The case detective has indicated that the suspect was arrested on 2 counts of Physical Abuse of a Child on July 1st, and that the original tentative charges were amended on July 5th, when the 1st Degree Reckless Homicide tentative charge was made.

UPDATED Wednesday, July 6, 2011 — 1:00 p.m.

From the Dane County Medical Examiner’s Office:

The Dane County Medical Examiner’s Office is releasing the name of the 3-year-old male child who died at University Hospital on 07-03-11. The child was taken to another local hospital for evaluation and then transferred to the UW Hospital with a severe head injury. The child is identified as:

A complete forensic examination was completed on 07-05-11 at the Dane County Medical Examiner’s Office. The preliminary results of that autopsy indicate that the injuries to Luis are consistent with inflicted trauma. Additional testing is currently underway.

This case remains under investigation by the City of Madison Police and the Dane County Medical Examiner’s Office.

Ms. Castillo-Dominguez was arrested Tuesday morning, July 5th, on a tentative charge of First Degree Reckless Homicide.

Victim:
Male, age 3, Madison

Details:
Tuesday morning, July 5th, detectives arrested a young Madison mother on a tentative charge of First Degree Reckless Homicide following the death of her 3-year old son.

The boy was taken to UW Hospital on Thursday June 30th with a head injury.

Madison Police were made aware of the injury on Friday, July 1st.

The child died, at the hospital, on Sunday afternoon, July 3rd.

The mother has told detectives that she struck the child inside their Lake Point Dr. apartment Thursday morning, June 30th, and that his head hit a wall.

Later that day, he began to show signs of physical distress and was driven to the hospital.

The Dane County Medical Examiner conducted an autopsy yesterday, July 5th.

The Madison Police Department is investigating the apparent double homicide of two brothers, ages three and four years old. The following is a chronological summary of what we believed happened at this time:

• At 2:06 p.m. yesterday, the 22 year biological mother of the two children came to the MPD headquarters at the City County Building to report a domestic violence incident which had transpired between the current boyfriend and this complainant. The couple had been residing in a Moorland Road apartment, where the altercation had taken place between them the day before and involved a knife.

• At approximately 5:00 p.m. the mother returned to the Moorland Road apartment and made contact with the 25 year old biological father of the two children they share in common. The mother learned that her boyfriend had made contact with the biological father at 1: 24 p.m. yesterday afternoon at his Lake Point Drive apartment, and took custody of the two children. The boyfriend indicated to the biological father he was taken them to the east side of Madison to meet with the mother’s family members and to go “shoe shopping.” It was not uncommon for this boyfriend to facilitate custody exchanges between the mother and father of these two children.

• At 5:47 p.m., the mother re-contacts the Madison Police Department and reports the children as missing and likely in the custody of her boyfriend. MPD officers interview the mother as to the possible whereabouts of the children. MPD officers also locate the father on Lake Point Drive and interview him as well.

• At approximately 8:00 p.m. the Madison Police Department made contact with the State Division of Criminal Investigation and the State Department of Corrections for assistance in locating the whereabouts of the boyfriend. The Department of Corrections issued an Apprehension Request at the boyfriend was currently on parole. Throughout the evening, various addresses were checked for the children.

• At 12:47 a.m., the boyfriend calls the Dane County 911 Center and advises he was in a vehicle, with another female, who had convinced him to “turn himself in.” At 12:54 a.m. the boyfriend drove into the MPD’s East District parking lot and was taken into custody.

• As the children were not with the boyfriend when he was taken into custody, MPD officers continued to search for a gray Volvo vehicle it was believed the boyfriend had been driving earlier in the day with the children. At 2:39 a.m., a Madison police officer checking business properties in the 3300 block of Kinsman Boulevard located the gray Volvo vehicle. Upon examining the interior of the vehicle, the officer observed what appeared to be the body of a child in the rear set. Upon forcing entry into the vehicle, the officer discovered the bodies of the three and four year brothers. Both children were deceased. Upon checking video surveillance cameras in the area, we believe the vehicle was parked in this Kinsman Boulevard location shortly after 7:00 p.m. last evening.

At this time the Madison Police Department has in custody the following individual:

ARRESTED PERSON: David J. Hoem
DOB: 05/30/1983 (28 yoa)
CHARGE: Parole Violation

The investigation is on-going. No additional information is available at this time.

UPDATED Wednesday, July 6, 2011 — 3:14 p.m.

Madison Police say 28-year-old David Hoem is the primary suspect in the murder of two young children on Madison’s northeast side.

They say Hoem and his girlfriend–the children’s mother–were involved in a domestic abuse incident before the murders. On Tuesday, Hoem went to the home of the biological father of the boys to take them for the day. Police say this was a common occurrence (for Hoem to pick the kids up from their father’s home).

Later in the day, the boys’ mother reported the children missing. Madison Police made contact with several people and began searching for the children.

Last night David Hoem called the 911 dispatch center to turn himself in, although initially it was unclear what he was turning himself in for.

Through the description of the vehicle he was driving, and a general area they were searching, police discovered the car in the Covance parking lot. The bodies of the two boys were inside.

UPDATED Wednesday, July 6, 2011 — 11:05 a.m.

Sources tell NBC15’s Dana Brueck that the 28-year-old person of interest in this case turned himself in to East District Police early Wednesday morning.

The sources also say the man is the boyfriend of the children’s mother, who reported them missing from Madison’s south side Tuesday night.

Police are trying to pin-point exactly where the 28-year-old was yesterday as they investigate this case.

UPDATED Wednesday, July 6, 2011 — 10:50 a.m.

MADISON, Wis. (AP) — Madison police say two young boys have been found dead in a parked car, and a 28-year-old man who knew them has been detained.

Police spokesman Joel DeSpain says the case is being treated as a double homicide. He says the man isn’t the boys’ father but was acquainted with them.

The boys were ages 4 and 3. They were found early Wednesday morning in a car parked next to a business.

UPDATE — 11:25 pm — The woman struck by the bus has been identified as Maureen Grant, an employee of Memorial Library, according to Ald. Scott Resnick, District 8. She was not a UW student.

 

A Madison woman died after she was struck by a Madison Metro bus Wednesday morning while walking northbound on University Avenue.

 

According to the Madison Police Department, the woman was in the crosswalk and had a walk light when she was struck by the Metro bus turning left onto University Avenue from Lake Street.

 

“This is a very sad day here at Metro,” Madison Metro Spokesperon Mick Rusch said. “This is a tragic accident that is hard on family, friends and everyone affected.”

 

A backpack, sandals and an umbrella were found at the scene, according to Ald. Scott Resnick, District 8. Although this could suggest she was a UW-Madison student, it is entirely possible she has no university affiliation as she has not been identified, said Resnick.

 

Police called the City of Madison Fire Crews to the scene to extract the woman pinned under the bus, where she was then transported to UW hospital.  The Engine 1 crew used cribbing to stabilize the bus while the Ladder 1 crew used the “Jaws of Life” to lift the bus off of the victim.

 

The accident is currently under investigation by the City of Madison Police Department, the Wisconsin State Patrol and the Dane County Medical Examiner’s Office. Identification of the victim is pending notification from her family.

 

“The city of Madison will cooperate with a complete investigation that is already underway,” Soglin said.

 

Rusch said the bus driver was taken immediately for drug and alcohol testing, which is standard procedure, and will be interviewed by police. The bus was taken to a garage where it will be impounded for investigators to examine the bus’s functioning and mechanics.

 

Mayor Paul Soglin said in a statement that his thoughts are with the victim and her family, but also the bus driver and entire Metro Transit Team.

 

“Madison Metro drivers have an exemplary safety record,” Soglin said.

 

Resnick said his deepest sympathies go out to the victim’s family and loved ones.

 

“It’s really horrific when an accident of this nature happens,” Resnick said.

 

A complete forensic investigation is scheduled for Thursday, June 23.

Rage Against The Machine guitarist Tom Morello spent Monday at the Wisconsin protests, performing acoustic songs at a rally and delivering a fiery speech to the thousands inside of the capital rotunda who are protesting Governor Walker’s attempt to end the right of state employees to collectively bargain. “What’s happened so far might be the most inspiring 24 hours of my life as an activist,” Morello tells Rolling Stone.  “I’ve never seen this kind of outpouring of unapologetic, steel-backboned support for union causes in the United States. The Madison police were delivering bratwurst to the protesters inside the capitol, and the kids were thanking them. It was unbelievable.”

At a freezing cold rally outside of the capital, Morello was joined by Rise Against frontman Tim Mcilrath, Wayne Kramer of the MC5 and Boston folk group Street Dogs. The show mixed classics like Neil Young’s “Ohio,” Bob Marley’s “Get Up, Stand Up”  and Morello’s driving acoustic version of Rage Against the Machine’s “Guerilla Radio.” “No matter what Gov. Walker, the Mubarak of the Midwest, says, this land is your land,” Morello said before singing Woody Guthrie’s “This Land is Your Land.” “Never give up and never give in!”

If Governor Walker’s bill passes, it would effectively destroy Wisconsin’s civil servant unions; many fear that other Republican-controlled states would attempt to follow suit. “I come from a coal-mining town in central Illinois where everybody was union,” says Morello. “For almost 30 years, my mom was a public high school teacher in Libertyville, Illinois. I grew up with a firm belief that the leverage we have as working people is through the union. It’s the only counterweight to the raw greed of corporate power. For the past 22 years, I’ve been a union man in L.A. as a member of the Professional Musicians Local 47.”

After the rally, Morello entered the packed Capitol rotunda, which had been occupied for the past week, grabbed a bullhorn, and made one of the most rousing speeches of the day. “This is what they do in times of economic crisis,” Morello said. “They think people aren’t paying attention, that they can just sneak through this legislation that would rob us of decades, centuries of social progress. We didn’t pick this fight. [Governor Walker] tapped us on the shoulder and said ‘let’s fight.’ And now we’re gonna knock his legislative teeth out.”
