Mitrice Richardson disappeared in September 2009. Her remains were found about eight miles from the police station.

July 13, 2011 9:03 p.m. EDT

Los Angeles County authorities exhumed the
remains Wednesday of a woman whose mysterious disappearance and death in Malibu
Canyon have been the subject of a family crusade for justice, the coroner’s
office said.

The grave of Mitrice Richardson, who disappeared at age 24 in September 2009,
was exhumed so that her family’s private pathologist could investigate the
remains, said Ed Winter, assistant chief of operations and investigations of the
Los Angeles County Department of Coroner.

The cause of Richardson’s death remains undetermined, Winter said
Wednesday.

“We just don’t know,” Winter said about the cause of death.

Her remains were scheduled to be reburied in Inglewood (California) Cemetery
Park on Wednesday afternoon, he said.

The exhumation also took place so that authorities could return to her grave
some of her bones that were found after her body was discovered in Malibu Canyon
in August 2010, Winter said.

The bones, found on two different occasions following the discovery of her
body, underwent DNA analysis to confirm that they were Richardson’s, Winter
said.

Last January, after an emotional public appeal, Richardson’s mother persuaded
Los Angeles County authorities to exhume the remains and involve the FBI crime
lab in examining them and Richardson’s clothing.

The exhumation and the FBI participation marked a victory in Latice Sutton’s
long struggle to get authorities to investigate her daughter’s mysterious
disappearance as a murder.

Richardson disappeared after she left the Los Angeles County Sheriff’s Lost
Hills/Malibu station, where she had been detained for allegedly being unable to
pay $89.51 for food and drink at a Malibu restaurant.

At one point in the controversy over her death, Richardson’s father, Michael
Richard, blamed the Sheriff’s Office for releasing his daughter without any
assistance even though she had mental health issues and was in a manic state. He
accused local authorities of providing special treatment and transportation to
celebrities running afoul of the law such as Mel Gibson and Charlie Sheen, but
said his daughter didn’t receive similar courtesy.

Richardson’s skeletal and mummified remains were found about eight miles from
the sheriff’s station, in the Monte Nido section of the Santa Monica Mountains,
which bisect Los Angeles, Latice Sutton said.

Los Angeles County Sheriff Lee Baca has said Richardson’s case showed “no
indication of a homicide,” but he and the coroner’s office agreed to the
exhumation as a matter of cooperation with her family.

“We’ve been working with family ever since her remains were
recovered,” Winter said Wednesday.

A father says his 15-year-old daughter, who was not sexually active, died of pulmonary embolisms from taking Yasmin and Ocella, contraceptives that a doctor prescribed for acne. The father claims Bayer “aggressively” promoted the contraceptives for off-label uses, and “ignored” the “serious risks associated with the drug.”
Scott Prewitt claims his daughter’s pediatrician dismissed her embolisms, which began in one leg, as a skin infection.
Prewitt sued drug manufacturers and distributors Bayer, Barr Laboratories, Teva Pharmaceuticals and Intendis for wrongful death and product liability, and the Asheville Children’s Medical Center, Dr. William Bryan III and Kelly Klaaren for negligence, in Buncombe County Court.
Dozens of lawsuits have been filed in recent years claiming Yasmin’s side effects increased the risk of heart attack, stroke, pulmonary embolism and other serious injuries. Ocella is the generic form of the drug.
Prewitt says his daughter, Brittany Nicole, started taking Yasmin when she was 13. He says a dermatologist prescribed the drug for acne in 2007. Brittany was 13 at the time.
The dermatologist, Dr. Hilary Krueger, of Hendersonville, N.C., is not named as a defendant. Brittany’s “regular physician” had been “Dr. Bryan at ACMC” since September 2006, according to the complaint.
Brittany took Yasmin until August 2008, when Dr. Krueger changed the prescription to Ocella, “a generic form of Yasmin,” according to the complaint. Brittany “continued taking the medication as prescribed by Dr. Krueger until her death on June 13, 2009,” according to the complaint.
The USDA has approved Yasmin for contraception. Doctors may legally prescribe drugs for off-label uses, but drug companies are not allowed to promote them for that.
But Prewitt says Bayer “aggressively marketed” Yaz – a variation of Yasmin, with a smaller dose of estrogen – to dermatologists: “The Bayer defendants aggressively marketed Yaz to the dermatology community, and relied in part upon data assessing the effectiveness of Yasmin upon acne, thus persuading the dermatology community that both Yasmin and Yaz were safe and effective in the treatment of acne,” the complaint states. It continues: “Yasmin never received approval for treatment of acne.
“Yaz only received approval for ‘the treatment of moderate acne vulgaris in women at least 14 years of age, who have no known contraindications to oral contraceptive therapy and have achieved menarche. Yaz should be used for the treatment of acne only if the patient desires an oral contraceptive for birth control.'”
Prewitt claims that he and his wife and their daughter “read magazines, newspapers, and other media, and watched television, all of which communicated Yasmin and the sister medication Yaz advertisements which minimized the risks of Yasmin and Yaz, and overstated the benefits and shaped their favorable perception of Yasmin, Yaz and Ocella.”
He adds: “Use of the drug Yasmin and its generic counterpart Ocella are associated with increased risks of several serious health conditions, including thromboembolism. The risk of morbidity and mortality increases significantly in the presence of other underlying risk factors, including obesity.” Brittany weighed 199 lbs.
Prewitt says Brittany’s pediatricians were aware of these increased risks to his daughter. He adds that Klaaren, Bryan and ACMC “knew that Brittany Prewitt was taking Yasmin, and subsequently Ocella, on a regular basis as prescribed for her acne condition and made regular notes of same in Brittany Prewitt’s medical records maintained at ACMC.” And he says they misdiagnosed the signs of the embolism that killed her.
Prewitt says Brittany saw Dr. Bryan on May 20, 2009 for pain in her left leg behind the knee, which was red and swollen. The doctor noticed a red, warm area on her inner thigh, but diagnosed it as “superficial cellulitis” and prescribed an antibiotic, the complaint states. It adds: “Her current medication was noted as ‘Yaz’ and her weight was recorded as 199.6 pounds.”
On June 4, 2009, Kelly Klaaren, a physician assistant supervised by Bryan, examined Brittany’s rash, which had extended to her lower abdomen, between her breasts, on her wrists and under her neck, and diagnosed the condition as “dermatitis,” according to the complaint.
Brittany collapsed on June 13, had seizures and was taken to (nonparty) Memorial Mission Hospital, where she was pronounced dead. An autopsy determined that Brittany died as a result of blood clots in both lungs, or pulmonary emboli.
Prewitt says that “the primary difference between Yasmin and Ocella and other oral contraceptives on the market is that [one of their ingredients, the hormone] drospirenone has never been marketed in the United States and is unlike other progestins available in the United States.
“In April 2002, the British Medical Journal reported that “the Dutch College of General Practitioners recommended that older second generation birth control pills be prescribed in lieu of Yasmin as a result of 40 cases of venous thrombosis among women taking Yasmin, two of which were fatal.”
The British Medical Journal carried another report in February 2003 citing “additional reports of thromboembolism where Yasmin was suspected as the cause,” the complaint states.
But Prewitt claims that “the Bayer defendants, Barr, and Teva ignored the correlation between the use of Yasmin, Ocella, and Yaz and the increased risk of developing thromboses, despite the wealth of scientific and medical evidence available.”
He claims that the “Bayer defendants have been warned multiple times by the FDA for misleading the public through use of television advertisements which overstate the efficiency of Yasmin and Yaz and minimize serious risks associated with the drug.”
Prewitt seeks compensatory and punitive damages for wrongful death, negligence, failure to warn, product liability, breach of warranty and unfair trade practices.
His lead counsel is George Ward Hendon with Adams Hendon Carson Crow & Saenger of Asheville.

Former Yale University lab technician Raymond Clark III has been sentenced to 44  years in prison for the grisly killing of a graduate student in 2009, according  to court officials.

Judge Roland Fasano sentenced Clark, 26, on  Friday in New Haven, Connecticut, Superior Court as part of a plea agreement, said Rhonda  Stearley-Hebert, a spokeswoman for the Connecticut Judicial Branch. Fasano  pleaded guilty in March to the murder and attempted sexual assault of  pharmacology student Annie Le.

Le, 24, was strangled to death. She had a broken jaw and collarbone, the  prosecution said. Clark’s DNA was “all over”  the crime scene, including in her underwear, the state  charged.

Le was pursuing a doctorate degree at Yale when she went missing on September 8,  2009. Her body was discovered inside a wall of a campus lab building after an  extensive search by the FBI and police.

Clark admitted the facts as the prosecution  presented them but pleaded guilty under a legal precedent that allows him to do  so while still officially protesting his innocence

He pleaded guilty under the so-called Alford doctrine, which allows a defendant to assert  that he is innocent but plead guilty when he “intelligently concludes that his  interests require a guilty plea and the record strongly evidences  guilt.”

Clark had pleaded not guilty in January  2010.

Le had planned to marry Columbia graduate student Jonathan Widawsky on  the day her body was found.

Clark was not a Yale student but had worked as  a lab technician at the university since 2004, after graduating from high  school. He lived with his girlfriend, who also was a Yale lab technician,  according to police.

A Yale faculty member described Clark’s job as  maintaining colonies for animals used in research.

20/20 Burning Bed

02/11/2011 05:42:04 AM PST

The family of murder victim Jennifer Schipsi wept with relief Thursday, moments after a Santa Clara County jury convicted her boyfriend Bulos “Paul” Zumot of strangling her and setting fire to their Palo Alto home.

“I heard that word ‘guilty’ and I thanked Jesus, and Jenny gave me a hug,” Schipsi’s father Jim Schipsi said as he fought back tears outside the Hall of Justice in San Jose.

Jurors found Zumot guilty of first-degree murder and arson. The 37-year-old former owner of Da Hookah Spot in downtown Palo Alto had taken the stand in his own defense during the 4½-week trial.

Schipsi, a 29-year-old real estate agent, was killed Oct. 15, 2009, and her burnt body was found in the Addison Avenue cottage she shared with Zumot.

Inside the crowded courtroom, family and friends of Schipsi cried and prayed aloud before the verdict was read. Once Zumot was declared guilty, one woman exclaimed “Thank God,” then repeated it.

“It was just a release of the tension and all the other emotions I had ever since day one, that at least justice, at least the person who is responsible, is going to pay,” Jim Schipsi said outside the courtroom.

Zumot’s family members also cried as the convicted murderer, who looked numb, was escorted away. They declined to comment after the verdict.

Outside the courthouse, Zumot’s high-profile defense attorney Mark Geragos said the jury was diligent but both he and his defendant were “bewildered” by the verdict.

After leaving the courtroom, jurors could not be found to comment.

Deputy District Attorney Chuck Gillingham argued during the trial that Schipsi’s murder culminated a turbulent two-year relationship punctuated by domestic violence. Zumot strangled his on-again, off-again girlfriend the day after they had a nasty argument during his birthday dinner celebration, according to the prosecution’s case.

Gillingham relied heavily on cell phone records to make his case, presenting heated text messages Schipsi sent to Zumot in the early morning hours of the day she died. He also used them to show Zumot and Schipsi’s phones appeared to be together as he drove down to a domestic violence class in San Jose and back up to Palo Alto about 45 minutes before the fire, and to show Zumot had tampered with her phone.

Witnesses who Gillingham put on the stand had testified Schipsi told them Zumot hit and threatened to kill her. One witness testified Schipsi said Zumot not only threatened to kill her, but also burn down her home.

Zumot testified he had never made any such threats and Schipsi overreacted and lied. He portrayed himself as “easygoing” and contended he didn’t have Schipsi’s iPhone on the day of her death or delete messages from it and his iPhone to cover his tracks.

When Zumot first took the stand, he claimed he loved Schipsi and still does. At one point he broke into tears for at least two minutes after being shown a message from Schipsi saying she loved him and wanted to spend her whole life with him.

In attempting to prove Zumot was innocent, Geragos pointed out during the trial that traces of gasoline detected on Zumot’s clothing by an accelerant-sniffing dog were not confirmed by a crime lab. He said the cell phone evidence used to incriminate his client was worthless and that a tape showing Zumot and Schipsi having sex on the day she was found dead suggests the couple had reconciled following the previous evening’s fight.

Superior Court Judge David A. Cena, who presided over the trial, set an April 21 sentencing date for Zumot, who faces a prison term of 33 years to life.

Geragos said he intends to seek a new trial and if turned down will file an appeal.

After rejoicing with relatives for a few minutes outside the courtroom, Schipsi’s grandfather Philip Schipsi said the verdict will bring him some closure.

“I’m finally realizing what I’ve been putting off for a long time, and that is Jennifer is gone forever,” he said.

Philip Schipsi’s wife Peggy said of the verdict, “I knew it. I knew it. I can’t explain how happy I am that Jenny can rest peacefully now.”

But, she added, “our lives will never be the same. It’s something when you get up every morning and it’s the first thing you think about.”

Gillingham, who wasn’t in court Thursday, said in a telephone interview: “We knew we had the right person and we knew we had the evidence to convict him. So I’m not surprised by the verdict at all.”

James Arthur Ray Arrested in Sweat Lodge Deaths

Self-help guru James Arthur Ray was arrested Wednesday in Arizona on manslaughter charges in the deaths of three people during a sweat lodge ceremony.

Ray was being held on $5 million bond at a sheriff’s station in Prescott awaiting transfer to the Camp Verde Detention Center, according to a statement by Yavapai County Sheriff Steve Waugh.

“Sheriff Waugh would like to thank the victim’s families for their patience while the Sheriff’s Office completed a thorough and comprehensive investigation,” the statement says. “With the arrest of James Ray, Sheriff Waugh hopes the families of the three victims will now have some measure of closure to this tragedy.”

Ray was arrested without incident at his attorney’s office in Prescott.

Cleansing Ceremony

The “cleansing” ceremony led by Ray at the Angel Valley Retreat Center near Sedona ended in the deaths of participants Kirby Brown, 38, James Shore, 40, and Liz Neuman, 49, and injuries to 18 others.

During the “Spiritual Warrior” five-day retreat, for which Ray charged approximately $9,000, participants were pushed to their spiritual and physical limits by fasting for 36 hours and cramming into a 415-square foot, sauna-like hut – essentially a wood frame covered in tarps and blankets. People were passing out and vomiting, but still urged to stay inside the sweat lodge.

After the deaths, Ray, the author of Harmonic Wealth: The Secret of Attracting the Life You Want, expressed sorrow but continued with his work, saying, “I, too, want to know what happened that caused this horrible tragedy.”

Ray’s attorney, Luis Li, issued a statement Wednesday saying the charges shouldn’t have been filed.

“The charges are unjust and we will prove it in court,” the statement says. “This was a terrible accident – but it was an accident, not a criminal act. James Ray cooperated at every step of the way, providing information and witnesses to the authorities showing that no one could have foreseen this accident. We will now present this evidence in a court of law, and we are confident that Mr. Ray will be exonerated.”

James Arthur Ray Didn't Help the Dying, Witnesses Say

After attending many courses led by self-help guru James Arthur Ray, Dennis Mehraver says he developed great trust in his mentor and came to believe that Ray “knew how far I could go better than myself.”

But as Mehraver and others struggled to remain conscious in the stifling heat of a sweat lodge during a retreat with Ray in 2009, their leader did nothing to stop the ceremony or to check on their well-being, Mehraver says.

Mehraver’s last memory was an urge to flee, and when he finally came to after passing out, a smiling Ray was sitting in a chair and saying, “Go get a shower and get ready for dinner,” Mehraver has testified in Camp Verde, Ariz., where Ray, 53, is on trial on reckless manslaughter charges. If convicted, he faces 10 years in prison for each manslaughter count.

The trail, which began March 1 and is expected to last for several more weeks, comes nearly 18 months after three people died and 15 others got sick in a sweat lodge during a $10,000 “Spiritual Warrior” retreat. So far, the trial has featured dramatic testimony by Ray’s former followers, who are now angry and disillusioned about the horrific scene during the ceremonies.

Victims ‘Found Death’

Yavapai County Attorney Sheila Polk contended in opening statements that Ray made the sweat lodge too hot, discouraged people from leaving and did too little to help as participants lost consciousness.

“Instead of growth and enlightenment [the victims] found death in Mr. Ray’s sweat lodge,” said Polk.

Longtime Ray friend Lou Caci testified that the stricken followers reminded him of how his brother and father died from cancer.

Caci testified that he’d attended a Ray sweat-lodge ceremony before, but this one was “a lot hotter” with about twice as many people, and as he stumbled out he burned his hands on the hot rocks.

Outside the lodge, the scene was “like a battleground” with people vomiting, foaming at the mouth and their eyes nearly popping out, said Caci.

During his testimony, Caci and Ray looked at each other and wept. They had become close friends, with Ray even attending Caci’s wedding, since meeting at a Tony Robbins seminar in 1992.

Defense: Deaths Accidental

After the seminar, Caci said, Ray began publishing self-help books and giving seminars of his own. Ray has appeared on The Oprah Winfrey Show and Larry King Live and in the movie The Secret.

Defense lawyers say the deaths were accidental, and suggest that exposure to an unknown toxin, perhaps a pesticide, could have caused the fatalities.

“If the state’s case is that he’s so persuasive that he can make people do something against their will, well then, he’s not very good at it, because a lot of people left,” defense attorney Lui Li said in opening statements. “Nobody was coerced. People chose for themselves.”

A New York television executive has been convicted of stabbing his wife to death and beheading her.

A jury found Pakistan-born Muzzammil Hassan guilty of second-degree murder in the 2009 death of Aasiya Hassan six days after she filed for divorce.

Hassan never denied killing her but said she had abused him and that he had acted in self-defence. He served as his own lawyer during the three-week trial.

Hassan, who founded a Muslim-oriented TV network, could face life in prison.

Prosecutors argued Hassan abused his wife and planned the attack in a hallway at Bridges TV, a satellite channel he set up in 2004 in an effort to counter negative portrayals of Muslims following the 9/11 terror attacks.

He was arrested in 2009 after he walked into a police station in the city of Buffalo, in upstate New York, and told officers his wife was dead.

Mrs Hassan, 37, had filed for divorce after enduring domestic violence, her lawyer told the Buffalo News newspaper in 2009.

The couple had been married for eight years and had two children.
