West Virginia’s pending case with the NCAA could be more damaging to Michigan coach Rich Rodriguez than the Mountaineers. The Notice of Allegation in the case said the violations started in 2005 when Rodriguez was coach of West Virginia.

The accusations are similar to what Rodriguez and Michigan are facing when they go before the NCAA’s Committee on Infractions later this month. The West Virginia report states Rodriguez “failed to promote an atmosphere of compliance within the football program” along with not monitoring the activities of graduate assistant coaches and other staff members.

Should both schools be penalized for violations under his watch, Rodriguez could face a show-case penalty, which would effectively end his tenure with the Wolverines and keep him out of college coaching for at least the term of the penalty.

“For the Michigan hearing, the West Virginia Notice of Allegations will not have a direct impact on the actual proceedings of the hearing because they are separate and distinct cases,” Michael Buckner, a Florida attorney who frequently represents universities in NCAA cases, told “However, it’s going to be the silent entity in the hearing room. Everyone’s going to know about it but no one’s going to talk about it.”
