporary restraining order, police said Sunday.

After scuffling with the homeowner and cutting the man’s hand with a knife, Kane allegedly stabbed his estranged wife multiple times about 7:50 a.m. Saturday before she collapsed in the street, police said.

Neighbors who heard the commotion stepped outside to find the woman on the pavement, mortally wounded.

“My son and my wife tried to stop the bleeding,” said Loni Specter, 63, who lives next door to where Kane and her children were staying. “Both of them did what they could, but she was pretty much dead…. It was a nightmare.”

Kane’s two young children, and two from the family with whom they were staying, hid in a bathroom during the attack, neighbor Roy Bernard said the homeowners told him. The wife of the injured man huddled with them, he said.

“She said, ‘No noise. No talking. Stay quiet,'” Bernard said.

The woman’s husband, who knew both of the Kanes, told Bernard that he at first thought he could talk Michael Kane out of doing anything rash and then shouted to Michelle Kane to “run as fast as you can out the front door and don’t stop,” as he fought with him, Bernard said.

“Unfortunately, her husband caught her and he butchered her,” he said. “It’s a tragedy.”

Michelle Kane was pronounced dead at the scene in the hilly, well-kept neighborhood of mostly 1960s tract homes, many of them occupied by their original owners. No one was home Sunday at the house where the killing occurred.

Hours earlier, Michelle Kane, a paralegal and notary public, had gone to the Los Angeles Police Department‘s Topanga Station to report that her estranged husband had vandalized the home they once shared and had violated a temporary restraining order she had obtained, Sgt. Al Flores said Sunday.

“She came in here the night before and said that they were going through a divorce and that she was concerned, that she was worried,” Flores said.

Among other things, Michelle Kane told police that her estranged husband had been uncharacteristically irrational lately and was using drugs, Flores said.

He said one of the station’s officers spent more than an hour with Michelle Kane that night. Flores said he could not discuss specifics of their conversation because of the pending investigation, but he defended the LAPD’s handling of the situation and said it underscores the difficulties of dealing with domestic violence.

“I believe that everything that we could possibly do for her was done,” Flores said.

It was unclear Sunday what triggered the attack or when the couple had split.

In June 2012, they filed a Chapter 7 bankruptcy proceeding to get out from under their debts, including $166,000 owed to credit card companies, court records show. The bankruptcy was discharged three months later, giving the couple a fresh financial start.

In a declaration, the Kanes said their problems stemmed from the 2002 purchase of a new West Hills home that required “landscaping, appliances and various other improvements” paid for with credit cards. When the housing market crashed, it also doomed their plan to tap their home equity to pay the bills, they wrote.

“We didn’t use the cards to buy expensive toys or take extravagant trips around the world,” they wrote. “The charges were for our general living expenses, such as mortgage payments, auto payments, food, insurance and utilities.”

Michael Kane, a teacher in the Los Angeles Unified School District, said he had also spent “a significant amount” on school supplies, and gifts to “incentivize” his students.

“And because I taught in an underprivileged area, I even bought some of the students clothing when I noticed some students coming to class wearing the same thing every day,” he wrote.

Police described Kane as 5 feet 10 and 175 pounds. He was last seen driving a silver, gray or mint green 1999 Chrysler 300M with California license plate 4HGP487.

The Supreme Court of British Columbia says a grieving mother who blames the federal and provincial governments for violating the charter rights of her slain daughter can move forward on a lawsuit.

“My heart is still beating so hard in my chest — I’m still looking at these papers. I just can’t believe it’s for real sometimes,” Rosemarie Surakka, whose 37-year-old daughter Lisa Dudley was gunned down in her Mission, B.C., neighbourhood in 2008, told CBC.

“Today I’m telling you we’re just going to rejoice and be grateful to those who are helping right a wrong done to Lisa.”

The ruling by B.C. Supreme Court Justice Heather Holmes stems from a lawsuit filed by Surakka.

RCMP were called to the scene by a neighbour who heard the gunshots, but the officer never got out of his car, reporting later that everything looked normal in the area.

Dudley was paralyzed and clung to life for four days in the house until a neighbour stumbled on the scene. She died before reaching the hospital. Dudley’s boyfriend was killed instantly in the same attack.

Jack Woodruff, 53, pleaded guilty in the deaths last year and was sentenced to life in prison with no chance of parole for 25 years. Two other suspects are in custody and awaiting trial.

The officer in question was later found guilty of disgraceful conduct and docked a day’s pay.

Surakka alleges the provincial and federal governments — in their responsibility for the RCMP — failed to uphold her daughter’s rights under Section 7 of the Charter of Rights and Freedoms, which guarantees the right to life, liberty and security of the person.

The case drew attention when the federal government moved to have it thrown out, arguing no one, not even a grieving mother, can make a charter case on someone else’s behalf. The government also argued a person’s charter rights end upon death.

But in her ruling, Holmes suggested the law may need updating when a charter violation is fatal.

The ruling may yet be overturned but, for now, Surakka’s lawyer says the case has cleared a major hurdle.

“To my knowledge that’s the first time a claim of this sort has survived a motion to strike,” said Monique Pongracic-Speier.

Andrew Lokan, a Toronto lawyer and adjunct professor of constitutional law at Osgoode Hall law school, agrees the decision is significant. If allowed to stand, it changes the general rule that one must be alive to assert charter rights.

“For me it’s very important that every constitutional wrong should have a constitutional remedy, and that’s the logic that was accepted in this case,” said Lokan.

But Lokan expects Ottawa will appeal the decision, because as it stands, it will open the door to more charter claims on behalf of people who have died.

No one from the federal Justice Department could be reached for comment.

A woman was found alive late last night amid the rubble of the collapse of two buildings in Center City yesterday that left five women and one man dead in one of Philadelphia’s biggest tragedies in recent memory.

The collapse occurred as shoppers fatefully filled the Salvation Army thrift story on a busy Wednesday morning, unaware that an excavation crew ripping down walls at a gutted building next door was about to yank on the wrong beam with heavy machinery.

Bystanders rushed to help amid the block and brick that toppled like a child’s Lego set, and wood frame that snapped like kindling. But it was too late for some browsing the store at 10:45 a.m.

Rescue and emergency crews worked at the collapse site at 21st and Market Streets into the night, helping usher 14 people to three area hospitals and ultimately recovering six bodies.

Then, to the stunned delight of hundreds gathered at the scene, 61-year-old Myra Plekam was pulled from the rubble late Wednesday night – more than 12 hours after the collapse. Plekam was awake and talking to rescuers, before she was taken to a hospital in critical condition, said Deputy Fire Chief Robert Coyne said early Thursday that 61-year-old Myra Plekam.

“Our thoughts and prayers go out to those who lost their lives, and their families,” Mayor Michael Nutter said, adding he hoped the survivors will recover both physically and mentally from the tragic event.

The bodies of all six were recovered in the store, Nutter said.

As of late last night, Fire Commissioner Lloyd Ayers said rescue teams had about 40 percent of the Salvation Army building remaining to search. Nutter reiterated that officials do not know how many people were in the store at the time of the collapse.

The search-and-rescue operation continues this morning. As of 5 a.m., workers and emergency crews were preparing for another day of operations.   Though firefighters and police officers remained on the scene, the ambulances that lined Market Street for much of yesterday are gone.

Yet piles of debris remain a tragic reminder at the site of the collapse.  Roads surrounding the area are still blocked this morning.

Two of the fatalities were a 35-year-old woman, and a man identified by the Inquirer as Borbor Davis, 68, who was last seen working inside the store’s basement.

City officials said they have not yet determined what went wrong.

Yesterday’s events unfolded as workers for Griffin Campbell Construction at 1236 and 1238 Market Street were demolishing what was a commercial storefront that shared a wall with a four-story building.  The Salvation Army story is next door and also shares a wall.

Those who live, work and shop in the area had watched with trepidation as workers used heavy machinery on the walls, wondering how it was possible to demolish a building while it was still attached to the functioning, and thriving, Salvation Army building.

Indeed, the tragedy began with sounds of the buildings crashing down at 10:43 a.m., which one witness described as “a freight train,” when demolition of a four-story structure attached to the Salvation Army thrift shop at 2140 Market Street went horribly wrong.

Twelve people were initially taken to city hospitals after firefighters arrived at 10:45 a.m. following the initial report of the collapse. A 66-year-old woman was rescued about two hours later. About the same time, shortly before 2 p.m., the 35-year-old woman who died was also pulled from the debris.

The building that was undergoing “active demolition” at 2140 Market Street had up-to-date permits for the work, said Licenses and Inspections Commissioner Carlton Williams. Griffin Campbell Construction received permits for the work in February.

Griffin T. Campbell, owner of the company, has a criminal record.  His crew was working for the property owner, identified as STB Investments of New York City. STB’s principal is Richard Basciano, once dubbed “the undisputed king of Times Square porn.”

And attorney representing STB issued a statement late last night.

”Our thoughts and prayers go out to the people affected by this tragic event. Please know that we are committed to working with the City of Philadelphia and other authorities to determine what happened today,” said the statement released by F. Warren Jacoby, of the Cozen O’Connor law firm in Philadelphia.

‘This obviously could have been so much worse,” Nutter said. He defended Williams, the L&I commissioner, when Williams could not answer any additional questions about the demolition permits and if inspections had been made at the work site.

The mayor also said it was not unusual for demolition work to go on directly next to open commercial properties or residential homes.

“There are demolitions taking place on a daily basis,” Nutter said. “So it’s not unusual that there would be people in a store or building next to where a demolition is taking place.

Marc Newell was doing landscaping work on 22nd Street when he heard an “unbelievable rumble.”

The noise “was like a freight train,” Newall said, adding it was immediately clear that people were trapped inside.

“You could hear the moaning,” he said.

Some witnesses to the collapse were visibly distraught.

“The whole building just collapsed and people were stuck in there,” said one woman, who was taken from the scene sobbing.

Brian Mullins, 23, was unloading paint at the nearby Mutter Museum when he heard the building fall. He and his coworkers ran toward the building, and pulled six people from the rubble, he said. At least two others remained inside when rescue crews arrived, Mullins said.

One woman was laying under a fallen wall.

“I just wanted to get people out,” he said.

He said he tried to keep the people inside the building calm amid chaos in the moments after the collapse.

“The dust was so thick you couldn’t see in front of your face,” he said.

Candice Williamson was getting sick from withdrawal. She craved a fix, but she was at her parents’ house in Bromley, Ky.

She drew a bath and quietly prepared a syringe of heroin.

“I was going through the sickness,” the 19-year-old heroin addict recalled. “I told my mom I was going to take a bath. I was sitting on the floor.

“She walked in. She took it from me. It was really bad.”

For Robin Knott, turning the doorknob of her bathroom and seeing her then 18-year-old daughter with a needle was the end of suspicion that Williamson was addicted to heroin. It was the beginning of Knott’s determination to fight for her daughter’s life — even if it might crush their relationship.

Knott turned to a friend in her anguish, and he recommended she file a Casey’s Law petition to get her daughter treatment.

Knott filed the petition and told her daughter, who was living at her boyfriend’s Grant County, Ky., home.

Williamson declared her hate for her mother.

“I told her, ‘You can hate me. But you’ll be alive hating me,’ ” Knott said.

Casey’s Law allows parents or other concerned people to petition the court to order involuntary drug treatment for an adult.

Ohio has a similar law that was enacted in March 2012.

The Kentucky Legislature enacted the Matthew Casey Wethington Act for Substance Abuse Intervention in 2004, named for Casey Wethington of Kenton County, who died of a heroin overdose Aug. 19, 2002, at 23.

His mother, Charlotte Wethington, initiated the law, which is modeled after one in Florida. She has been pushing for such laws throughout the country ever since.

At a petition hearing in early May, Kenton County (Ky.) District Judge Ann Ruttle let Williamson go to her mother’s home instead of jail, cautioning her that if she fled, she’d be tracked down and jailed.

Use of Casey’s Law jumps

Casey’s Law requires court examination, petitions that show the person is a danger to self or others and a medical evaluation by two health professionals, including a physician.

Kenton County Attorney Garry Edmondson has been proactive in informing residents of Casey’s Law. Several years ago, he decided to detail the process through the county attorney’s website at www.kentoncoatty.com/CaseysLaw.htm.

“We put it out there as much as we can,” Edmondson said. “Then of course, we get calls about it all the time from parents. … Sometimes they feel hopeless. We tell them this is something they can do.”

Fewer than 10 Casey’s Law petitions were filed in Boone, Campbell and Kenton counties each year from 2004 through 2008, according to the Kentucky Administrative Office of the Courts. Cases for the three counties jumped to a total of 20 in 2009 and in 2010, then shot up to 66 in 2011 and 71 in 2012.

Out of the 113 Casey’s Law petitions filed in 120 counties in Kentucky in 2011, Boone, Kenton and Campbell county residents filed more than half.

The surge in recent years coincides with a heroin epidemic in Northern Kentucky and across the nation.

A ‘good girl’ addicted

“My daughter was a good girl,” Knott said. “I never, not one time, had to go to the school. She graduated from Walton High School with honors. She wanted to be a nurse.”

Williamson described herself as “the good one.”

“I had a 3.4 grade-point average,” she said, waving halfheartedly toward a diploma on her mother’s living room wall.

She said her parents were free with her because she earned good grades and kept a job.

By the time she met her boyfriend during her senior year, she had already dabbled in prescription painkillers. He had, too. They hung out with friends who were unabashed about taking drugs, she said.

One day, Williamson gave a friend a ride and asked for gas money. The girl’s boyfriend offered heroin instead.

Williamson was reluctant until he told her it was an opiate, “like pain pills,” she said. “I snorted it.”

“After that I said, ‘I don’t want to do that ever again — because I like it way too much.’ ”

What started as a one-time pay-off escalated to a $140-a-day addiction to heroin by snorting. She worked, but money was tight. Her mother said once her daughter junked a car her grandmother had given her for $300 to buy heroin.

It wasn’t long before Williamson developed a tolerance to it. When snorting no longer worked, she started shooting it up.

Shooting up is more powerful, she explained, so it gets you high at a cheaper cost.

Waiting for treatment

In her first days without heroin, Williamson endured sleep-deprived nights with jerking legs and aching muscles. Now, she sleeps better and attends Al-Anon and Nar-Anon meetings when she can.

At a recent meeting, she listened to a mother express hopelessness about her child’s addiction. Williamson told her about how her own mother used Casey’s Law to save her life.

In the hours after the hearing that ordered her into treatment, Williamson was sure her boyfriend would quit for her: “He loves me,” she said, tears filling her downcast eyes. Within a week, she broke up with him.

Out on her parents’ deck recently, Williamson dragged on a cigarette, glanced at the sky and pondered what she might do with her newly clean life. She said she wasn’t sure about the medical field anymore; she’d heard it’s a bad idea for recovering addicts, with all the drugs around it.

After a few minutes, the teen shrugged it off, concluding, “I don’t have to know. I’ve got time.”

And she smiled.

Authorities have arrested the father of a Colorado man accused of breaking into his estranged wife’s home before blasting her with a stun gun and pepper spray and kidnapping their 3-year-old son.

Ronald Turner was arrested early Sunday on a highway in Missouri as an accessory to the kidnapping, the Denver Post reports (http://bit.ly/13Wa246 ).

Police say his son 51-year-old Monty Ray Turner assaulted his wife at her Longmont, Colo., home Saturday and left with their young child.

A court order prohibits Monty Turner from contacting his wife and son.

Longmont Police Cmdr. Jeff Satur says the missing boy might be in a maroon 2001 Dodge Caravan with Colorado tag 576-ZXY; a brown 1997 Ford F350 pickup with Colorado tag 541-YLH or a 1993 Jeep Grand Cherokee with Colorado tag 837-UHS.

A 35-year-old missing persons case in Glendora has been narrowed to a backyard in the 500 block of Essex Street.

Authorities are digging there in hopes of finding the remains of Wendy Byron, who disappeared in August 1978.

“It just always seemed odd to have somebody that had disappeared and you didn’t know what happened,” neighbor Maggie Green told KTLA on Thursday.

Byron’s husband, Robert, was a suspect at the time but he was never arrested or charged, KTLA reported.

“He talked about it some, but not very often,” Green recalled. “And he didn’t know why, didn’t know what had happened.”

Byron, who was 24, was last seen Aug. 26, 1978. Her car was later found at the Ontario airport.

The L.A. County coroner’s office is assisting in the search, KTLA reported. Robert Byron lived in the home on Essex Street until 1989 but has since moved.

The FBI has arrested a suspect in a case involving the discovery of a pair of letters containing the deadly poison ricin and says investigators are working “around the clock” to address any remaining risks.

The U.S. attorney’s office for Eastern Washington had no comment on whether additional charges might be sought.

Matthew Ryan Buquet, 37, was arrested Wednesday.

A grand jury indictment accused him of mailing a death threat to U.S. District Judge Fred Van Sickle in Spokane on May 14.

The indictment did not mention ricin, but the FBI made the link in a news release late Wednesday, saying analysis showed the letter sent to the judge contained “active ricin toxin.”

“Our coordinated team acted swiftly to resolve a potentially dangerous situation, and continues working tirelessly around the clock to investigate the origin of the letters and to address any remaining, potential risks,” Laura Laughlin, the special agent in charge of the FBI’s Seattle office, said in a statement.

The U.S. Postal Service said last week that two letters were intercepted — one addressed to the courthouse and the other to the downtown post office — and they contained ricin in a crude form that did not immediately pose a threat to workers.

Buquet appeared in federal court in Spokane after the FBI said agents arrested him Wednesday afternoon. He pleaded not guilty to mailing a threatening communication.

The short, balding Buquet wore dark-tinted glasses and was shackled in court. He gave brief “yes” and “no” answers to questions from U.S. Magistrate Judge Cynthia Imbrogno.

A search of federal court records turned up no indication that Buquet had ever appeared before Van Sickle or had any connection to the judge.

Imbrogno ordered Buquet held until a bail hearing scheduled for Tuesday. A public defender was appointed to represent him.

If convicted of mailing a threatening communication, he could face up to 10 years in prison and a $250,000 fine.

U.S. Attorney Michael Ormsby declined to comment after the hearing, and little information about Buquet was immediately available.

Ricin is a highly toxic substance made from castor beans. As little as 500 micrograms, the size of the head of a pin, can kill an adult if inhaled or ingested.

There were no reports of illness connected to the Spokane letters.

Investigators in hazardous materials suits spent most of Saturday executing a search warrant at a three-story apartment building in downtown Spokane. Witnesses reported that agents escorted a man from the building.

The Spokane investigation comes a month after letters containing ricin were addressed to President Barack Obama, a U.S. senator and a Mississippi judge. A Mississippi man was arrested in that case.

DEVOTED father-of-two Mal Osborne wasn’t rostered to work when he was killed in a car crash on his way to the office on Saturday morning.

His devastated wife Linda, 57, said her husband had swapped shifts with a colleague at heavy machinery firm David Evans Group after falling sick last weekend.

“He wasn’t even supposed to be starting work that early,” she said.

“He was just at the wrong place at the wrong time.”

Mr Osborne was driving to work about 8am Saturday when a white Holden Commodore driven by a 19-year-old man crossed on to the wrong side of Milne Rd at Beenleigh and crashed head-on into his white Barina.

Police said the Commodore was speeding at the time of the accident, after it had been stolen from a house in Beenleigh on Friday night.

Mrs Osborne said the crash had destroyed her family. She urged young drivers to stop speeding.

“You can’t keep doing what you are doing,” she said.

“Just think, this could happen to any of your families when you get older. Family is the most important thing in the world … and ours is broken now.”

The pair, who would have celebrated their 40th wedding anniversary this year, met as teenagers when they lived near each other at Moggill in Brisbane’s west.

They wed at the civil registry, after deciding they did not want the drama of a big celebration, much to the dismay of their parents.

“That was just before my 18th birthday,” she said.

“Only last week he said I was his soul mate.”

Relatives and friends converged on the 58-year-old’s home in Regents Park as they grappled with the sudden loss.

The big-hearted family man was known for playing tricks on his nieces and nephews with fake creepy crawlies when they were younger.

“Uncle Mally” even had a plastic ant on his car’s dashboard – something the family salvaged from the crash site yesterday.

Daughter Rebecca Wright, 30, said she knew her father would watch over their close family and that he would have been “puttering” down the road when the accident happened.

“He would’ve been driving slowly, trying to save petrol,” she said.

Boss Kurt Evans had only known Mr Osborne for 12 months, since his company bought agricultural and construction machinery business Black-Trac, but said the spare parts interpreter was an affable man who was held in high regard.

“He was a gentle soul who had many years of experience in the industry,” Mr Evans said.

“He was a team player who was committed and hard-working, was well-respected and liked by customers and colleagues.”

History of violence: Before leaving the force, DeCoatsworth was involved in two others incidents in April and September of 2009 where he shot two suspects

A former Philadelphia police officer once hailed as a hero and given a seat next to the first lady at a speech by President Obama has been arrested and charged with rape and other crimes.

Authorities allege that former officer Richard DeCoatsworth left a party with two women early Thursday and took them to another location, where they claim that he produced a handgun and ‘forced the two females to engage in the use of narcotics and sexual acts.’

A police spokeswoman said the two called police after he left, and 27-year-old DeCoatsworth was charged with rape, sexual assault, terroristic threats and related offenses.

DeCoatsworth was hailed as a hero after he was shot in the face during a traffic stop in September 2007 but still managed to chase after his attacker, who was later sentenced to 36 to 72 years in prison.

DeCoatsworth was invited by Vice President Joe Biden to attend the president’s televised February 2009 address to Congress and sat with first lady Michelle Obama.

He said he didn’t know why he had been singled out, but being in the presence of the nation’s leaders was an honor ‘that I will keep with me for the rest of my life.’

WCAU-TV, which first reported his arrest, said DeCoatsworth retired from the department on disability in December 2011.

Police were tight-lipped Saturday about the details of the incident, declining to give even general locations for the party.

According to investigators, at around 2am Thursday, two 20-year-old women were at a social gathering at an unknown locale when they bumped into DeCoatsworth and later left with him, NBC 10 Philadelphia reported.

The trio then went to the home of one of the women in the Fishtown/Kensington area, where the alleged incident took place involving drugs, sexual acts and use of a firearm. The two women contacted police after DeCoatsworth left.

At around 6.30am Saturday, police raided the retired officer’s house in the 2700 block of Salmon Street in Port Richmond and took him into custody.

DeCoatsworth’s record with the local police department was far from spotless. Before leaving the force, he was involved in two others incidents in April and September of 2009 where he shot two suspects.

The Philadelphia cop retired in December 2011 at age 25 after accumulating nine Internal Affairs complaints lodged by citizens accusing him of assault, abuse and misconduct.

Last year, an arrest warrant was issued for DeCoatsworth after he allegedly threatened his neighbor’s mother.

Rob Kardashian charged

Rob Kardashian, charged Friday with misdemeanor battery and petty theft, pleaded not guilty Wednesday to the charges stemming from a scuffle with a photographer in March.

While prosecutors had asked that bail be set at $21,000, L.A. Now reported, Judge Marsha Revel (one of the many judges Lindsay Lohan appeared before) let Kardashian go on his own recognizance.

Now maybe the weight-challenged reality star can get back to working out, which is kind of what got all this started in the first place: Kardashian, who’s been working to drop the pounds, wasn’t cool with surprise photos being taken of him shirtless in the parking garage of a West Hollywood gym.

Kardashian was already sued in civil court over the incident, in which he is accused of roughing up the paparazzo who took said pictures while grabbing her camera and taking out the memory card to prevent the pics from ever seeing the tabloid light of day.

Photographer Kassandra Perez, real name Andra Viak, alleged that she was hit in the face and suffered injuries to her arm and chest and said her memory card was worth approximately $30,000, according to April 30 court documents obtained by E! News. The card contained 1,200 pictures of celebs and about 300 freelance photos, the docs stated.

It looks as if Rob’s taking the criminal proceedings seriously: He was represented Wednesday by Robert Shapiro, TMZ said, one of the attorneys in the O.J. Simpson murder case, on which Kardashian’s late father also worked back in the day.

For most women a police mug shot is the most humiliating photograph that will ever be taken.

In recent months, photographs of celebrities such as Reese Witherspoon and Lindsay Lohan have been forced to pose for the mandatory ‘booking in’ picture at the police station.

A 14-year-old boy in Illinois got the opposite of lucky when a prostitute, with whom he arranged a date while his parents were out, instead made off with his piggy bank.

After arranging to meet the boy over the Internet, Dareka R. Brooks, 22, allegedly followed him to his bedroom in Prospect Heights, Ill., a Chicago suburb, and told him to remove his pants, said Margie Bolger of the Prospect Heights Police Department.

As the teen sat on the edge of his bed, Brooks sprayed him in the face with pepper spray and proceeded to steal his piggy bank and iPad, police said.

Authorities would not confirm how much money was in the bank.

After the alleged robbery, the teen called police.   Cops “pinged” the iPad after Brooks turned it on, allowing them to track her to a motel in Elks Grove Village about 10 miles from the boy’s home, Bolger said.

Brooks was charged with armed robbery and ordered held on $10,000 bond on Thursday.

She did not enter a plea at the time and did not yet have an attorney.

The case is reminiscent of the 1983 Tom Cruise film “Risky Business” in which an Illinois teenager is robbed by a prostitute when his parents are out of town.

Doctors say a Utah soccer referee remains in a coma after being punched by a teenage player unhappy with one of his calls, and his family says their only hope is for a miracle.

The 46-year-old man remained in critical condition Thursday at Intermountain Medical Center in the Salt Lake City suburb of Murray. Doctors say they’re trying to control swelling in his brain and that his recovery is uncertain.

Police say a 17-year-old player in a recreational soccer league punched the referee, Riccardo Portillo, once on the side of his head Saturday after the man flagged him for a foul. The teen has been booked into juvenile detention on suspicion of aggravated assault.

Portillo’s oldest daughter says it wasn’t the first time a soccer player assaulted her father. Johana Portillo says the referee has had ribs and legs broken by players angry with his calls.

The woman accused of putting tainted bottles of orange juice in a Starbucks refrigerated display is a professional chemist, said police who also told ABC News that she is refusing to respond to police questioning about why she allegedly put poisoned bottles in reach of customers.

Ramineh Behbehanian, 50, of San Jose, Calif., works in the research and development department of a pharmaceutical subsidiary of Johnson & Johnson.

San Jose Police Department spokesman Officer Albert Morales told ABC News that Behbehanian refused to speak to officers following her arrest and requested an attorney.

“There is no information at this time that there were any associates,” said Morales. “We’re searching for answers.”

Greg Panico, a spokesman for the J&J subsidiary Janssen Pharmaceuticals confirmed to ABC News that Behbehanian was currently an employee in the company’s research and development department in Fremont, Calif.,

Panico could not confirm how long she has worked for Janssen. According to her LinkedIn profile, she has been there since August 2006, and has expertise in “drug delivery and controlled release technologies,” among other things.

Her LinkedIn profile also states that she has a master’s degree in physical chemistry and chemical engineering from Lehigh University in Bethlehem, Pa. The university did not immediately respond to ABC News’ attempts to verify Behbehanian’s educational history.

Behbehanian was booked on charges of attempted murder and poisoning for allegedly swapping bottles of a Starbucks-owned orange juice brand with contaminated bottles from her purse. She was arrested Monday after a customer in a San Jose Starbucks spotted her switching bottles, said police.

As the witness was notifying Starbucks employees of the woman’s suspicious activity, police said, the suspect apparently overheard the conversation and fled.

The San Jose Fire Department responded to the store after Starbucks employees examined the bottles and found the contents had a toxic smell to them. The bottles were tested with hazardous materials equipment and were found to contain a mixture of isopropyl alcohol, or rubbing alcohol, police said.

A Starbucks employee was able to record the license plate of the woman’s car. Later Monday evening, Behbehanian was taken into custody after she was found to be the owner of the car leaving the scene, police said.

Starbucks spokesman Zach Hutson said no one consumed the contaminated juice and that all of the juice in the store was destroyed “out of an abundance of caution.” Hutson said that other stores in the area were asked to check juice bottles’ safety seals to make sure they weren’t tampered with.

Behbehanian is being held without bail at Elmwood Complex Women’s Facility in Milpitas, Calif. Her arraignment is scheduled for Thursday, Morales said.

It is unclear if Behbehanian has an attorney.

A MAN is in a critical condition after he was set on fire when he refused to give a beggar money.

The incident happened in Long Beach, California on Friday afternoon outside a 7-Eleven.

The 63-year-old man was getting into his SUV when the beggar doused his car and set it on fire.

Bystanders helped put the blaze out and Raymond Sean Clark, 38, was arrested a few blocks away and jailed on suspicion of attempted murder.

His victim remains in hospital with third-degree burns to his chest and face.

“This is an unsettling crime, a horrific act,” Long Beach Sgt. Aaron Eaton told NBC Bay Area. “The potential for other people to get hurt through the vehicle catching fire next door, the building, someone walking by … it’s extremely unsettling for sure.”

Steve Cox said he had just given the man money minutes before the fire.

“He didn’t seem like he was going to harm anybody. He wasn’t very aggressive or anything. I mean, asking for change, he seemed like a nice guy,” Mr Cox said. “I’m really surprised about what happened. It’s outrageous.”

Shannon Flynn, 16, said the victim ‘was engulfed in flames’.

“The fire was so big, people were screaming. I just can’t believe this happened here.”

An Ohio landlord charged with whipping an adult tenant with a belt on his buttocks for falling behind on his rent has been accused of whipping another man with a belt and a paddle, according to court records obtained Friday.

In a lawsuit filed in southwestern Ohio’s Warren County on Tuesday, Mark Neace accuses Ronald Kronenberger of spanking him on four separate occasions while Neace worked as a volunteer in Kronenberger’s grocery store in Waynesville.

The lawsuit, which describes Neace as mentally disabled, says the whippings caused him “severe emotional distress.”

Kronenberger’s home phone number does not accept messages and the number at his grocery store in Waynesville rang busy Friday.

His Dayton attorney, Lawrence Greger, declined to comment.

The lawsuit seeks unspecified damages, but Neace’s attorney said he thinks it’s worth up to $100,000.

“This guy cried in my office,” attorney Eric Deters said. “People with a disability like this have an innocence about them and that innocence being shattered is really sad.”

Deters said Neace, who is 56 and lives with his mother, wanted to volunteer at the grocery store because he’s social and everyone in town knows him.

No police reports have been filed stemming from the incidents, but Deters said he forwarded information about the case to the county prosecutor’s office to consider whether criminal charges are appropriate.

In January, the 53-year-old Kronenberger was charged with hitting a former 29-year-old tenant on the buttocks with a belt in a dispute over more than $2,000 in overdue rent.

A magistrate said he would dismiss an assault charge against Kronenberger in six months if he stayed away from the tenant and out of trouble, but that he would face conviction if he violates the order.

Kronenberger is a former chamber of commerce president and was named Waynesville’s Citizen of the Year in 2006.

Randy Blythe, the frontman of US metal band Lamb of God, has been charged over the death of a fan at a concert in Prague in 2010.

The singer is accused of pushing the fan off stage during the show in the Czech Republic. The fan hit his head when he fell to the concrete floor and died of his injuries 14 days later.

Blythe was charged with causing bodily harm resulting in death on Friday.

Lamb of God’s manager said Blythe will “fight vigorously” against the charges.

The court in Prague has three months to set a trial date or return the case to prosecutors for further investigation.

The 41-year-old singer faces five to 10 years in prison if convicted.

Blythe has previously said that he intends to go to Prague to defend himself at a trial.

In the statement reported by metal website The PRP, the band’s manager Larry Mazer said: “While it is a tragedy that a Lamb of God fan died following a performance by the group, in no way do I feel that Randy did anything improper that led to the young man’s injuries and subsequent death.”

He continued: “The price of a ticket to a show does not entitle audience members access to a band’s stage.”

Mazer said he felt Blythe had “responded professionally” to numerous fans rushing the stage.

“We have testimony from the venue operator that acknowledges lax security and an improper barricade being used that evening,” he added.

Following the incident, Blythe spent five weeks in the custody of Czech authorities before being released on bail in August. He has been in the US since then.

He was arrested when the band flew into Prague to play a gig, apparently unaware that there was an outstanding warrant for the singer’s arrest.

Virginia-based Lamb of God, who received Grammy nominations in 2007 and 2011, played at the Download festival at Donington Park in the UK in June.

Gulf oil spill

Laying the blame for the deaths of 11 oil rig workers in the Deepwater Horizon explosion and Gulf of Mexico spill on BP, federal prosecutors announced Thursday that two BP supervisors had been charged with manslaughter and the company would pay a $4-billion criminal fine, the largest in U.S. history.

“Those deaths were in fact unnecessary,” Atty. Gen. Eric H. Holder Jr. said in New Orleans, adding that the federal investigation continued into the 2010 disaster and the nation’s biggest offshore oil spill. “Our work is far from over.”

The charges, contained in a criminal settlement with BP and an indictment handed down by a federal grand jury, paint a picture of a corporation that placed “profit over prudence,” said Assistant Atty. Gen. Lanny Breuer.

Not only did the BP supervisors on board the rig the night of the explosion fail to take steps to prevent the blowout when they realized they were losing control of the deep-sea well, company executive David I. Rainey later lied to Congress about the size and severity of the spill, prosecutors said.

“As part of its plea agreement, BP has admitted that, through Rainey, it withheld documents and provided false and misleading information in response to the U.S. House of Representatives‘ request for flow-rate information,” the Justice Department said.

The explosion on the night of April 20, 2010, unleashed a gush of oil from broken equipment on the seabed that continued for nearly three months off the Louisiana coast. More than 200 million gallons of oil were spilled, shutting down commercial fisheries, destroying the summer beach season along part of the coast and fouling coastal wetlands.

Still to be settled are federal civil claims for the spill’s environmental damage that could cost BP billions of dollars more. Justice Department officials said negotiations with the company had so far failed to produce an agreement that could avert a civil trial scheduled for February.

Also, a federal judge in New Orleans has not yet approved an estimated $7.8-billion settlement with about 120,000 plaintiffs in a civil suit by fishermen, beachside property owners and business owners, among others.

As part of BP’s settlement of criminal charges, prosecutors said BP had agreed to plead guilty to felony manslaughter, environmental crimes and obstruction of Congress, and would pay the record $4 billion in criminal fines and penalties.

About $2.4 billion of that will go to environmental restoration in the gulf. The company will pay an additional $525-million civil penalty to the Securities and Exchange Commission for misrepresenting the size of the spill in SEC filings.

Robert M. Kaluza, 62, of Henderson, Nev., and Donald J. Vidrine, 65, of Lafayette, La. — the highest-ranking BP supervisors on board that night — were charged with 11 felony counts of seaman’s manslaughter, 11 felony counts of involuntary manslaughter and one violation of the Clean Water Act in a federal indictment unsealed Thursday. Rainey, 58, of Houston, a former BP executive who helped oversee the spill response, was charged with obstruction of Congress and making false statements to law enforcement officials.

Lawyers for Kaluza blasted the government case. “After nearly three years and tens of millions of dollars in investigation, the government needs a scapegoat,” attorneys Shaun Clarke and David Gerger said in a statement. “Bob was not an executive or high-level BP official. He was a dedicated rig worker who mourns his fallen co-workers every day.”

At the height of the spill, then-BP Chief Executive Tony Hayward was forced to step down, in part for commenting, “I’d like my life back,” during the frenetic cleanup period when oil was washing ashore in Louisiana and many livelihoods were in ruins.

In a statement, Bob Dudley, BP’s current chief executive, said the company deeply regretted the loss of life. “From the outset, we stepped up by responding to the spill, paying legitimate claims and funding restoration efforts in the gulf. We apologize for our role in the accident, and as today’s resolution with the U.S. government further reflects, we have accepted responsibility for our actions.”

Chris Jones, whose younger brother Gordon Jones died in the fiery explosion, was not satisfied with BP’s mea culpa.

“The fact that BP is finally admitting that it is responsible is not shocking; the amount of money it is paying in fines is not shocking,” said Jones, a litigation attorney in Baton Rouge, La. “What is shocking is that it has been three years since this happened and not once has a representative of BP said to us, ‘I’m sorry for your loss.’ It’s par for the course.”

“BP is simply going to sign a check for billions of dollars, then continue to do business in U.S. waters and make money for its shareholders,” he said. “But Gordon wasn’t able to live a day after April 2010.”

British BP can easily absorb the $4.5-billion settlement, analysts said.

In the third quarter alone, BP raked in sales of more than $93 billion and had a net profit of more than $5.2 billion. That shows that “BP has made the most remarkable comeback from the most costly industrial accident in history,” Fadel Gheit, senior energy analyst at Oppenheimer & Co., said in a note to investors.

Snoop Dogg Reflects On Protect The West Summit, Says He's The Reincarnation of Bob Marley

Snoop Dogg has unveiled the trailer for his new documentary “Reincarnated,” chronicling his new album of the same name and the transformation into his new Reggae persona Snoop Lion.

“F— Snoop Dogg…All that sh– be out of here,” he says in the opening to the Vice-produced visual. “Rastafari called me.” Snoop Lion discussed the film, which was recently selected to premiere at the 2012 Toronto International Film Festival, and his journey from hip-hop to reggae at a small media gathering in NYC yesterday with MTV’s Sway Calloway, the album’s producer Diplo and supporters including Rohan Marley, son of the late great Bob Marley, and singer Melanie Fiona.

“I always said I was Bob Marley reincarnated,” said Snoop, paying homage to the Reggae legend. Snoop explained how after several years in hip-hop, he was tired of rapping and felt his creative juices plateau. While at a Rastafarian temple in Jamaica, Snoop met a high priest and instantly felt a spiritual awakening. “No more. You are the light; you are the lion,'” said the priest. This prompted Snoop’s name change and a new direction for his music. Reincarnated producer Diplo echoed this excitement over the project, dubbing it some of the best music he’s ever been a part of and a professional “dream come true.”

Snoop emphasized that this album will be universal and more importantly, authentic. The first single, “La La La” serves as the perfect introduction for what fans can expect moving forward. Snoop’s clearly having fun with this all. He gleefully said that his new creative direction has given him a “rebirth. “I’m 19 again,” he added laughing.

Pope Benedict XVI fired a 52-year-old Slovak bishop for apparently mismanaging his diocese in a rare show of papal power over bishops that could have implications for U.S. sex abuse cases.

Usually when bishops run into trouble — either for alleged moral lapses or management problems — they are persuaded by the Vatican to resign. But Benedict has become increasingly willing to forcibly remove bishops who refuse to step down, sacking three others in the past year alone.

His willingness to do so raises questions about whether he would take the same measures against bishops who covered up for sexually abusive priests. So far he has not.

In the most notable case to date, Benedict fired Bishop William Morris of Toowoomba, Australia, last year after he called for the church to consider ordaining women and married men. He also removed a Congolese bishop for management problems in his diocese and an Italian one in May for similar reasons.

On Monday, the Vatican said Benedict had “relieved from pastoral care” Bishop Robert Bezak of Trnava, Slovakia. No reason was given, but Italian news reports suggested administrative problems were to blame, and Slovak news reports quoted Bezak as saying he thought his criticism of his predecessor may have had a role.

Bishops normally hand in their resignation when they turn 75 years old, their customary retirement age.

The exercise of the pope’s ability to fire a bishop has important implications, particularly concerning bishops who mishandle pedophile priests.

In the face of U.S. lawsuits seeking to hold the pope ultimately responsible for abusive priests, the Holy See has argued that bishops are largely masters of their dioceses and that the pope doesn’t really control them. The Vatican has thus sought to limit its own liability, arguing that the pope doesn’t exercise sufficient control over the bishops to be held responsible for their bungled response to priests who rape children.

The ability of the pope to actively fire bishops, and not just passively accept their resignations, would seem to undercut the Vatican’s argument of a hands-off pope.

“If the pope can fire a bishop, that implies he’s their supervisor,” said Nick Cafardi, a U.S. canon lawyer and former chairman of the U.S. bishops’ lay review board that monitored clerical abuse. “This will invite more lawsuits attempting to sue the pope in American courts.”

Jeffrey Anderson, who is seeking to hold the Holy See liable for a case of an abusive priest in Oregon, said the Vatican was trying to have it both ways.

“They will remove, using their canon laws and their own protocols, bishops, priests and clerics for any reasons — for theological or any other reasons — but when it comes to sexual misconduct, they never use those same standards,” he said.

Even the most well-known case, that of Cardinal Bernard Law, ended when Law offered his resignation after the sex abuse scandal exploded in his Boston archdiocese 2002. Law subsequently was named archpriest of one of the Vatican’s basilicas in Rome, St. Mary Major.

That said, things may be changing: The Vatican’s sex crimes prosecutor, Monsignor Charles Scicluna, warned in February that bishops could face possible church sanctions for malicious or fraudulent negligence if they fail to follow the Vatican’s rules on handling sexually abusive priests. But he acknowledged that such bishop accountability needed to be “further developed.”

Lamb of God‘s D. Randall “Randy” Blythe was detained in Prague this week. The heavy-metal singer could face five to 10 years in prison for an alleged altercation at a 2010 Lamb of God show that reportedly left a concertgoer dead, according to Czech media outlet Novinky.

Early reports indicate the incident involved a man repeatedly rushing the stage from the crowd. He was ejected from the stage and later died of head injuries sustained during the alleged altercation, according to Novinky and WTVR, the CBS News affiliate in Lamb of God’s hometown of Richmond, Virginia.

Lamb of God canceled a show at the Rock Cafe in Prague Thursday after the singer was brought in for questioning. Some reports say he was arrested and charged with “the crime of bodily harm of 4th degree and resulting in the death of a fan,” however, representatives for the band say he hasn’t been formally charged.

Randy’s brother, Mark Blythe, told WTVR the manslaughter charge is “bogus and outrageous and will be dropped immediately.”

The band tweeted the hashtag #FreeRandyBlythe late Thursday. (Blythe deleted his once extremely active personal Twitter account earlier this summer).

Maria Ferrero, the Grammy-nominated band’s longtime publicist, told MTV News that Lamb of God’s management will not comment in full on the matter until Monday. “As no formal charges have yet been made and the case is only in the investigation stages, it would be premature to make an official statement filled with false truths or innuendos,” she said in an email to the press.

“Having said that, management wished to address today one false piece of information that has been included in many of the news stories released so far,” she continued. “Under no circumstances was there a fight of any kind involved. This incident deals with a fan that three times during the concert jumped the barricade and rushed Randy during the performance. It is alleged that the third time, security was not able to reach him and that Randy pushed him back into the audience where supposedly he fell and hit his head. Again, until the investigation is concluded this weekend, nothing more will be released, but clarity and the facts needed to be addressed on this one reported point which is totally inaccurate.”

The alleged incident took place during a show at Prague’s Club Abaton in May, 2010. Friday night’s (June 29) show in Germany is still listed on the band’s official Facebook page, as well as a show on Sunday in Finland. Lamb Of God is currently on tour in support of Resolution, which debuted at #3 on the Billboard 200 in January.

The former boyfriend of the late singer Amy Winehouse has been charged with rape.

Reg Traviss faces two counts of rape and will appear before magistrates next month.

The 35-year-old had been seeing the singer for more than a year when she died at her home in Camden, north London, last July.

The film director has been behind movies including Psychosis, which featured Charisma Carpenter and Darkness frontman Justin Hawkins.

Traviss, who was charged under his full name Reginald, was arrested on April 5 by the Metropolitan Police in relation to an allegation of rape reported on January 18.

Rebecca Mundy, a lawyer for the Crown Prosecution Service, said: ‘I have authorised the Metropolitan Police to charge Reginald Traviss with two counts of rape.

‘The alleged offences took place between 29 December 2011 and 1 January 2012.’

The lawyer from the CPS London Rape and Serious Sexual Offences Unit added: ‘The decision was taken in accordance with the Code for Crown Prosecutors.’

He will appear at Westminster Magistrates’ Court on July 17.

Police have not yet made any arrests in the weekend shooting of two south Texas teens at a Portland park. According to CBS affiliate KZTV, two visitors to the Violet Andrews Park found the women’s bodies lying in the grass. Mollie Judith Olgin,19, was pronounced dead at the scene and her apparent girlfriend, 18-year-old Mary Christine Chapa, was hospitalized with a gunshot wound to the head. Chapa was reportedly listed in serious but stable condition. KZTV reports investigators believe they teens were shot around midnight on Friday. They were found about 9 hours later Saturday morning. According to the Corpus Christi Caller-Times, police say the women likely walked with their attacker down a trail and into knee deep grass. This is where authorities believe they were shot with a large caliber handgun. Friends of the women said the two had been dating for about five months, KZTV reports. Investigators reportedly do not believe this was a random incident but have not named a potential motive.

A suburban Chicago businessman who used to be a campaign fundraiser for imprisoned former Gov. Rod Blagojevich and Congressmen Jesse Jackson Jr. has been arrested on fraud charges related to his outpatient surgery centers.
FBI agents took Raghuveer Nayak (RUG’-oo-veer NAY’-uk) of Oak Brook into custody Wednesday. He’s accused of paying bribes and kickbacks to physicians for patient referrals and filing false federal income tax returns.
Nayak owns outpatient centers in Illinois and Indiana.His name came up during Blagojevich’s corruption trials, although he wasn’t charged and didn’t testify. Prosecutors contend Nayak told the FBI that Jackson instructed him to raise millions for Blagojevich in exchange for President Barack Obama’s vacated Senate seat.Jackson has denied wrongdoing.

Nayak and Jackson haven’t returned messages seeking comment Wednesday.

A Fort Wayne man was sentenced to life in prison Monday for bludgeoning to death and dismembering a 9-year-old girl he was baby-sitting just days before Christmas.

Michael Plumadore last month pleaded guilty to murder, abuse of a corpse and removing a dead body from the scene in the Dec. 22 death of Aliahna Maroney-Lemmon. Prosecutors initially called for the death penalty but agreed to life in prison without the possibility of parole in exchange for the guilty plea.

On Monday, a judge accepted that plea deal and added a further 36 years to the sentence: three more years for abuse of a corpse; three years for moving her body; and 30 years more for the murder charge because Plumadore is a habitual offender.

The day Aliahna died, Plumadore was looking after the third-grader and her 6-year-old sisters at his mobile home because their mother was sick. Aliahna’s family and Plumadore lived in the same trailer park in Fort Wayne. Aliahna’s relatives described the 39-year-old man as a trusted family friend who had helped care for the girl’s dying grandfather.

Police found the girl’s head, hands and feet in the freezer at the mobile home where Plumadore had lived with Aliahna’s grandfather, who had died about three weeks earlier. The other remains were thrown into trash bags and discarded at a gas station.

The other girls weren’t harmed.

At last month’s hearing, Plumadore told the judge he killed Aliahna by repeatedly striking her in the head with a brick, then he cut her up with a hacksaw.

“I put parts in my freezer and took the rest down to the Marathon station and put them in a Dumpster,” he said.

Plumadore has criminal records in Florida and North Carolina including convictions for trespassing and assault, and an Indiana conviction for forgery.

Rodney King was found at the bottom of his swimming pool at his home in Rialto early Sunday, authorities said.

King’s fiancé called 911 about 5:25 a.m. and said she found King at the bottom of his pool, Sgt. Paul Stella told The Times. Officers pulled him from the pool and began CPR until paramedics arrived and took King to Arrowhead Regional Medical Center in Colton.

King was pronounced dead at the hospital at 6:11 a.m., Stella said.

Preliminary information indicated King drowned and there were no immediate signs of foul play, Stella said.

An autopsy will be conducted.

King was drunk and unarmed when he was pulled over in 1991 for speeding by Los Angeles Police Department officers, who responded to his erratic behavior by kicking him and striking him dozens of times with their batons.

The incident was captured on video by a civilian bystander, and the recording became an instant international sensation.

Four of the officers were tried for excessive force. Their acquittal on April 29, 1992, touched off one of the worst urban riots in U.S. history.

King became a symbol for police brutality and troubled relations between the LAPD and minority residents. He was eventually awarded a $3.8-million settlement. But the money and the fame brought him little solace. He had repeated run-ins with the law and as of April said he was broke. He wrote a book this year recounting his struggles.

King said he was scarred by the beating.

“It felt like I was an inch from death,” he says, describing what it was like to be struck by batons and stung by Tasers.

A jury acquitted four police officers in the beating of King, unleashing an onslaught of pent-up anger in parts of the community. There were 54 riot-related deaths and nearly $1 billion in property damage as the seams of the city blew apart.

 In an interview with The Times this year, King confided that he was at peace with what happened to him.

“I would change a few things, but not that much,” he says. “Yes, I would go through that night, yes I would. I said once that I wouldn’t, but that’s not true. It changed things. It made the world a better place.”

What emerges from both the book and the man is the picture of someone who has spent two decades coping, not always well, with the blows that police inflicted on the night of March 3, 1991, and with the notoriety that came later.

Thousands have protested in Greece against the far-right Golden Dawn party after one of its members assaulted a woman on live TV.

Demonstrators shouted “Neo-Nazis out” in rallies called by left-wing and anti-racism groups in Athens.

On Thursday, Ilias Kasidiaris, a Golden Dawn MP, was filmed hitting a left-wing politician during a chatshow.

The rally comes nine days before elections which could result in a Greek exit from the Eurozone.

In polls a month ago, Golden Dawn surprised many by winning 21 seats in Greece’s 300-seat parliament.

A second election is taking place as no party was able to forge a coalition.

Arrest warrant

Prosecutors said an arrest warrant has been issued for Mr Kasidiaris, whose whereabouts remain unknown after he fled the television studio on Thursday.

The assault took place during a live debate on a daily morning political show on the private Antenna television.

Mr Kasidiaris appeared to have been provoked when Rena Dourou of the radical left-wing Syriza party mentioned his alleged involvement in an armed robbery in 2007.

He jumped up and threw a glass of water across the table at her, a You Tube clip of the Antenna television channel showed.

When Liana Kanelli of the Greek Communist party, the KKE, apparently threw a newspaper at him, he responded by slapping her around the face with three right-left blows.

Speaking to a TV station from an undisclosed location on Friday, Mr Kasidiaris said he had been provoked.

“She (Communist party member Liana Kanelli) raised her hand and hit me first and since I respect my honour and my name, I had to defend myself. The police ought to arrest her,” he told Star TV, according to Reuters news agency.

The government and other political parties have condemned the attack.

“The government condemns in the most categorical way the attack by Golden Dawn spokesman Ilias Kasidiaris against Liana Kanelli and Rena Dourou,” government spokesman Dimitris Tsiodras said.

“This attack is an attack against every democratic citizen.”

Mr Kasidiaris is already facing charges of theft and bodily harm, which he denies.

Golden Dawn campaigned on an anti-immigrant platform, and has even proposed planting mines along Greek borders to prevent the entry of migrants. It has been accused of violent attacks against immigrants in Athens, but denies the claims.

The rescuers had rappelled from a helicopter, swaying in the brisk April winds as they bore down on a cave 7,000 feet up in a rugged desert mountain on the edge of this rural hamlet. There had been a call for help. Inside, they found a jug with about an inch of water, browned by floating leaves and twigs. They found a woman, Christie McNally, thirsty and delirious. And they found her husband, Ian Thorson, dead.

The puzzle only deepened when the authorities realized that the couple had been expelled from a nearby Buddhist retreat in which dozens of adherents, living in rustic conditions, had pledged to meditate silently for three years, three months and three days. Their spiritual leader was a charismatic Princeton-educated monk whom some have accused of running the retreat as a cult.

Strange tales come out of the American desert: lost cities of gold, bandit ambushes, mirages and peyote shamans. To that long list can now be added the story of the holy retreat that led to an ugly death.

The retreat — in which adherents communicate only with pen and paper — was designed to allow participants to employ yoga and deep meditation to try to answer some of life’s most profound questions. Mostly, though, it has only raised more questions.

Was it a genuine spiritual enclave? What happened to drive Ms. McNally and Mr. Thorson out of the camp and into the wilderness? And just why, in a quest for enlightenment, did Mr. Thorson, a 38-year-old Stanford graduate, end up dead, apparently from exposure and dehydration, in a remote region of rattlesnakes and drug smugglers?

When Ms. McNally and Mr. Thorson left the retreat on Feb. 20, after having participated for one year and one month, she had been its leading teacher. The monk who ran the retreat, Michael Roach, had previously run a diamond business worth tens of millions of dollars and was now promoting Buddhist principles as a path to financial prosperity, raising eyebrows from more traditional Buddhists.

He had described Ms. McNally for a time as his “spiritual partner,” living with him in platonic contemplation. What the other participants did not know is that before she married Mr. Thorson, Ms. McNally had been secretly married to Mr. Roach, in stark violation of the Buddhist tradition to which he belongs.

Even the manner in which Ms. McNally and Mr. Thorson left the retreat adds a fresh turn to an already twisty tale. It came days after she made a startling revelation during one of her lectures: she said that Mr. Thorson had been violent toward her, and that she had stabbed him, using a knife they had received as a wedding gift.

The authorities do not suspect foul play in Mr. Thorson’s death. Still, the events at Diamond Mountain University, as the place that hosts the retreat is known, have pried open the doors of an intensely private community, exposing rifts among some of Mr. Roach’s most loyal followers and the unorthodoxy of his practices.

In an interview, Matthew Remski, a yoga teacher from Toronto who unleashed a storm online after posting a scathing critique of Mr. Roach after Mr. Thorson’s death, described Mr. Roach as a “charismatic Buddhist teacher” whom he used to respect until his popularity “turned him into a celebrity” whose inner circle was “impossible to penetrate.”

Others spoke of bizarre initiation ceremonies at Diamond Mountain. Sid Johnson, a former volunteer who also served on its board of directors, said his involved “kissing and genital touching.” Ekan Thomason, a Buddhist priest who graduated from a six-year program there, said hers included drawing blood from her finger and handling a Samurai sword, handed to her by Ms. McNally.

“Should a Buddhist university really be doing such things?” Ms. Thomason asked.

Erik Brinkman, a Buddhist monk who remains one of Mr. Roach’s staunchest admirers, said, “If the definition of a cult is to follow our spiritual leader into the desert, then we are a cult.”

Mr. Thorson’s mother, Kay Thorson, hired two counselors about 10 years ago to pry her son away from Mr. Roach, who was trained under the same monastic tradition as the Dalai Lama. She recalled him as “strange,” someone who “sometimes connects, sometimes doesn’t, but who clearly connected with people who were ready to donate and adulate.”

The intervention — the term she used to describe it — offered only temporary relief. Mr. Thorson left for Europe for a time, but eventually rejoined the group.

“We learned of a possible offshoot to over-meditation, or meditation out of balance, or the wrong guidance in meditation; I don’t know the right word here,” Mrs. Thorson said in an interview. She recalled her son’s “compromised critical thinking, as far as making decisions and analyzing things,” and she feared Mr. Roach’s technique and guidance had pushed him there, but could not get him back.

Mr. Thorson and Ms. McNally, 39, married on Oct. 3, 2010, by the sea in Montauk, N.Y., almost three months before they left for the retreat and a month after Mr. Roach had filed for divorce from her. Ms. McNally and Mr. Roach had an old Dodge Durango, $30,000 in credit card debt and little else, according to the filing, in Yavapai County Superior Court.

Ms. McNally and Mr. Roach had shared a yurt in an earlier three-year retreat he promoted, in 1999, but swore they were celibate. The relationship nonetheless stirred reproach by Buddhist scholars, who urged him to renounce his monastic vows, and the Dalai Lama, whose office decried his “unconventional behavior.”

The marriage was a closely held secret. In writing, the only way he agreed to answer questions, Mr. Roach, who uses the title “geshe,” a type of doctoral degree in theology in the Buddhist monastic system, said he and Ms. McNally “come from strong Christian backgrounds” and “wanted to do a Christian partnership ritual at the same time we did the Buddhist one, at the beginning of our partnership.” (They were married on April 16, 1998, in Little Compton, R.I.)

He also said he wanted her to be “legally entitled” to his possessions if something happened to him. Their success seemed interdependent: They had written books together, given lectures around the world and were the forces behind Diamond Mountain.

In early February of this year, Ms. McNally and Mr. Thorson received a letter from Mr. Roach and the five other members of Diamond Mountain’s board of directors, demanding explanations for the violence and stabbing she had discussed in her lesson. There was no reply. In a letter she posted online — which she wrote after their departure from the retreat, though before Mr. Thorson’s death — Ms. McNally described it as an accident by a novice martial-arts practitioner rehearsing her moves.

The board’s president, Rob Ruisinger, said in an interview that Mr. Thorson had been stabbed three times in the torso, and that one of the wounds had been sutured by a medical professional who is among the retreat’s participants.

Ms. McNally and Mr. Thorson were given five days to leave. Instead, they departed without notice.

In her letter, she said they simply were not ready to go back into the world, so they decided to “go camping in the cow-herding land” next to Diamond Mountain “to get our thoughts settled.” When people came looking for them, they clambered uphill, she wrote, to the cave where Mr. Thorson would die. Some of the retreat participants would leave water for them, knowing they were still around. She told the authorities that at some point, she fell ill, he fell ill and they grew too weak to fetch it, said Sgt. David Noland, the search-and-rescue coordinator for the Cochise County Sheriff’s Office.

On April 22 at 6 a.m., Ms. McNally sent a distress signal to Diamond Mountain from a portable transmitter she had been carrying. Three of Diamond Mountain’s caretakers set out to look for her and Mr. Thorson, but could not find them. Around 8 a.m., the caretakers called 911.

Mr. Thorson was cremated in nearby Willcox on April 26. His mother said it was the last time she saw Ms. McNally, who could not be reached for comment.

The retreat is set to end on April 3, 2014. Of its original 39 participants, 34 remain.

A Tennessee man has been charged with attempted murder after shooting a TV weatherman in the chest with a crossbow during a home invasion.

Gerald Delbert Taylor, 53, from Johnson City, is accused of breaking into the home he once shared with Robert William Batot, 43, and firing a crossbow bolt into Batot’s chest during an altercation.

Batot fleed the house as Taylor also fired at him with a 9mm handgun, missing him with every shot.

Batot, who uses the name Rob Williams when working as a meteorologist for WJHL Channel 11, still had the bolt sticking out of his chest when police arrived on the scene after the attack early on Monday morning.

It is unclear why Taylor launched such a vicious attack against Batot, but the TV personality had taken out a restraining order against Taylor in May.

In court details for that order or protection, Batot alleged that Taylor had earlier vandalised his car – slashing the tyres – had stolen from him, and had threatened to kill him on precious occasions.

Taylor, who had been staying at a local motel after being evicted from Batot’s house, had allegedly threatened to ruin Batot’s reputation, before threatening to kill Badot and then himself.

The restraining order prevented Taylor from going to Batot’s Ashworth Court home or his place of work at Channel 11.

Taylor has now been charged with attempted first-degree murder, aggravated burglary and violation of an order of protection.

The attack occurred at Williams’ home before 4am on Monday.

Police said Taylor broke into the house through a window and shot Williams with the crossbow when the home owner confronted him.

Taylor is then said to have fired several shots from a 9mm handgun as Williams tried to run from the house. But all bullets fired from the weapon missed their target.

Police claim Taylor fled the house after firing the weapons and was found by police on a dock nearby Batot’s waterside property.

He was still holding the handgun, arresting officers claim, and was subdued with the use of a Taser after a brief confrontation.

Batot is recovering in hospital and has posted a statement on his Facebook page about the incident.

On the Channel 11 website, Batot has thanked everyone for their concern, and is helping the police with their investigation.

Police are charging a 23-year-old man with one count of first degree murder and six counts of attempted murder in connection to the Saturday shooting inside Toronto’s Eaton Centre that left one man dead and wounded six others, including a 13-year-old boy.

Christopher Husbands, who was accompanied by a lawyer, turned himself in to police early Monday morning, said Toronto police Det. Sgt. Brian Borg at a Monday afternoon news conference.

At the time of the shooting, Husbands had been charged with another offence and was under house arrest, Borg said.

“Our investigation continues to suggest that this is a targeted shooting and not a random act of violence against members of the general public,” said Borg.

Borg wouldn’t discuss the motive of the shooting.

“Even though there are several persons who have now been identified in this case as being known gang members, or who have gang associations, I do not believe this to be a gang-motivated shooting.”

Police believe Ahmed Hassan, the 24-year-old killed at the scene, was almost certainly an intended target of the shooting. Another 23-year-old man who was shot several times in the neck and chest was also likely targeted, according to police.

Borg confirmed that Husbands, Hassan and the wounded 23-year-old were all in the same gang, but he didn’t specify which one. Borg stressed that despite this link, police don’t think the gang affiliation was a factor in the shooting.

“I believe that there’s personal aspects involved,” he said.

Teen ‘doing well’

The youngest victim of the shooting — 13-year-old Connor Stevenson — was an innocent bystander caught up in the attack. He was shot in the head. The Grade 8 student from Port Hope, Ont., was visiting Toronto with his family at the time of the attack.

Doctors had removed a piece of his skull to relieve swelling and had been keeping him in an induced coma as his parents Joanne and Craig, and sister Taylor, 15, and other close family members maintained a bedside vigil.

“After complicated neurosurgery, we are happy to say that he is doing well, all things considered; he is alert and talking. It will be a long healing process, but we are optimistic that he will recover,” the boy’s family said in a statement.

The 23-year-old man who was shot in the neck and chest remains hospitalized, while the four other people who suffered gunshot wounds have all been released from hospital.

Susan Allen, the mall’s general manager, told reporters on Monday afternoon that Eaton Centre staff are hoping that those injured in the shooting have “a speedy and complete recovery.”

The Eaton Centre is a popular tourist attraction that receives roughly one million visitors a week.

Belongings left at food court can be picked up

The shooting, which has attracted international attention, took place in the mall’s busy lower-level food court.

The mall was locked down immediately after the shooting, but police did not locate any suspects during their search. The victim was pronounced dead at the scene after being shot multiple times.

The nature of the injuries to the six wounded are as follows:

  • A 25-year-old woman was wounded in her left leg and has been released from hospital.
  • A 22-year-old man was also wounded in his left leg and also released from hospital.
  • A 23-year-old man remains in hospital after suffering “multiple gunshot injuries” to his neck and chest.
  • A 13-year-old Connor Stevenson, who was visiting from out of town with his family, was wounded in the head and remains in hospital.
  • A 30-year-old woman suffered a “gunshot-graze wound” to her abdomen and has been released from hospital.
  • A 22-year-old woman was wounded in the hand, but left hospital without treatment.

Additionally, a 28-year-old pregnant woman went into labour after being knocked down in the rush to flee the area. However, she was discharged from hospital on Sunday and did not give birth.

Those who left their belongings in the food court during an evacuation following the shooting will be able to pick up their property on Tuesday, Borg said. Police are asking affected people to go to Toronto police’s 51 Division on Tuesday starting at 9 a.m. with photo identification.

Interested parties should not call ahead before picking up their belongings, said Borg.

Mall reopens

The mall re-opened Monday morning at its regular time.

Storekeepers said they were not concerned about coming to work. They said they feel reassured it was an isolated incident and that a suspect is in custody.

One man did say he feels a bit “tense,” because the shooting was apparently gang related, so problems could recur.

The food court where the shooting happened is expected to remain closed until Tuesday.

A Halifax man who survived the fatal shooting on Clifton Street last week says the incident had nothing to do with drugs.

William Hawes-Boliver was in his apartment Friday when his close friend, Corey Duane Lucas, was shot to death.

Hawes-Boliver said the ordeal began when two men stormed in to his home. He said one of the intruders shot him in the leg with a silver .25-calibre automatic handgun before turning the weapon on Lucas.

“I grabbed the man’s hand and Corey jumped up and started firing fists and hitting him directly in the face, and buddy is backing up and popping off shots and trying to cover himself,” he told CBC News on Wednesday.

Hawes-Boliver said the gunman ran out of bullets and fled with the other intruder.

Lucas, 36, collapsed behind the couch, told him that he loved him and died.

Hawes-Boliver was taken to hospital for treatment for his injuries. He said the bullet went through his leg above the knee and didn’t cause any serious damage.

Halifax Regional Police said the shooting was related to drugs and was not random.

But Hawes-Boliver said his apartment is not a crack house.

“It wasn’t a drug deal. It wasn’t nothing to do with that at all,” he said.

Three people face drug-related charges as a result of the investigation into the homicide.

A 21-year-old man and a 21-year-old woman face charges of drug possession and drug possession for the purpose of trafficking. A third person — a 20-year-old man — faces a charge of drug possession for the purpose of trafficking.

No one has been charged in connection with Lucas’s death.

The Los Angeles Memorial Coliseum field is the place where the USC Trojans play football, two Summer Olympics were staged, John F. Kennedy accepted the Democratic presidential nomination and Pope John Paul II celebrated Mass.It was also a location for “The Gangbang Girl #32,” a hard-core pornographic movie that featured 40 minutes of group sex on the gridiron turf, The Times has learned.

The filming at the taxpayer-owned stadium was done at night, with the Coliseum‘s towering lights blazing and its rows of distinctive red and white seats framing many of the scenes. The video also shows the stadium’s signature tunnel, which the Trojan team charges through at the start of games, as well as a sliver of the iconic peristyle, the arched entrance to the Coliseum.

“I was just in awe that we were at the Coliseum,” said a star of the film, who goes by the name Mr. Marcus. “I’ve made movies for about 20 years and I’ve done a lot of things, but that one really stands out.… I mean, who gets to have sex on the Coliseum floor?”

Marcus said the football-themed footage was shot on a single night, including some non-explicit scenes filmed in a Coliseum locker room that did not make the final cut. The Coliseum is not identified by name in the video, which was made in 2001 and released in 2002. About half of the 90-minute movie was filmed elsewhere.

How the crew got permission to use the national historic landmark — which was built as a memorial to World War I veterans — is unclear. Attempts to reach a representative of the production company, Anabolic Video, were unsuccessful.

The Coliseum is jointly run by the city, county and state, which owns the land. A spokesman for the California attorney general’s office said Tuesday that he did not know if it is illegal to film pornography on state property. Agencies such as the California Department of Parks and Recreation prohibit porn shoots on properties they control.

Gaining access to the locked stadium and firing up the field lights typically requires the approval of a high-ranking manager, according to people familiar with Coliseum operations, who requested anonymity because they are not allowed to speak publicly on the matter.

An attorney for the top Coliseum executive at the time the video was made said his client knew nothing about the production.

Former General Manager Patrick Lynch resigned in early 2011 and was indicted in March of this year in a sweeping corruption case.

“That’s disgusting,” Lynch’s attorney, Tony Capozzola, said of the porn shoot. “He would never allow that.”

Lynch has pleaded guilty to conflict of interest in a deal that required him to return $385,000 in alleged kickbacks he received from a Coliseum contractor. Ex-events manager Todd DeStefano has pleaded not guilty to charges that include bribery, embezzlement and conspiracy. Four other men also have been indicted in the case.

The indictments followed more than a year of Times reports on Coliseum financial irregularities and lax oversight by its nine-member governing commission, which includes four elected officials. Managers were engaged in side deals with concert promoters and others who did business at the Coliseum. Executives spent tens of thousands of dollars in public funds on massages, golf tournaments, luxury cars and other perks.

The commission is now at the brink of insolvency and voted May 14 to surrender control of the stadium and companion Sports Arena to USC.

Some current commissioners, including county Supervisors Zev Yaroslavsky and Mark Ridley-Thomas, were on the panel when the film was shot.

Yaroslavsky and Ridley-Thomas declined requests for an interview late Tuesday.

The plot of the movie, to the extent that it has one, revolves around a football team and a cheerleader.

The Anabolic logo is emblazoned on the jerseys the dozen or so performers wear — Marcus kept his as a souvenir — and on banners draped like bunting along the stands.

Marcus is a repeat winner of the annual Adult Video News Award, has been inducted into the X-Rated Critics Organization’s Adult Movie Hall of Fame and wrote the 2010 book “The Porn Star Guide to Great Sex” (St. Martin’s Press), which earns a three-star review on the Barnes & Noble website.

Before he joins in the film’s raunchier scenes, Marcus is depicted as a quarterback tossing warmup passes near the western end zone. He told The Times he remembered the movie was shot on a cool night starting about 7.”We were probably there until 11 p.m.,” he said.

The movie’s credits say it was produced on Sept. 16, 2001, a Sunday, during USC’s football season.The Trojans played at the Coliseum the weekend before and two weeks later.

Sitting in the warehouse-like office of his Van Nuys-based apparel company, Daddy Inc., Marcus recalled that a clearly marked Sheriff’s Department helicopter startled the cast when it appeared overhead in mid-shoot. The whop-whop of a chopper’s blades is heard in the movie.

Marcus said he remembered looking up and thinking: “There’s going to be, like, this intercom saying, ‘Hey, this is the … Sheriff’s Department, you guys must cease.’

“But none of that came. They just circled, like they were trying to see what was going on.”

Spokesmen for the Sheriff’s Department and Los Angeles Police Department, which has jurisdiction over the Coliseum, said they had no information about any 2001 pornography shoot there.

Marcus said the fact that the filming continued after the helicopter left convinced him that Anabolic must have had an official go-ahead to use the stadium.

“Honestly, when I started to shoot there, I thought, ‘How the hell did we pull this off? And does everyone know about it?'”

The performer had no apologies for people who might be angry that the movie may have tarnished the Coliseum.

“You can be mad all you want, but it was one of those once-in-a-lifetime types of opportunities,” he said.

Rodney Berget lives in a single cell on South Dakota’s death row, rarely leaving the tiny room where he awaits execution for bludgeoning a prison guard to death with a pipe during an attempted escape.

For Berget’s immediate family, his fate is somewhat familiar. He is the second member of the clan to be sentenced to death. His older brother was convicted in 1987 of killing a man for his car. Roger Berget spent 13 years on Oklahoma’s death row until his execution in 2000 at age 39.

The Bergets are not the first pair of siblings to be condemned. Record books reveal at least three cases of brothers who conspired to commit crimes and both got the death penalty. But these two stand out because their crimes were separated by more than 600 miles and 25 years.

“To have it in different states in different crimes is some sort of commentary on the family there,” said Richard Dieter, executive director of the Death Penalty Information Center, which tracks death penalty trends.

The siblings’ journey from the poverty of their South Dakota childhood to stormy, crime-ridden adult lives shows the far-reaching effects of a damaged upbringing – and the years of havoc wrought by two men who developed what the courts called a wanton disregard for human life.

Rodney Berget is scheduled to die later this year, potentially ending the odyssey that began when the two boys were born into a family that already had four kids.

A former prison principal described Rodney as a “throwaway kid” who never had a chance at a productive life. A lawyer for Roger recalled him as an “ugly duckling” with little family support.

The boys were born after the family moved from their failed farm in rural South Dakota to Aberdeen, a city about 20 miles away. Roger arrived in 1960. Rodney came along two years later.

His farming dreams dashed, patriarch Benford Berget went to work for the state highway department. Rosemary Berget took a night job as a bar manager at the local Holiday Inn.

The loss of the farm and the new city life seemed to strain the family and the couple’s marriage. When the family moved to town, “things kind of fell apart,” Bonnie Engelhart, the eldest Berget sibling, testified in 1987.

Benford Berget, away on business, was rarely around. When he was home, he drank and become physically abusive, lawyers for the brothers later said.

By the 1970s, the couple divorced, and Roger and Rodney started getting into trouble. Roger skipped school. Rodney started stealing. Soon, they were taking cars. Both went to prison for the first time as teens.

Roger Berget enjoyed a rare period of freedom in 1982 and met a woman while hitchhiking. The two started a relationship, and the woman gave birth to a child the next year. But Roger didn’t get to see his son often because he was soon behind bars again, this time in Oklahoma. And for a far more sinister crime.

Roger and a friend named Michael Smith had decided to steal a random car from outside an Oklahoma City grocery store. The two men spotted 33-year-old Rick Patterson leaving the store on an October night in 1985. After abducting him at gunpoint, they put Patterson in the trunk and concluded he would have to be killed to prevent him from identifying his captors.

They drove the car to a deserted spot outside the city and shot Patterson in the back of the head and neck, blowing away the lower half of his face.

A year later, Berget pleaded guilty to first-degree murder and was sentenced to death on March 12, 1987. An appeals court threw out a death sentence for Smith, who was later sentenced to life in prison without parole.

Less than three months after Roger was sentenced to death, Rodney Berget, then 25 and serving time for grand theft and escape, joined five other inmates in breaking out of the South Dakota State Penitentiary in Sioux Falls.

The men greased their bodies with lotion, slipped through a hole in an air vent and then cut through window bars in an auto body shop at the prison. Berget was a fugitive for more than a month.

Thirteen years passed before Roger Berget was executed by lethal injection on June 8, 2000. His younger brother was still in prison in South Dakota.

Then in 2002, the younger Berget was released. His sister and her husband threw Rodney his first-ever birthday party when he turned 40.

But the good days were numbered because a year later, he was sentenced to life in prison for attempted murder and kidnapping. He headed back to the South Dakota State Penitentiary – this time for good.

Then Rodney got to talking with a fellow inmate named Eric Robert about a goal they shared: to escape – or die trying.

The plan was months in the making. The inmates figured they would corner a solitary guard – any guard would do – and beat him with a pipe before covering his face with plastic wrap.

Once the guard was dead, Robert would put on the dead man’s uniform and push a box with Berget inside as the prison gates opened for a daily delivery. The two would slip through the walls unnoticed.

On the morning of April 12, 2011, the timing seemed perfect. Ronald “R.J.” Johnson was alone in a part of the prison where inmates work on upholstery, signs, custom furniture and other projects. Johnson wasn’t supposed to be working that day – it was his 63rd birthday. But he agreed to come in because of a scheduling change.

After attacking Johnson, Robert and Berget made it outside one gate. But they were stopped by another guard before they could complete their escape through the second gate. Both pleaded guilty.

In a statement to a judge, Rodney acknowledged he deserved to die.

“I knew what I was doing, and I continued to do it,” Berget said. “I destroyed a family. I took away a father, a husband, a grandpa.”

His execution, scheduled for September, is likely to be delayed to allow the State Supreme Court time to conduct a mandatory review.

Rodney Berget’s lawyer, Jeff Larson, has declined to comment on the case outside of court. Rodney did not respond to letters sent to the penitentiary.

The few members of the Berget family who survive are reluctant to talk about how seemingly normal boys turned into petty criminals and then into convicted killers of the rarest kind: brothers sentenced to death.

Dieter, of the Death Penalty Information Center, said some families of the condemned remain involved in appeals. But others see no reason to preserve connections.

“There’s no light at the end of it,” he said. “What happens at the end is execution.”

A Michigan teen found a finger tip in an Arby’s roast beef sandwich after he spit out a bite that he said was rubbery and hard to chew.

Ryan Hart, 14, said he ordered the sandwich last Friday at the drive-thru window of at a Jackson, Mich., Arby’s franchise.

“I was like, ‘That [has] to be a finger.’ I was about to puke. … It was just nasty,” Ryan told the Jackson Citizen Patriot.

An employee lost approximately one inch of her finger while operating a meat slicer. She left her station and did not immediately alert her co-workers, the Associated Press reported.

Employees continued to fill orders until they were made aware of the fleshy find.

“Upon learning of the incident, the franchisee’s restaurant team shut down food production and thoroughly cleaned and sanitized the restaurant. The franchisee fully cooperated with the local Health Department, and the restaurant was given the approval to remain open,” said John Gray, vice president of communications at Arby’s, in a statement.

Gray said Arby’s is investigating the event and has been in touch with its 66,000 employees to reinforce safety protocols.

Rebekah Brooks, the former head of Rupert Murdoch’s British newspaper arm, has been charged with perverting the course of justice over the News of the World phone hacking scandal.

Brooks was charged with concealing material from detectives, conspiring to remove boxes of archive records from Mr Murdoch’s London headquarters, and hiding documents, computers and other electronic equipment from police.

The maximum sentence for perverting the course of justice is life imprisonment.

Also charged were Brooks’ racehorse-trainer husband Charlie Brooks, her secretary, and other staff from News International, including her driver and security officials from the British newspaper arm of Mr Murdoch’s News Corp media empire.

The charges are the first since police re-launched an investigation into alleged illegal practices at News Corp’s British newspapers, following accusations the extent of wrongdoing had been covered up.

“I have concluded … there is sufficient evidence for there to be a realistic prospect of conviction,” Alison Levitt, principal legal adviser to the UK’s Crown Prosecution Service, said.

“All these matters relate to the ongoing police investigation into allegations of phone hacking and corruption of public officials in relation to the News of the World and The Sun newspapers.”

‘Weak and unjust’

Brooks and her husband released a statement confirming the charges.

“We deplore this weak and unjust decision. After the further unprecedented posturing of the CPS, we will respond later today after our return from the police station,” they said.

Brooks presided over the News of the World during the time when dozens voicemails, including those of murdered schoolgirl Millie Dowler, were hacked to provide stories for the tabloid.

Dubbed by some as Mr Murdoch’s “fifth daughter”, Brooks edited the News of the World from 2000 to 2003 and went on to become the first female editor of the Sun daily tabloid, Britain’s most widely read newspaper, for six years.

Long-running scandal

The news is also embarrassing for British prime minister David Cameron, who was close friends with Brooks and her husband.

Police re-launched an investigation in January last year into claims journalists at the News of the World routinely hacked into the phones of celebrities, politicians and victims of crime to generate front-page stories.

They are also investigating whether staff hacked into computers and made illegal payments to public officials, including the police, to get ahead in their reporting.

The action against Brooks comes as Mr Murdoch is increasingly under fire in Britain. He has been forced to close one newspaper, withdraw a major takeover bid for a TV station and been described by a parliamentary committee report as someone who is not fit to run a major international company.

The phone-hacking scandal first broke six years ago when the royal correspondent from the News of the World and a private detective were arrested and later jailed for hacking the phones of aides to the royal family.

News International maintained the practice was limited to one rogue reporter until that defence crumbled last year as detectives reopened their investigation amid claims their initial probe had been insufficient.

The explosive saga has shone a light on close ties between the media, British politicians and the police, with Brooks one of the central characters.

More than 160 staff are now working on one of the biggest investigations ever carried out by London police, and almost 50 people have been arrested.

Brooks’ arrest comes as she “voluntarily attended a London police station to assist with their ongoing investigation,” according to a statement released on her behalf, The Associated Press reported.

Authorities are questioning Brooks on suspicion of conspiring phone hacking and on suspicion of corruption.

Brooks spokesman David Wilson told the AP that Brooks’ meeting with the police was arranged but “not aware she was going to be arrested.”

“Obviously this complicates matter greatly,” Wilson told the AP. “Her legal team will have to have discussions with the committee to see whether it would still be appropriate for her to attend.”

Brooks who had refused to resign over the scandal, stepped down from her post as head of Murdoch’s British newspaper division, News International on Friday.

Critical Time for Murdoch

Brooks’ arrest comes at a critical time for Murdoch.

On Tuesday, British lawmakers are expected to grill the media baron when he testifies in front of Parliament.

Each passing day has brought new revelation in this scandal, and the shockwaves are quickly spreading across Murdoch’s sprawling empire, which includes television and newspaper properties spanning the globe, and a key stake in the U.S.In turn, Murdoch has had to do some unprecedented damage control.

“I was appalled to find out what had happened and I apologized and I have nothing further to say,” said Murdoch.

On Friday, Murdoch apologized to the family of Milly Dowler, a teen murdered in 2002.

Earlier this month, it was revealed the girl’s voicemail had been allegedly hacked and messages deleted by a reporter from one of Murdoch’s papers.

After the meeting, the Dowler family emerged with their lawyer, who described Murdoch’s tone as humble.

“Yes he did apologize. He apologized many times. I don’t think somebody could have held their head in their hands and said sorry so many times,” said Mark Lewis, the Dowler family’s lawyer.

On Saturday, there were more apologies.

“The News of the World was in the business of holding others to account. It failed when it came to itself. We are sorry,” according to an ad signed by Murdoch.

The ad appeared in every London newspaper.

Last Sunday, Murdoch shut down his profitable tabloid, “The News of the World,” mired in allegations of criminal activity.

The scandal has even crossed the Atlantic.

Les Hinton, the head of the company that operates the Wall Street Journal, resigned Friday. He was in charge in London when much of the alleged criminal activity took place.

There is also a connection to 9/11: allegations that Murdoch’s reporters tried to tap the phones of 9/11 victims in search of yet more sensational headlines.

“Many, many innocent men, women, and children their private tears bought and sold by News International for commercial gain,” said Gordon Brown, the former British Prime Minister.

No longer intimidated by Murdoch, British politicians are putting his empire under the microscope.

This week, the government established a judicial inquiry to look at criminal activity, media ethics, and media ownership.

The suspect in the slaying of a 7-year-old Georgia girl worked in the apartment complex where she lived, investigators said Wednesday.

Authorities arrested maintenance worker Ryan Brunn, 20, on Wednesday afternoon.

He is charged with killing 7-year-old Jorelys Rivera, who was last seen alive Friday near a playground at the apartment complex in Canton, Georgia. Investigators found her body in a trash bin there three days later.

Tips from the public led authorities to Brunn, said Vernon Keenan, the director of the Georgia Bureau of Investigation. Brunn had been working at the complex since November 7, authorities said.

“We believe that this horrendous crime was planned and calculated,” Keenan told reporters.

Jorelys was abducted “in the immediate vicinity” of the apartment complex’s playground, then taken to an empty apartment nearby, Keenan said.

“We have evidence that the murder occurred in that vacant apartment,” he said. “At some point, the child’s body was then disposed of in the Dumpster and compacted into trash.”

Authorities have said Jorelys died of blunt force trauma to the head, was stabbed and had been sexually assaulted.

Earlier, Keenan said investigators had found blood in an empty apartment.

Brunn was one of hundreds of people investigators interviewed in their search for suspects, Keenan said Wednesday. Authorities arrested him after they had obtained enough evidence to connect him to the killing, Keenan said, but the investigation will continue for months.

“We are investigating all of the past history of Ryan Brunn and piecing together what he’s been doing the last several years,” Keenan said. “We have sent agents to other states and also to other counties and we’re going to backtrack all of his activities and make a determination if he has been involved in other crimes. He has no known criminal history to us, but we will find out.”

Posts on a Facebook page that friends said belonged to Brunn recently talked of plans to move to Canton from Dahlonega, Georgia.

“New job,apt,life coming soon,” an October 6 post said. A post on November 5 said, “Today is moving day! Not ready to go but i got to.”

The brutal killing has shaken residents of the apartment complex, located about 40 miles north of Atlanta.

Witnesses told CNN that some neighbors screamed profanities and threw things as authorities arrested Brunn there Wednesday.

“It’s so close to home. To think she was just right there at the park and from there disappeared is the scariest thing,” Maria Rodriguez, a friend of the girl’s mother, told CNN before Brunn’s arrest.

Relatives of the little girl were devastated by her death.

“My world collapsed,” her father, Ricardo Galarza, told CNN affiliate WAPA in Puerto Rico. “I couldn’t believe that they robbed her from me.”

“They destroyed my soul,” her grandmother, Wanda Ivette Rivera, told the same network. “They took a piece of my heart.”

Another family member, Miriam Rivera, urged the state of Georgia to “throw the full weight of the law to the person who did this.”

Brunn is scheduled to be arraigned Thursday at 1:30 p.m. at the Cherokee County Courthouse in Canton, Keenan said.

Cheerleader Melissa Kellerman was barely into the middle part of her 15 minutes of fame when the Dallas Cowboys pulled the plug.

Kellerman, a 22-year-old student in her fourth year with the team, became a national sensation on Thanksgiving when she was accidentally tackled on the sideline by Cowboys tight end Jason Witten.

CNBC’s Darren Rovell reported that Kellerman was forced to delete her Twitter account after posting two messages on Friday morning about the incident. Her Tweets were good-natured and innocuous.

Cowboys cheerleader knocked over by Witten forced off Twitter

Those were pretty much the perfect tweets: Clever, self-deprecating and a bit funny. (We’ll even ignore the winking emoticons.) Why did she have to delete her Twitter account? Do the Cowboys believe cheerleaders are only to be seen, not heard?

Hardly. The team allows cameras to record cheerleader auditions for a reality show on CMT. It’s alright when the team controls the message but not when a cheerleader begins to get a following and has the stage to herself? This should have been a win-win for everyone involved. Witten looked chivalrous when he helped up Kellerman, she became endearing with her laughter and positive attitude. Both the franchise and the cheerleaders looked good after this. Now, only Kellerman does.

The 22-year old South Carolina native is studying to become a teacher.

Off-duty police officer shoots and kills man in Lakewood

A man who was shot and killedby an off-duty Santa Ana police officer Monday was unarmed, a Sheriff’s Department official said Thursday.

Jason Richard Bitz, 23, of Long Beach died Monday about 6:30 a.m. near Rynerson Park in Lakewood.

According to sheriff’s officials, the off-duty officer said he heard noises outside his home on Longworth Avenue, went outside and found two people trying to break into a vehicle parked across the street.

According to the account of the officer, whose name was not disclosed, when the officer confronted the men, they ran and he pursued them in his personal car. During the pursuit, the officer got out of his car and somehow Bitz got into the vehicle’s driver’s seat. The officer told sheriff’s officials that Bitz reached into his waistband and the officer fired his gun four times.

A family friend says Bitz was helping to change a tire, not trying to steal a vehicle. Bitz had been given $12 to help change the tire on a van and was doing so at about 6 a.m. when the off-duty officer came out of his home, said Rita Gomez, a drug and alcohol counselor and friend of the Bitz family. He was given the keys to the vehicle by the owner’s son, she said.

Bitz, she said, “was not a saint. He was on parole. That’s probably why he ran.”

But, she added, “this kid was not breaking into anything … he wasn’t stealing anything. And he shot him.”

Sheriff’s officials are looking into whether Bitz had permission to use the car and the coroner’s office has confirmed that he was unarmed when he was shot, said sheriff’s Lt. Eddie Hernandez. Authorities are still looking for the second suspect.

Wal-Mart baseball bat killing

Prosecutors charged a transient with murder Thursday for allegedly beating a 74-year-old man to death at a Lakewood Wal-Mart with an aluminum bat.

Richard Lawrence Kalfin, 47, is due to appear in a Bellflower courtroom Thursday for arraignment on the single murder count. In charging Kalfin, prosecutors also noted he had a 2005 conviction for arson.

Authorities have identified the victim as David Oakleaf of Lakewood, who died Tuesday after being repeatedly struck in the head in what witnesses described as a vicious, methodical attack.

Kalfin is believed to be a local transient who frequented the Wal-Mart shopping center. On Tuesday, he wandered into the store and through its aisles before ending up in the sporting goods section.

He removed a baseball bat from a display rack and began walking the nearby aisles, stopping only when he spotted Oakleaf. Witnesses told authorities Kalfin began swinging the bat swiftly and furiously at the customer’s head.Sheriff’s Lt. Eddie Hernandez said there was no evidence the two men had prior contact.

In a statement, Wal-Mart expressed its “deepest condolences” to the victim’s family.

“We are working closely with law enforcement to offer what information we have, such as surveillance video that might help with the investigation,” the company said.

Rajat Gupta, shown in 2008, has surrendered to the FBI

Rajat Gupta, a former Goldman Sachs board member accused by regulators of passing along confidential corporate information, has surrendered to the FBI.

Gupta is in custody, according to the Associated Press. Charges were not immediately disclosed, but the Securities and Exchange Commission in March accused Gupta of giving inside information about Goldman Sachs to his friend and business partner Raj Rajaratnam.

Gupta served on the boards of Procter & Gamble and the parent company for American Airlines but after being hit with the SEC accusations he stepped down from those positions.

Gupta followed with a lawsuit in March in which he complained about the SEC’s decision to go after him in front of an SEC administrative judge instead of in federal court, where other defendants connected to Rajaratnam had been charged. He said he’d been “unfairly and unconstitutionally” singled out.

Gupta in August agreed to drop the lawsuit as the SEC pledged to file any lawsuit over the same matter in federal court.

At the time of the charges, a lawyer for Gupta insisted that his client had done nothing wrong. Gupta’s lawsuit said there was no “plausible reason why Mr. Gupta would have deviated from a lifetime of probity and a career dedicated to safeguarding corporate confidences.”

But, as the AP reported, Gupta’s name featured prominently at the criminal trial earlier this year of Rajaratnam, who received an 11-year prison term, the longest sentence ever for an insider-trading case. But prosecutors had sought 19 to 24 years. The founder of Galleon Group hedge funds was given a lesser sentence in part because of advanced diabetes.

Boy Scouts of America leaders knew for years about incidents involving a Canadian pedophile who preyed on boys in the U.S. but failed to stop him as he moved back to Canada, where he continued his abuse.

The organization sometimes even helped him go undetected by authorities, an investigation by CBC-TV’s The Fifth Estate and the Los Angeles Times has found.

Scouts Canada learned of his inappropriate behaviour in the 1980s and kicked him out, but nearly a decade passed before police charged him with crimes.

Throughout the 1970s and ’80s, Richard Turley was involved with the Scouts across California and British Columbia, molesting at least eight scouts.

“It was easy,” the 58-year-old, who now lives in Alberta, says about how he used scouting to target his victims. “Kids were easily accessible.”

The CBC investigation, which can be seen in full Friday night on The Fifth Estate, catalogued nearly 80 cases in Canada, dating from the 1950s, where either active or former scout leaders committed crimes ranging from sexual assault to possession of child pornography. More than 300 children were abused by leaders while they were active in the movement.

Brazen kidnapping

In 1975, Turley did what he describes as the “craziest, stupid, bizarre thing” he would ever do. California newspaper headlines from 1975 dubbed it a “wild abduction tale.”

In a stolen single-engine Cessna, Turley kidnapped Ed Iris, an 11-year-old Nova Scotia boy living in La Puente, Calif., whom Turley had met while visiting a local scout troop.

A day earlier, he’d shown up at Iris’s house, telling Ed’s mother he was “one of Canada’s top scouts leaders” and asking if he could show the boy around town.

“He had badges all over the place,” says Iris, now 47 and living in Ontario. “He had his Canadian scouting book. It was impressive to a kid.”

Turley took the boy on a fun-filled day in the San Diego area. That night, the two slept in a car inside Turley’s double sleeping bag covered in scouts merit patches, said Iris. Turley later admitted to molesting the boy, though Iris says he slept through it.

In the morning, Turley stole a Cessna at a regional airport, vowing to take Ed back to Canada. With the plane low on fuel, though, Turley was soon forced to land.

Turley, then 21, was arrested and later pleaded guilty to child stealing. At trial, a judge committed him to a state hospital as a “mentally disordered sex offender.”

Police files obtained by The Fifth Estate and the Los Angeles Times show that Boy Scouts of America knew about the incident because they helped officers search for Iris and Turley.

Though the Boy Scouts of America have a decades-old practice of creating “confidential files” recording individuals barred from the group for sex abuse allegations — a system aimed at preventing pedophiles from hopping from troop to troop — it appears no file was created on Turley at that time.

Put on list

In November 1976, 18 months after Turley’s arrival at the Patton State Hospital, he was deemed well enough to be released. The judge ordered him to return to Canada and report for probation if he re-entered the U.S.

Within a year, Turley returned to Southern California to work at a Boy Scout camp near San Diego, an hour’s drive from the hospital. He spent the next three summers working for the camp.

On the last day of camp in July 1979, Turley arranged to stay an extra night with three boys from the Orange County troop. All three were molested that night, according to a confidential file later created by the Boy Scouts of America.

The next morning, one boy told his father, a scoutmaster, about the abuse.

The camp director, John LaBare, confronted Turley and “he readily admitted what he had done, expressed concern for his actions, immediately packed and returned to Canada,” according to a letter in Turley’s U.S. “perversion file.” The camp, meanwhile, was told Turley had returned home due to family problems.

Behind the scenes, camp officials requested that the Boy Scouts of America’s Texas-based national office create a “confidential file,” informally known as a “perversion file,” on Turley.

“The parents of the three boys agreed not to press charges if he would leave, but are quite prepared to do so if they hear of his involvement with scouting,” Scouts executive Buford Hill wrote.

Hill told the Los Angeles Times that he was following recommendations of the Boy Scouts of America at the time.

“I don’t remember what we decided, other than we didn’t want this person on our staff,” Hill said. “Hopefully, he went back to Canada and that was their problem.”

In a written statement to the Los Angeles Times, Boy Scouts of America stated that within 25 hours of learning of Turley’s conduct, they expelled him.

“In the 30 years since then, the BSA has continued to enhance its youth protection efforts as society has increased its understanding of the dangers children face,” wrote spokesman Deron Smith.

When Turley was shown the 1979 confidential U.S. file created by the Scouts on him, however, he shook his head in amazement that officials had not contacted police.

“That probably would have put a stop to me years and years ago,” said Turley in an interview at an Alberta motel where he works as a manager and handyman.

“And yet I went back to the Scouts again and again as a leader and offended against the boys until they came forward.”

Others were shocked Turley even made it into the Scouts after his kidnapping conviction and commitment as a sex offender.

“He should have never been there in the first place,” the scoutmaster whose son was allegedly molested by Turley told the Los Angeles Times.

Back in Canada

Though The Fifth Estate found documents showing that Scouts Canada and its American counterpart have traded information about pedophiles banned from their organizations, it appears the two did not share information about Turley.

By August of 1979, Turley had returned to the Victoria area, and within a few years, he’d begun leading a local scouts troop.

Court records show that Turley took scouts on camping trips once or twice a month, often luring boys to his tent by offering warmth or comfort. He used skinny-dipping as a pretense to molest boys and plied them with alcohol.

In his Victoria home, stocked with ice cream, candy, alcohol and porn, he entertained an endless number of boys, including scouts.

“He had an Atari and worked for a candy company and his cupboard was full of candy,” said Jason Davies, one of his victims. “This is where we wanted to go after Scouts.”

While a Scouts Canada leader, Turley also organized trips to the U.S. with his troop and recalls filing paperwork with the Boy Scouts of America to have the visits approved.

Jean Buydens, a scouting supervisor, recalls hearing whispers about parties where Turley offered boys beer and camp outings where he shared tents with boys.

“I was very suspicious of that,” says Buydens, adding she passed on what she heard.

The Fifth Estate spoke to parents, victims and Scouts executives familiar with Turley and found no evidence executives called in the police to investigate. Turley says he was never contacted by police at that time. Scouts Canada said it won’t comment on specific cases.

An assistant scoutmaster had also complained about Turley sharing his tent with boys, but the meddling assistant was moved to another troop, CBC News has learned.

As rumours persisted in the mid-1980s, Scout House, the regional headquarters, asked Turley to resign. Scouts Canada added him to a “confidential list,” sources say. The exact date is unknown.

“It should have been handled differently,” says Buydens. “I absolutely wish now that I had thought about going to police rather than Scout House, but I thought talking to Scout House would be enough.”

Canadian conviction

In 1988, Turley sexually assaulted a child at a swimming pool. He was sentenced to 30 days in jail and banned from associating with youth groups such as Scouts, YMCA and the Little League.

It was not until 1995 that police began their first large-scale investigation into Turley – 16 years after the Boy Scouts of America created a “perversion file” and nearly a decade after its Canadian counterpart put him on their “confidential list.”

In the end, it was not the Scouts organization that informed Saanich, B.C., police, but rather a suspicious girlfriend.

Turley was convicted in 1996 of sexually abusing four boys, three of whom were scouts, but later admitted to having at least a dozen victims.

First victim

In 1971 at age 18, Turley began more than a year of molestation with his first known victim, nine-year-old Joey Day.

Turley had moved from Toronto to Victoria as a member of the Canadian military, and had befriended Day’s mother.

He offered to take Joey to cub scout meetings, but instead Turley often took the boy to his apartment.

“He fed me alcohol and I believe he was drugging me,” said Day. “I would wake up and I’d be naked in his bed.”

During an undercover sting, Turley later admitted to an officer that being involved with the Scouts organization was a “good way to recruit young boys.”

Turley served five years in prison and seven years of long-term supervised parole, which he completed in 2009.

When The Fifth Estate and the Los Angeles Times tracked him down in Alberta earlier this year, Turley said his sexual impulses are now under control thanks to an intense sex-offender program he underwent.

He’s no longer that “monster” moving from “troop to troop picking out people who I thought would be easy to offend against,” he said. “Rick Turley today is a caring loving person who just wants to stay below the radar.”

But he added that he believes the very nature of Scouts made it an easy place to find targets.

“If I look back at my own self, the availability, the trust that was involved with the parents at the time,” said Turley. “I was … the nice guy, who wanted to do everything.”

Screening process

Much in Scouts has changed since the 1970s and 1980s when Turley used the movement to find his victims.

Since 1997, Scouts Canada has required police record checks, reference checks and a special screening interview for all adult volunteers and staff.

The organization’s policies dictates that individuals accused of any sexual abuse are immediately suspended and then investigated, with information passed along to police and child protection authorities.

Scouts Canada also has a stringent “two-deep rule” requiring that two fully screened, registered leaders be present with youth at all times.

Turley recalls always having adult leaders present on his Scouts outings. “It didn’t stop anything,” he says.

Seattle-based lawyer Tim Kosnoff, who has viewed the U.S. “perversion files,” says historically the U.S. Boy Scouts “routinely” chose not to notify police when aware of child molesters, instead noting them in their own secret files.

Despite all the changes made to the Scouts organization, Turley maintains that “Scouting is still a flawed movement.”

“If I was a parent, I would never put my kids in Scouts.”

Texas execution

One of three people convicted in the 1998 dragging death of a black man in Jasper, Texas, was  executed Wednesday night for his part in the slaying, the Associated Press has reported.

[Updated 4:41 p.m.: Earlier reports said the execution was scheduled.]

The racially motivated killing of James Byrd Jr. stunned the nation, sparking protests, inspiring the movie “Jasper, Texas,” and leading to state and federal hate-crime legislation.

One of Byrd’s sisters planned to be in Huntsville, Texas, for the execution; another planned to hold a prayer vigil in Jasper, according to the Beaumont Enterprise.

The night he was killed, Byrd had accepted a ride home from a white man he knew, Shawn Berry, then 24, and two of Berry’s friends — John King, then 23, and Lawrence Brewer, then 31. King and Brewer were later identified as white supremacists.

Brewer, now 44, was the one scheduled for execution.

Instead of taking Byrd home, the men drove him down a remote county road, beat him unconscious, urinated on his body, chained him by his ankles to the truck and dragged him for three miles. When the truck made a hard turn at a bend in the road, Byrd’s head struck a cement culvert and he was decapitated. The three men then dumped his remains in front of an African American cemetery and went to a barbecue.

The three were later tried and convicted of Byrd’s murder. Brewer and King received the death penalty, while Berry was sentenced to life in prison. King is appealing his sentence, but Brewer had no appeals pending late Wednesday, a spokeswoman for the Texas attorney general’s office told The Times.

In a July interview with Beaumont’s KFDM-TV, the first Brewer has granted since he was convicted in 1999, he admitted driving the truck but said he was not responsible for killing Byrd.

“I know in my heart I participated in assaulting him, but I had nothing to do with the killing as far as dragging him or driving the truck or anything,” Brewer said.

Brewer told KFDM that he was willing to die.

“I’m for the death penalty. I feel that if you take a life you should pay for it by taking your own life if you’re actually guilty of taking a life,” Brewer said.

He also said that for him, the death penalty will be a relief.

“This is a good out for me,” he said. “I don’t want a life sentence, period, with or without parole. I wouldn’t be happy with that.”

Fullerton police make court appearance

Two Fullerton police officers have been criminally charged in the violent confrontation that left a homeless man dead, Orange County Dist. Atty. Tony Rackauckas announced Wednesday.

Rackauckas said the department reviewed 151 witness statements, videos of the beating, medical reports and police statements.

The district attorney’s office had been awaiting the coroner’s determination on the cause of death before deciding whether to file charges.

Officers approached Kelly Thomas on July 5 at the bus depot in downtown Fullerton while responding to a report of someone trying to break into cars. According to witness accounts, Thomas ran when officers attempted to search his bag. Exactly what happened next is unclear, but witnesses said they saw multiple officers hitting Kelly and shooting him with a Taser while he was on the ground.

Officials from the district attorney’s office have said they were awaiting toxicology and other test results from the coroner before making a decision on the case. That report was handed over to the district attorney’s office Tuesday, but the findings were not made public.

Thomas, a 37-year-old homeless man with schizophrenia, was a regular presence in downtown Fullerton. He died five days after the confrontation, after being removed from life support.

Earlier this month, an attorney representing the Thomas family released hospital records that showed Thomas had tested negative for drugs and alcohol and that the immediate cause of death was “brain death” due to “head trauma” from the incident.

The hospital records released showed that he suffered brain injuries, a shattered nose, a smashed cheekbone, broken ribs and severe internal bleeding. Thomas also had been shocked with a stun gun “multiple” times, including in the left chest near the heart, the records showed.

Thomas’ father, Ron, has been pushing the district attorney’s office to file charges against the officers, and the case has sparked a furious reaction, including weekly protests outside the police station and a recall campaign against three City Council members.

Two Fullerton police officers charged in the death of a homeless man made their first court appearance Wednesday afternoon, and one was set to be released on bail.

Orange County Dist. Atty. Tony Rackauckas took the unusual step of appearing in person for the arraignment of Officers Manuel Ramos and Jay Cicinelli, who are charged in the death of Kelly Thomas, 37. Thomas’ father, Ron, also spoke out at Rackauckas’ request during the arraignment.

Cicinelli pleaded not guilty to charges of involuntary manslaughter and the use of excessive force. He posted $25,000 bail and was slated to be released Wednesday. His next hearing is set Nov. 4.

Ramos’ arraignment on charges of second-degree murder and involuntary manslaughter was postponed until Monday, as his attorney is out of town. He remains in custody with bail set at $1 million.

The issue of bail will be revisited Monday. When asked if he opposed a bail reduction, Rackauckas called up Ron Thomas, who asked the judge not to reduce the bail amount because of the “horrific way” his son was killed.

Cicinelli appeared in court in a two-piece suit and appeared calm, while Ramos wore a striped polo shirt. He was handcuffed and appeared nervous.The judge ordered both officers to surrender their firearms when they are released from custody.The court appearance came three hours after Rackauckas announced the charges at a dramatic news conference during which he gave a detailed and chilling narrative of the beating that resulted in Thomas’ death.

Rackauckas said Thomas begged for his life as Fullerton police officers beat him and Tasered him July 5.

Ramos put latex gloves on his hands and brandished a fist at Thomas. Then, Rackauckas said, the officer, in a “menacing” manner, threatened Thomas: “These fists are ready to F you up.”

Scared and bleeding, Thomas begged for his life. No one listened, Rackauckas said.

“Kelly Thomas appeared to be acting in self-defense, in pain, in a state of panic. His numerous pleas of ‘I’m sorry,’ ‘I can’t breathe,’ ‘help,’ ‘Dad,’ all to no avail,” Rackauckas said. “Screams, loud screams, didn’t help.”

“Kelly Thomas was not responding when blows to his face occurred,” Rackauckas said, adding, “That is not protecting and serving.”

Ramos’ attorney, John Barnett, said his client was simply doing his job under difficult conditions when he tried to restrain Thomas.

“Officer Ramos was confronted that evening with a noncompliant suspect with a history of violence,” Barnett said. “Officer Ramos had the responsibility and the duty to detain, restrain and arrest him.”

Barnett said the district attorney had taken Ramos’ threats out of context.

“To characterize that as a justification for Kelly Thomas to leave betrays a complete lack of understanding as to what happens in the street,” Barnett said. “This was an attempt to use less force not more…. That does not a murderer make.”

A large team of investigators from the Orange County district attorney’s office spent 11 weeks combing through a mountain of evidence before a decision was made to file the criminal charges.

Key pieces of evidence included a 30-minute surveillance video taken from a pole camera at the downtown Fullerton bus station and digital audio recording devices carried by Fullerton officers.

Dana Page, Thomas’ stepmother, said it was “numbing” to hear Rackauckas recite the details.

She said she was extremely happy with the charges, but said the four other officers involved in the case should also be charged.

“Nothing will bring Kelly back, but we miss him every day,” she said. “We’ll take the two for now.”
