Duane Brown is a Pro Bowl tackle for the Houston Texans. He is a popular, an oft-quoted vocal representative of the team and a reality TV veteran, having appeared on TLC’s “Say Yes to the Dress” back in August.

Brown is softspoken, but he doesn’t mind getting a little shine on him.

So he recently was a guest on a morning drive show on Houston’s KRBE 104.1, and the hosts of the Roula and Ryan Show found out Brown’s favorite song is, “Somebody I used to know” by Gotye. Brown even revealed that he listens to the song while he works out.

So they had him sing it.

Two things are clear: (1) Duane Brown knows every word to that song, and (2) Duane Brown is not a singer.

So while The Voice and American Idol are a couple of reality shows on which Brown won’t be appearing, there is something to be said for stepping outside your comfort zone to risk humiliation for the amusement of strangers.

The Houston Rockets tied an NBA record and set a franchise mark with 23 three-pointers in a 140-109 win over Golden State on Tuesday night in Houston.

Jeremy Lin sank five three-pointers, a career high, and Chandler Parsons and James Harden hit four apiece as the Rockets reached a season-high point total. They also tied an NBA record with 14 three-pointers in the first half and dished out a season-high 35 assists on 46 field goals overall.

Lin scored 28 points, Harden had 18 and Parsons scored 16 for Houston. The Rockets put on the shooting display without their best three-point shooter — Carlos Delfino sat out with a right elbow injury.

Jarrett Jack scored 20 points and David Lee had 18 for the Warriors. Houston tied the single-game record for three-pointers set by Orlando in a 139-107 win over Sacramento on Jan. 13, 2009.

The Rockets were 18 for 27 from three-point range through three quarters, and they also bottled up Golden State’s leading scorer, limiting Stephen Curry to seven points on 3-for-12 shooting.

Former US President George H W Bush has been in intensive care with a fever since Sunday, a spokesman has revealed.

Jim McGrath said he had had a “series of setbacks” and remained in a “guarded condition”, but was alert and conversing with family and doctors.

Mr Bush, aged 88, has been in the Methodist Hospital in Houston, Texas, since he was taken there for bronchitis treatment on 23 November.

He is the oldest living former president and a World War II veteran.

Mr Bush was Ronald Reagan’s vice-president for two terms and became the 41st president in 1989, but was defeated by Democrat Bill Clinton when he stood for re-election in 1992.

‘Humorous banter’

Mr Bush was now on a liquids-only diet, the spokesman said, describing his ailment as “a stubborn fever that won’t go away”.

He said the former president had not been able to celebrate Christmas in the traditional sense but his family was with him.

“He’s conscious and he’s able to engage in humorous banter with his doctor,” Mr McGrath said.

He also said that doctors were cautiously optimistic about Mr Bush’s treatment.

When first admitted, the former president had only been expected to stay in hospital a few days, but a persistent fever kept him in hospital until and over Christmas.

On Christmas Day, Mr Bush was visited by his wife, Barbara, his son Neil and other family members.

He has also been visited twice by his son George W Bush, who served as 43rd president in 2001-09.

A 27-year-old mother of two has been fatally shot by an off-duty sheriff’s deputy after he suspected her of shoplifting at a Houston Walmart.

Harris County Sheriff’s deputies have said that victim Shelly Frey, Tisa Andrews and Yolanda Craig  were stealing when they were confronted by Louis Campbell a 26-year veteran of the force who works as a security guard at the store.

According to Campbell the women ran to their car and when he rushed to open the door, they accelerated away – at which point he fired the deadly shot into the car which hit Frey in the neck.

Security at the store on the 14000 block of the North Freeway had noticed the three women ‘stuffing items inside their purses’ and notified Campbell, who was working an extra job that evening.

Investigators with Harris County said the three women even attempted to pay for some small items to act as a cover for the shoplifted ones.

After chasing Frey and the other two women to their car, Campbell opened the door and commanded them to stop, but the car was placed in drive and moved forward.

‘I think it knocked him off balance and, in fear of his life and being ran over, he discharged his weapon at that point,’ said Thomas Gilliland, Harris County Sheriff’s Office.

Inside the car as it was speeding away were two small children – investigators have said that they were not Frey’s children.

Gilliland said it was clear that the deputy was law enforcement.

‘He was clearly marked in uniform as a Harris County deputy. And identified himself as the suspects were leaving the establishment,’ said Gilliland to KHOU.Com

Despite the shooting, the women fled but eventually they stopped at The Worthington at the Beltway apartments in the 1300 block of Greens Parkway.

Paramedics from the Houston Fire Department arrived to try and save Frey, but she was pronounced dead at the scene.

‘Shelly was the perfect mom, perfect friend, perfect daughter,’ said her father, Shelton Frey.

He said that his daughter had moved to Houston after Hurricane Katrina to start a new life, but the amount of work she could do was limited by her two-year-old who has sickle cell anemia.

The deceased’s mother Sharon Wilkerson was devastated that the deputy fired into a car with two small children inside and killed her daughter

‘Why couldn’t you just shoot the tire, shoot the window?’ said her mother Sharon Wilkerson. ‘Was it that serious?’

She added that even if her daughter had committed a crime, she did not deserve to die and she worries now for her two young grandchildren.

‘How do I tell these children she’s not coming back,’ said Sharon.

‘To me, it should never (have) happened. I wish the officer didn’t shoot her. I wish he shot her tires just to slow her down. That’s a mother you know. And now they have to figure out what to do with the kids,’ said Angel Gaines, a neighbor.

Kesha Sapp, a woman who knew Frey, agreed.

‘What that look like with him shooting with the darn kids in the car? There were kids in the car with them. Why is he shooting at the car? Come on now, that makes him look bad. That don’t even look right,’ said Sapp.

Both Andrews and Craig, the two other women allegedly involved, have been charged with shoplifting.

Tragically, Frey wasn’t even supposed to be at a Walmart that evening.

Earlier in the year she pleaded guilty to stealing shirts and a package of meat from another Walmart and as part of her plea arrangement she agreed to never enter Walmart stores again.

Five weeks ago, Audrina Cardenas was born with her heart outside her body. The condition is usually fatal. But Audrina has survived, and doctors are hopeful after they performed surgery to tuck her heart back where it belongs.

Audrina had a rare congenital malformation known as “ectopia cordis,” where the heart is abnormally located either partially or totally outside the chest. Audrina was born on Oct. 15 with her heart exposed.

Eight babies out of every million are born with her condition and 90 percent of the eight are either stillborn or die within the first three days of life.

A statement by Texas Children’s Hospital in Houston, where Audrina was born and operated on, said that on Oct. 16 “a multidisciplinary team of surgeons at Texas Children’s saved Audrina’s life during a miraculous six hour open-heart surgery where they reconstructed her chest cavity to make space for the one-third of her heart that was outside of her body.”

Audrina’s mother, Ashley Cardenas of Odessa, Texas, told ABCNews.com she learned of the baby’s condition when she was 16 weeks pregnant.

“I was told that it is a very rare condition and that the survival rates are really low and that if she did survive they don’t know what kind of life she will have,” she said.

“They gave me the option to terminate the pregnancy, continue with the pregnancy and do something called comfort care at the time of delivery, where instead of doing anything painful to her or do surgery they let you spend as much time with her until she passes, or opt for a high-risk surgery to help repair the heart,” said Cardenas.

Cardenas decided to carry on with the pregnancy despite low chances of Audrina’s survival.

“As soon as I made my decision to continue with the pregnancy, the physicians in Midland referred me to Texas Children’s Hospital where a team of miracle workers provided the specialized treatment and care my baby and I both needed,” she said.

“This risky operation on such an uncommon condition required specialists from a variety of care teams including cardiovascular surgery, plastic surgery and general pediatric surgery,” Dr. Charles D. Fraser, surgeon-in-chief at Texas Children’s Hospital and professor of surgery and pediatrics at Baylor College of Medicine (BCM) told ABCNews.com.

“I have only seen this condition a few times in my career and these are always very tricky cases; in fact, many of these babies do not survive … Audrina is a true fighter and we are so excited that this was a good outcome,” he said.

“She’s a fortunate child to have gotten through difficult circumstances. She is a very strong baby and is also fortunate because her other systems are normal,” said Dr. Fraser, who added that it was promising that she still is showing improvements.

“We’re not definitive about her prognosis, but so far, so good. We are very optimistic about the long-term prognosis. The baby will probably have to have operations in the future. Her sternum is about half formed but these are things we can deal with,” said Fraser.

“Despite Audrina’s misplaced heart, she was born with no other syndromes or genetic conditions that would cause additional stress or complications on her heart,” Dr. Carolyn Altman, a pediatric cardiologist at Texas Children’s Hospital and associate professor of pediatrics at BCM, told ABCNews.com.

Dr. Larry Hollier, chief of plastic surgery at Texas Children’s, played a key role in the surgery. “After reducing the heart into the chest we needed to mobilize the surrounding soft skin tissue to cover the heart itself to get it back in,” he said when explaining his part of the surgery.

Audrina is still at Texas Children’s for an open-ended stay, said Dr. Fraser.

“It would be a great blessing if she can celebrate Christmas with all of us at home,” said Audrina’s mother. “I want to tell the team at the hospital, ‘Thank you for everything.’ If it wasn’t for them and the grace of God she wouldn’t be here,” she said.

The New York Knicks decided that Linsanity would have only a one-season run on Broadway.

Lin is headed back to Houston after the Knicks decided on Tuesday that they wouldn’t match the Rockets’ three-year, $25 million offer for the restricted free agent.

The 23-year-old point guard, who went undrafted out of Harvard, became an international phenomenon and the biggest story in sports during one dazzling month in the Big Apple. But the Knicks decided keeping the show in town was too costly.

“Extremely excited and honored to be a Houston Rocket again!!” Lin posted on his Twitter account.

“Much love and thankfulness to the Knicks and New York for your support the past year…easily the best year of my life.”

Lin will return to Houston, where he spent two weeks in training camp in December, before the Rockets waived him. General manager Daryl Morey later regretted the move and alluded to the mistake as he celebrated the re-acquisition of Lin on Twitter late Tuesday:

“Welcome to Houston (at)JLin7. We plan to hang on this time. You will love (hash)RedNation.”

The Knicks said they would match any offer to retain Lin, but the Rockets made it tough for New York to keep him by backloading their offer sheet with a $15 million salary in the third season of the deal. If the Knicks agreed to match, they would have faced a hefty luxury tax in the 2014-15 season because of other big contracts on their books — between $30-40 million.

One sports consultant said the adjustment to the offer sheet was a stroke of genius by Morey.

“The Rockets deserve a lot of credit for the way they’ve gone about this,” said Marc Ganis, president of Chicago-based SportsCorp. “It was extremely intelligent — with an assassin’s touch.”

Houston initially released Lin because it already had Goran Dragic and Kyle Lowry on the roster. The Knicks picked him up, and coach Mike D’Antoni put him in the lineup out of desperation, with the Knicks floundering at 8-15. Lin scored a career-high 25 points in a 99-92 win over the New Jersey Nets, and “Linsanity” was born in the bright lights of New York.

The stock price for Madison Square Garden Inc. surged as Lin proved to be more than a one-game wonder. He made the Sports Illustrated cover in consecutive weeks, only the 12th athlete to hold that distinction since 1990. On Tuesday, Lin had more than 829,000 followers on Twitter.

The more opponents saw Lin, though, the more they seemed to figure him out as the season wore on. He went 1 for 11 with eight turnovers in a humbling, nationally televised loss in Miami, and the Knicks dropped their first six games in March.

D’Antoni resigned in mid-March and Lin hurt his left knee less than two weeks later. The Knicks revealed on April 1 that Lin needed surgery to repair a meniscus tear and would miss six weeks.

The Knicks made the playoffs behind surging Carmelo Anthony, but bowed out to Miami in the first round. The Rockets, meanwhile, missed the postseason for the third straight year and have spent the offseason completely rebuilding their roster.

Houston has been trying to put together a package of assets and draft picks to offer Orlando in exchange for disgruntled All-Star center Dwight Howard. In the process, the Rockets lost the unrestricted free agent Dragic to Phoenix, then traded Lowry to Toronto for a first-round pick with lottery protection.

Yvonne Stern, who has reconciled with her husband, is now suing Gaiser in civil court. Gaiser’s response, filed Friday, is filled with details of the kinky sex life she shared with Stern and is intended to show how Stern used sex to manipulate Gaiser.

“A steamy sex novella could not sufficiently describe the intensity of their sexual relationship,” the documents stated.

The couple frequently had sex at Stern’s mansion when his wife wasn’t home and he made his lover wear his wife’s bras and panties, Gaiser claimed.

Stern solicited male transsexual prostitutes and demanded Gaiser watch, the documents alleged.

On one occasion, a transsexual named Cindy met the couple at Moe’s Steakhouse Bar where Stern allegedly “began playing with Cindy’s male genitals in the view of Michelle Gaiser.” During another encounter, Cindy had to run to Gaiser for protection from Stern’s “painful deviant sexual advances,” the documents alleged.

The alleged coercion also extended outside of the bedroom, as Gaiser became financially dependent on her lover. He persuaded Gaiser to quit her job and he opened a satellite personal injury law firm where she worked.

“At that juncture in her life, Michelle was paying her sister’s college tuition at Florida State, she was supporting her mother, she was contributing to her brother’s college education and she was purchasing a home. Once she went to work for Jeffrey Stern she became totally dependent on his financial support,” the filing said.

Prosecutors say Stern and Gaiser planned three failed attempts to kill Stern’s wife, Yvonne.

The plots failed, although Yvonne Stern was shot in the stomach during the third attempt.

Stern has admitted the affair with Gaiser, but denied any wrongdoing in the murder attempts.

Yvonne Stern initially filed for divorce after learning of her husband’s infidelity, but took him back. She has said she does not believe he was responsible for the attempts on her life.

“Is this the plot of a mastermind? My husband is brilliant. He’s smart. He’s talented. He would never be capable of doing such a terrible job,” she told ABC News.

Stern will stand trial on July 27.

It was a very unpleasant flight home for United Airlines passenger Karen Reed that resulted in her filing multiple complaints to United.

Reed said she had to cut out a chunk of her hair after a maintenance worker dripped super glue all over her while fixing an overhead bin.

Reed says she had just  boarded  a flight on June 14  from San Diego to Houston  with her two children when a maintenance worker approached her and asked her to get up from her  seat.

“He put super glue on a piece of plastic trim and put it on the overhead bin above me and proceeded to drip it everywhere,” said Reed.

Everywhere included her hair.

“He was cleaning the seat and I told him the glue was still dripping from overhead but that’s how careless he was,” said Reed.

The maintenance worker walked away and returned shortly to replace the seat cushion, she said.

“When the flight attendant said, ‘Hey, you got super glue in her hair,’ he totally ignored the comment, wouldn’t look at me, wouldn’t give me any eye contact and turned around, replaced the seat cushion and walked out,” said Reed.

She had a very uncomfortable ride home. The flight was full and with no other seats to switch to, the flight attendant gave Reed a blanket to sit on.

“At this moment I’m sitting on super glue, I can feel the clumps of glue in my hair, I’m tired and I’m ready to get home,” she said.

Once she got home, her hair was so tangled she took a pair of scissors and cut off  more than  9 inches of it off of her head.

Reed filed a complaint with the flight attendant, the supervisor at the gate in Houston and even sent in a packet that included a complaint form and a picture of her cut off hair.

She said United offered her 40,000 miles and a $100 American Express gift card. She declined the offer.

“For what they offered me, they’re not even giving me a round trip ticket, basically their customer service sucks,” said Reed.

The airline offered an apology.

“We’re sorry about what happened, we reached out and spoke directly to Miss Reed. We appreciate her business and we’d like to welcome her back,” said United Airlines spokesman Charlie Hobart.

A Houston woman’s attempt to save drivers from a speeding ticket landed her something worse: 12 hours in jail.

As she rode her bicycle home from a grocery store last week near downtown Houston, Natalie Plummer noticed police officers pulling over speeders. After she parked her bike and turned one of her grocery bags into a makeshift sign warning drivers about the “speed trap” ahead, an officer drove up and arrested her.

“I was completely abiding by the law,” Plummer told ABC’s affiliate KRTK. “I was simply warning citizens of a situation ahead.”

But Houston police saw it differently, and arrested Plummer for standing in the street where there a sidewalk was present, a misdemeanor charge.

Houston police spokeswoman Jodi Silva said that officers found Plummer standing in the street, waving her arms as she held the sign.

But Plummer denied ever leaving the sidewalk on West Dallas Street, alleging that the arresting officer invented a reason to detain her.

“He couldn’t take me to jail for holding up this sign or he would have. So all he could do was make up something fake about it,” Plummer told KRTK. The officer searched Plummer’s backpack, she said, and threatened to arrest her for obstructing justice, a felony charge.

Michael Dirden, Houston’s executive assistant police chief, said in a statement that if Plummer believes the police acted inappropriately, she should file a complaint with the department’s internal affairs division.

After being held in jail for 12 hours, Plummer was released on bond, and will soon appear in court to face her misdemeanor charge.

While Plummer’s method of alerting drivers to police activity might have been unprecedented, state laws covering such warnings are decades old. Their most common form, flashing headlights, is legal in some states but illegal in others.

Laws in New Jersey, New York, Ohio, Pennsylvania, Tennessee, Virginia and Florida allow headlight flashing, while other states, such as Arizona and Alaska, forbid it. In Washington, drivers may be fined $124 for flashing their high beams within 400 feet of another vehicle for any reason. Other states forbid headlight flashing in some circumstances but not in others.

In Massachusetts, flashing car lights is not illegal, but it may result in an encounter with a police officer. If a driver says no when an officer asks whether headlights were flashed to warn drivers of a speed trap, the officer might ask if the motorist was driving with defective lights — which state law forbids.

A young autistic boy died from head injuries when he dove into a pool after he and his mother had snuck in.

Police said that Linda Harden, 33, told investigators that she ignored signs stating the pool in a Houston apartment complex was closed when she helped her son over the fence.

Joseph Harden, 7, who was autistic, reportedly jumped into the shallow end of the pool at the Oakwood Gardens Apartments, hitting his head.

KTRK reported that the boy was rushed to the hospital after the accident on Thursday in critical condition, but was pronounced dead on Saturday.

Harden originally faced charges of injury to a child by omission, but those charges will be upgraded due to her son’s death.

Houston Police Department Detective Fil Waters told KTRK: ‘The mother put the child in harm’s way because of a decision she made to give him access to the pool.’

Police said Harden initially told officers that she and her four children jumped over the gate to get to the pool.

Uriel Landeros, 22, was captured on a cell phone video spray painting a bull and the word “Conquista” in gold onto Pablo Picasso’s “Woman in a Red Armchair,” Houston Crime Stoppers said in a statement. “Conquista” is Spanish for “conquest.”

The video was uploaded to YouTube, and a Crime Stoppers tip identified Landeros, the statement said.

Landeros, who has not been apprehended, is a University of Houston student known to spend time at a local art studio, said Harris County Assistant District Attorney John Lewis.

Landeros was charged with criminal mischief and felony graffiti, both third-degree felonies, Lewis said. Warrants have been issued for his arrest.

The student has numerous ties to the Houston area and investigators suspect he is still in the area, Lewis told CNN.

Earlier this week, a museum spokeswoman said the 1929 painting was expected to hang again soon.

“The painting went directly to the on-site conservation lab down the hall,” said museum spokeswoman Gretchen Sammons. “The damage is being undone and the prognosis is excellent.”

Menil Collection Director Josef Helfenstein called it an “unfortunate incident.”

“It threatened the public’s ability to enjoy a wonderful painting and violated the bonds of trust that enable museums to share great works with their visitors,” Helfenstein said.

While the Houston Police Department hasn’t yet confirmed the identities of the victims involved in the shooting that resulted in rapper Trae Tha Truth being hit by gunfire early Wednesday morning, veteran H-Town MCs, Bun B and Slim Thug, took to Twitter to express their sadness over the loss of Dinky D and Poppa C, both pronounced dead at the scene of the former Scores Cabaret located in Southwest Houston:

“RIP Dinky D and Poppa c,” Bun B wrote, while Slim Thug added, “Im just waking up hearing all this, we was all together yesterday prayers out to the whole #ABN I can’t believe Dinky died #RIPDinky”

MTV News reported earlier that the rapper, born Frazier Thompson III, was shot and treated for his wound at a Houston area hospital, while another unnamed survivor was also treated and released and is currently being interviewed by HPD homicide.

HPD spokesman Victor Senties told MTV News that at this time, no arrests have been made and that though hundreds of witnesses were on the scene, they are not coming forward with details on the shooting. HPD is asking that witnesses volunteer firsthand details of the shooting to assist in their investigation.

According to Senties, HPD received a 911 call at 3:15 a.m. this morning reporting that there was a shooting in progress. Officers were quickly dispatched to the scene.

This tragedy comes just six months after the Grand Hustle signee’s close ABN friend and right hand man, Money Clip D, was gunned down at Breakers night club, which is a stone’s throw from Scores. Many believe the two shooting incidents are somehow related.

A jury has convicted a Texas man for murdering his neighbor during a confrontation over loud music two years ago, rejecting a claim that he was within his rights to fatally shoot the man under Texas’ version of a “stand-your-ground” law.

Raul Rodriguez, 47, faces up to life in prison for the killing of Kelly Danaher, 36. Sentencing is scheduled to begin today.

“I’m just glad he can’t hurt anybody else,” Danaher’s wife, Mindy, said. “I love my husband, and I miss him so much … and he helped all of us get through this today.”

It took the jury less than six hours Wednesday to decide between self-defense and murder. Jurors, apparently agreeing with prosecutors that Rodriguez, a retired Houston-area firefighter, was a trigger-happy neighborhood bully.

“He felt like he had ultimate control, control to determine who lives and who dies,” Donna Logan, Harris County Assistant District Attorney, said.

Rodriguez recorded the argument in May of 2010 when he killed Danaher, an elementary school teacher, and wounded two other people. The 22-minute homemade video was the key to the trial as Rodriguez’s lawyers argued it was self-defense under Texas’ version of the so-called stand-your-ground law, which is also at the center of the Trayvon Martin case in Florida.

It was after midnight when Rodriguez, complaining to police via telephone that the music was too loud, walked up to Danaher’s driveway with a flashlight and gun.

In the video, Rodriguez can be heard talking to a 911 operator, saying, “I’m running the video camera right now and I’m talking to you and I mean, I’m scared to death here.”

In the unfolding confrontation between Rodriguez and several unidentified men, one yells, “Tell you what, pal, you just pulled a gun on the wrong [expletive], OK?”

When one of the party-goers saw Rodriguez’s gun, he suggested he is getting his own. “When I go in that house and come back,” he warned, “don’t think I won’t be equal to you, baby.”

“It’s about to get out of hand sir, please help me. Please help me, my life is in danger now …,” Rodriguez told police over the phone. “Now, I’m standing my ground here. Now, these people are going to try and kill me.”

Seconds later, a fight about loud music ends with the crack of gunfire.

“Look, I’m not losing to these people anymore,” Rodriguez said. “I’m just totally going to stay back, because they’re drunk, they’re …”

Rodriguez is interrupted by wild laughter, and then the sound of gunfire, before the tape stops as Rodriguez is tackled to the ground. In addition to the shot that killed Danaher, Houston Fire Capt. Ricky Johnson and Marshall Stetson received multiple gunshot wounds after the camera stopped recording. Rodriguez, a father of six, walked away from the incident unharmed.

“This has eaten me up for two years,” Johnson said. “Hopefully, now I can begin to heal from it.”

The defense did not present much of a case as it called no witnesses and Rodriguez didn’t testify. Legal experts say if defendants are going to successfully argue self-defense, the jury wants to hear from them.

Greg Rubar, 42, has waited tables at D’Amico’s Italian Market Cafe in Houston for 16 years. But his car was flooded during a thunderstorm weeks ago and so he had been taking taxis to work and borrowing the restaurant’s catering truck from the owners.

But on Saturday, a couple who have been coming to the restaurant for about eight years gave him an envelope of cash to help solve his car troubles.

“He said, ‘I’m not going to be giving you a tip for a while. Take this money. Go buy yourself a car,’ ” Rubar told the Houston Chronicle.

“I’m just humbled by it, that’s all,” Rubar told Houston’s ABC affiliate KTRK.

The couple wishes to remain anonymous.

Rubar’s mother, Annetta Rubar-Staff, said her son is a “hard worker” who is on his feet all day at the popular restaurant.

“They just love him because he gives good service to them,” she said.

She said her “shy” son has been inundated by the recent media attention because of the gift.

“He’s kind of embarrassed because everyone came and talked to him,” she said.

His boss is overwhelmed at the generosity of the two customers, KTRK reported.

“And also that we have staff that our customers feel so close to that they could willingly and wantingly do something like that for them,” the restaurant’s VP Brina D’Amico said.

The money is technically a gift, not a tip, because it was not attached to a bill.

“It’s enough money to go buy you a nice car. I didn’t even look at it. I was hesitant about it, but he said, ‘No you take it and buy you a car!’” Rubar told KTRK. “People can be generous, you know? They told me they felt like I deserved this.”

Rubar said he has not seen the couple since they gave him the gift, but he would like to tell them:

“Thank you very, very much. I mean I did need it and I’m gonna buy a car with it; that’s what that money’s gonna go to — every cent,” he said.

The Texas judge who jailed an 11th-grade honor student for missing too much school unfairly punished the teen who works two jobs to support her siblings, one of her employers says.

“I can understand if a child is staying out of school, running around, a bad kid, getting into trouble, taking drugs,” Mary Elliot, Diane Tran’s boss at her weekend job, told ABC News this weekend. “I can understand why he would slap them into jail for 24 hours. But Diane doesn’t do that. All she does is work and go to school.”

Tran, 17, had already been warned not to miss any more time at her Houston-area school, but when Judge Lanny Moriarty heard she’d skipped again, he sent her to jail for 24 hours Wednesday, according to KHOU 11 News.

It’s unclear how many days she missed but state law allows for only 10 unexcused absences in a six-month period.

In addition to working at Elliot’s wedding-planning venue, Tran works full-time at a dry cleaners. She has been supporting an older brother and a younger sister since her parents separated and her mother relocated out of state, Elliot said. Her father often works too late to come home, so she sometimes lives with Elliot’s daughter.

“She’s a straight-A student,” Elliot said. “She keeps her grades up, but sometimes she oversleeps, because she’s been working.”

Tran, who was working at Elliot’s venue when Elliot spoke to ABCNews.com, declined o comment.

Tran’s classmate Devon Hill told the New York Daily News that Tran takes Advanced Placement classes, goes “from job to job” and stays up until 7 a.m. some nights.

When those close to Tran suggested she switch to home schooling, Tran refused because she wanted to be named among the top-10 students in her class just like her brother, Elliot said.

Judge Moriarty told KHOU 11 News that he intended to make an example of Tran.

“If you let one run loose, what are you going to do with the rest of them? Let them go, too?” Moriarty asked the TV station.

Willis High School posts the state truancy law on its website.

“Texas law is clear that children must attend school,” the site says before explaining that students can only have 10 unexcused absences in a six-month period before the school files a complaint in court.

A former Los Angeles County Sheriff’s Department deputy tortured his then-wife and her lover in an Irvine office after learning of their affair, a prosecutor said in court last week.

Robert Avery McClain, 38, of Irvine stands accused in Orange County Superior Court of eight felonies, including aggravated mayhem, torture, rape and sodomy in connection with the Sept. 28, 2008, incident.

He has entered pleas of not guilty and not guilty by reason of insanity. He faces multiple life sentences if convicted.

The Orange County district attorney’s office asserts that McClain drove to the leasing office where his wife, 31 at the time, worked. Her lover, then 23, lived in the complex.

McClain and the two went to the office’s break room, where he used a knife to stab the man and carve into his face “like a pumpkin,” prosecutor John Cristl said.

The male victim, who was in the Central Justice Center courtroom Monday, stiffened and began breathing hard as a photo of his face after the attack was displayed.

Cristl told the jurors that McClain also forced his wife to shoot a gun aimed at her lover, but, unbeknownst to her, the chamber wasn’t loaded.

Prosecutors showed jurors slides of the office before the alleged attack and the blood-soaked carpet afterward.

Public defender Darren Thompson painted a different picture of McClain, describing him in a soft voice as a deeply-rooted family man who snapped after learning of his wife’s infidelity.
