The retired Alabama trucker who shot a school bus driver and is now holding a kindergarten student in an underground bunker was scheduled to be in court Wednesday to answer for allegedly shooting at his neighbors in a dispute over a damaged speed bump.

Jimmy Lee Dykes, 65, has been holed up in a 6 by 8 foot bunker 4 feet underground with a 5-year-old autistic boy named Ethan since Tuesday, when he boarded a school bus and asked for two 6 to 8 year old boys. School bus driver Charles Albert Poland Jr., 66, was shot several times by Dykes, and died trying to protect the children.

Police said that they do not think that Dykes had any connection to Ethan, and that SWAT teams and police are negotiating with Dykes.

“I could tell you that negotiators continue to communicate with the suspect and that there’s no reason to believe the child has been harmed,” Sheriff Wally Olson said late Thursday.

Dykes’ neighbor Claudia Davis told The Associated Press that he had yelled at her and fired his gun at her, her son James Davis, Jr. and her baby grandson after he claimed their truck caused damage to a speed bump in the dirt road near his property. No one was hurt, but Davis, Jr. told the AP that he believes the shooting and kidnapping are connected to the scheduled court hearing.

“I believe he thought I was going to be in court and he was going to get more charges than the menacing, which he deserved, and he had a bunch of stuff to hide and that’s why he did it,” he said.

This was not Dykes’ only run-in with people in the neighborhood, where he had come to be known as a menacing figure. Neighbor Ronda Wilbur told the AP that Dykes beat her 120-pound dog with a lead pipe when it entered the side of the dirt rode his trailer sits on. Wilbur said her dog died a week later.

Early last year, two pit bulls belonging to neighbors Mike and Patricia Smith escaped and got into his yard. Patricia Smith said that Dykes threatened to shoot her children when they went to retrieve them.

Neighbor Ronda Wilbur said that Dykes would be seen on his property at all hours of the day.

“It could be 2 o’clock in the morning, it could be midnight. He was out there either digging or moving dirt,” she said.

As the underground standoff moved into its fourth day, tensions grow in this small community near Midland City, Ala., which is now enveloped by SWAT teams and police.

“That’s an innocent kid. Let him go back to his parents, he’s crying for his parents and his grandparents and he does not know what’s going on,” Midland City Mayor Virgil Skipper told ABC News. “Let this kid go.”

Neighbor Jimmy Davis said that he has seen the bunker where Dykes has been known to hunker down for up to eight days.

“He’s got steps made out of cinder blocks going down to it, Davis said. “It’s lined with those red bricks all in it.”

Police say he may have enough supplies to last him weeks.

Former FBI profiler and ABC News consultant Brad Garrett said there’s a distinct reason why authorities are keeping details about Dykes under wraps.

“One of reasons they are keeping negations closed and not releasing his picture, is to try to insulate the situation, so they don’t have a situation where they don’t have to deal with his anger and rage,” he said.

Meanwhile, children are trying to understand why this happened to their friend

“He always comes up to my house to play,” 10-year-old Trisha Beaty told ABC News. “I miss him. I miss him a lot.”

Investigators in Philadelphia are trying to unravel a baffling mystery after a hogtied pediatrician was found dead and on fire in the basement of her home.

Police found Melissa Ketunuti, 35, a beloved doctor at Children’s Hospital of Philadelphia, Monday in her Center City basement after her dog walker called 911. Her wrists and ankles were bound behind her back, and she was on fire, police said.

Investigators said she had been strangled with a rope around her neck. Strangulation appeared to be the cause of death, police say, but they are awaiting the results of an autopsy.

With no evidence of forced entry, police wonder whether she knew whoever attacked her.

“We don’t know if she walked in on individuals inside of her property,” Philadelphia police Capt. James Clark said. “We don’t know if it’s a known doer or an unknown doer.”

There’s no clear motive, and nothing appeared to have been stolen. Police have questioned Ketunuti’s boyfriend, but he has not been declared a suspect.

ABC News consultant and former FBI agent Brad Garrett said the culprit is likely someone Ketunuti knew.

“This is extremely personal. I can’t think of anything more heinous or cold to do to another human being,” he said. “The boyfriend can provide all kinds of leads: who she knows, what problems she was having at work.”

Ketunuti lived alone on a quiet street, and had been there for about three years.

“[She was] super pleasant, really nice,” one neighbor said. “Just super friendly.”

Ketunuti’s hospital issued a statement Tuesday that she was “a warm, caring, earnest, bright young woman with her whole future ahead of her,” adding that she will be deeply missed.

“It’s going to be just a horrible thing for her family,” a neighbor said. “She was just a very nice person, very full of life.”

VIDEO: The woman was wedged for hours between a building and a cinder block wall.

Oregon firefighters have rescued a woman who was trapped between a very narrow space created by the outside walls of two buildings.

Anita Mann, 30, fell between the parking garage of the Gretchen Kafoury Commons apartment building and the Joyce Furman building in Portland around 3:45 a.m. PST, firefighters told ABC News’ Portland affiliate KATU.

Firefighters cut a door-size opening in one of the concrete walls and used lubricant to help her slide out from where she was stuck.

Relief cuts were made in the walls and airbags were wedged between the walls in an effort to spread the walls out as much as possible.

The woman’s plaid shirt was cut off, leaving her with only a turqoise t-shirt. When she finally managed to squeeze out of the space, the woman looked relieved and pumped her arms in the air.

She hugged and kissed her husband and paramedics quickly took her away to be examined for injuries.

The woman was stuck in a space that is roughly one-foot wide. A team of firefighters worked to cut out portions of the concrete walls to free the woman.

The initial plan was to cut a doorway into the wall near her, Simmons said, but an excess of dust made it hard for her to breathe so rescuers had to reassess the plan.

Firefighters cut windows in the concrete on either side of the woman in order to blow heat since she is cold and give her blankets. They have also passed her cups of water through the hole. She is conscious and firefighters are talking to her to “keep her spirits up.” They also brought her husband to talk her through the process.

“She is very, very uncomfortable, scared, agitated,” Portland Fire Bureau spokesman Lt. Damon Simmons told KATU on the scene as firefighters worked to free her. “It’s just really scary and uncomfortable, as you can imagine.”

Dispatchers told KATU that someone called 911 at around 3:45 a.m. to report that a woman had fallen between the buildings. She was walking on the roof of the two-story building when she fell, according to KATU. The other building is 8 stories tall.

Neighbors told KATU they could hear the woman screaming for help.

Urooj Khan had just brought home his $425,000 lottery check when he unexpectedly died the following day. Now, certain members of Khan’s family are speaking publicly about the mystery — and his nephew told ABC News they knew something was not right.

“He was a healthy guy, you know?” said the nephew, Minhaj Khan. “He worked so hard. He was always going about his business and, the thing is: After he won the lottery and the next day later he passes away — it’s awkward. It raises some eyebrows.”

The medical examiner initially ruled Urooj Khan, 46, an immigrant from India who owned dry-cleaning businesses in Chicago, died July 20, 2012, of natural causes. But after a family member demanded more tests, authorities in November found a lethal amount of cyanide in his blood, turning the case into a homicide investigation.

“When we found out there was cyanide in his blood after the extensive toxicology reports, we had to believe that … somebody had to kill him,” Minhaj Khan said. “It had to happen, because where can you get cyanide?”

Authorities could be one step closer to learning what happened to Urooj Khan. A judge Friday approved an order to exhume his body at Rosehill Cemetery in Chicago as early as Thursday to perform further tests.

Moments after the court hearing, Urooj Khan’s sister, Meraj Khan, remembered her brother as the kind of person who would’ve shared his jackpot with anyone. Speaking at the Cook County Courthouse, she hoped the exhumation would help the investigation.

“It’s very hard because I wanted my brother to rest in peace, but then we have to have justice served,” she said, according to ABC News station WLS in Chicago. “So if that’s what it takes for him to bring justice and peace, then that’s what needs to be done.”

Khan reportedly did not have a will. With the investigation moving forward, his family is waging a legal fight against his widow, Shabana Ansari, 32, over more than $1 million, including Urooj Khan’s lottery winnings, as well as his business and real estate holdings.

Khan’s brother filed a petition Wednesday to a judge asking Citibank to release information about Khan’s assets to “ultimately ensure” that [Khan’s] minor daughter from a prior marriage “receives her proper share.”

Ansari may have tried to cash the jackpot check after Khan’s death, according to court documents, which also showed Urooj Khan’s family is questioning if the couple was ever even legally married.

Ansari, Urooj Khan’s second wife, who still works at the couple’s dry cleaning business, has insisted they were married legally.

She has told reporters the night before her husband died, she cooked a traditional Indian meal for him and their family, including Khan’s daughter and Ansari’s father. Not feeling well, Khan retired early, Ansari told the Chicago Sun-Times, falling asleep in a chair, waking up in agony, then collapsing in the middle of the night. She said she called 911.

“It has been an incredibly hard time,” she told ABC News earlier this week. “We went from being the happiest the day we got the check. It was the best sleep I’ve had. And then the next day, everything was gone.

“I am cooperating with the investigation,” Ansari told ABC News. “I want the truth to come out.”

Ansari has not been named a suspect, but her attorney, Steven Kozicki, said investigators did question her for more than four hours.

Miss Montana Alexis Wineman, 18, will be the youngest contestant when she takes the stage at this weekend’s Miss America competition in Las Vegas.

And no matter the outcome, she will also go down in the Miss America record books as the 92-year-old pageant’s first contestant diagnosed with autism.

“The girl you’re seeing right now is not the girl you would have seen 10 years ago,” Wineman told ABC News.  “I have overcame a lot.  I have overcome so many of my symptoms.”

Wineman was first diagnosed with the developmental disorder that affects one’s social and communication skills at age 11.  Even though she was considered highly functioning, Wineman recalls being ridiculed for her speech impediment and intense shyness.

“I would stay in my room for hours, not wanting to talk to anyone,” she said.  “Growing up, I barely hung out with anyone and that’s because I was afraid of being laughed at.”

Wineman, a recent high school graduate,  credits her family with enabling her to become comfortable in her own skin.  As she got older, she began to try new things, including cross-country running and cheerleading, even becoming captain of her squad in her senior year.

She entered the Miss Montana competition on a whim.

“I realized I’d done a lot of things I never thought I’d be able to do, so what’s stopping me from at least trying,” she said.

Wineman went on to win and, now, in a competition filled with struts, smiles and outgoing personalities, she will find her place on stage Saturday night in front of a worldwide television audience.

“It just really kind of hit me that, holy, holy crap, I’m at Miss America,” she said of her experience so far in Las Vegas preparing for the competition.

If Wineman – who, according to the hometown paper, plans to attend the University of Montana to pursue a degree in art therapy after her reign – makes it far enough into the competition to reach the talent portion, she hopes to lighten things up with her comedy routine.

“I realized if I laugh at myself, then that’s OK,” she said.

Call it the Year of the Latte, or the Panini.

When the new year rolls around, some people vow to spend more time with their family. Others pledge to step up their Pilates routines. But Beautiful Existence — yes, that’s the legal name of a real person, not a philosophical question triggered by the new year — has another resolution for 2013:  To eat and drink only items from Starbucks for 12 straight months.

Based in Seattle — like Starbucks — Beautiful Existence, who’s  a wife, mother and veteran of the Year-Long Challenge (past resolutions have included her year of Goodwill hunting – that is,  shopping only at the famed thrift shop, and “taking on” Parents magazine),  is consuming only  Starbucks’ products, which can now include  Tazo Tea and Evolution Fresh, as the coffee giant recently acquired them.

The way Beautiful Existence sees it, it’s her duty as a “spoiled” American to test her mettle in such a way. After all, what about the  less-fortunate living in far-flung villages with no Starbucks, who can’t indulge in such delicacies as  Turkey Rustico Panini or Roasted Tomato & Mozzarella Panini, both of which Ms. Existence adores? Compared to others with more limited choices, “Is it really going to be that hard for one year of my life to limit my menu?” she told MyNorthwest.com.

Not only is her goal to call attention to the plight of Panini-free people, she’s also trying to make a  feminist statement.

Think about it: Jared Fogle shot to fame after losing 245 pounds in one year by eating only Subway products. And Morgan Spurlock, whom Ms. Existence calls “Mr. McDonalds” in her blog, changed the way the world views fast food with his documentary “Supersize Me.”

But where, Beautiful Existence laments, “are all the women challenging themselves in the world? Where are the effects being shown on a woman’s culture? A woman’s family and children? A woman’s diet, weight, fashion, checkbook, community and world through challenges? Where is her voice on how an international company is directly or indirectly impacting everything from her waistline to her bottom line and every other woman’s, man’s, child’s, societies and planets world with their presence?”

(Actually, a woman named Christine shed 54 pounds in two years by eating low-fat meals at Taco Bell, but it is unclear whether this had any impact on other planets.)

She also wanted to focus on businesses and organizations that are based in the Pacific Northwest.  ”I’ve been watching Starbucks for a while and I’ve known about how they’re really tried to keep good benefits for the part-time workers and really good customer service,” she told ABC News.  ”Howard Schultz has been participating in politics and the economic situation in our community; they are very environmental. I really wanted to do something that would have a little more depth when I get into it.”

Starbucks, for its part, is “honored” by the whole thing.

“We think it’s great,” spokeswoman Linda Mills told ABC News. “It speaks to the variety of food and beverage items in our stores. … We’re obviously very flattered that she would take on such an endeavor like this.”

So far, Ms. Existence has been enjoying her challenge, although steering clear of baked goods has proved a little tough. And she recently confessed to almost blowing the whole thing by licking a batter-covered spoon during an evening brownie-baking session.

Still, none of this would be worth it if there were no hurdles.

That, after all, is what life is all about, she says.  ”Things start out with reservation and hesitation, even fear, loathing, upset or ridicule. But it’s what that questioning leads to … the ideas, the engagement, the creativity, the expression, the involvement in life that make my questions, my challenges, my voice of only eating/drinking Starbucks for a year all the more sweet,” she notes.

“Because it is the question itself that brings us to what it is to be a woman, a mother, a blogger, an eater and drinker of only Starbucks for a year, basically… what it is to be a human.”

A Cleveland stripper died after attempting a tricky move during a lap dance that caused her to fall 15 feet from a balcony, according to MetroHealth Medical Center.

Lauren Block, 22, died Wednesday from major head trauma. She’d been in critical condition since her Jan. 2 fall, said the medical center.

Block’s family released the following statement:

“We would like to thank the community for their outpouring of support and prayers for Lauren. She … is an organ donor, and we hope this will enable her to save many lives and live on through others. We would like to express our gratitude to the staff at MetroHealth. They worked tirelessly to do all they could to save her life. We ask that the media respect our privacy during this difficult time. We know that she’s in God’s hands.”

Block was entertaining a customer on the second floor of Christie’s Cabaret at 12:40 a.m. on Jan. 2 when she attempted a “jump-dance” move that misfired, the man getting the lap dance told police.

“He stated that she grabbed the rail, as he was facing away from the balcony, and she tried to complete some sort of jump-dance move, and accidentally went head first over the rail,” a Cleveland Police Department incident report said.

Block suffered “massive head trauma” and was lying on the floor of the club when police and paramedics arrived, according to the report.

She was taken to MetroHealth Medical Center, where she was listed in critical condition for a week.

Cleveland Police said they were no longer investigating the incident, which they view as an accident.

Christie’s Cabaret, a chain of “Gentlemen’s clubs,” has not responded to ABC News’ requests for comment.
