The former superintendent at a mine where 29 men were killed in a blast has been given a 21-month prison term.

Gary May admitted in March to charges he falsified records, disabled a methane gas monitor and tipped off workers ahead of inspections at Upper Big Branch mine in West Virginia.

The April 2010 explosion was one of the worst US mining accidents in 40 years.

Investigators concluded then-owner Massey Energy allowed explosive methane and coal dust to build up in the mine.

Those were ignited by a spark from improperly maintained mining equipment, the investigation concluded.

“With this sentence, [Federal Judge Irene] Berger took the opportunity to send a powerful message to this mine manager and other mine managers who would put profits over safety: if you violate mine laws and put miners at risk you will go to jail,” US Attorney Booth Goodwin said in a statement.

In February, Upper Big Branch chief Hughie Elbert Stover was sentenced to three years in prison on charges he lied to investigators. May testified at his trial.

The mine’s new owners, Alpha Natural Resources, have agreed to pay $210m (£135m) in damages in connection with the accident – the largest US settlement for a mining disaster.

A plea hearing for a former executive of Massey Energy, the mine’s previous corporate owner, is scheduled for next month.

Like May, the executive, David Hughart, has been co-operating with prosecutors.

Mirko Jurkovic, a former University of Notre Dame football standout who was part of the 1988 national championship team and later a consensus All-American offensive guard, died of cancer Wednesday evening in Indiana, according to the university’s athletic department. He was 42.

Jurkovic, a 6-foot-4, 289-pounder from Calumet City, Ill., played defensive tackle on the ’88 team and offensive guard in 1990 and 1991. He played on teams that won the Fiesta Bowl, beating West Virginia after the 1988 season; the Orange Bowl, besting Colorado after the ’89 season; and the Sugar Bowl, defeating Florida to cap the 1991 season.

The McGann Hay funeral home in Granger confirmed Jurkovic’s death late Wednesday and said a funeral will be held Saturday.

Jurkovic is survived by his wife and three children.

Before she even announces her West Virginia Senate campaign, Republican Rep. Shelley Moore Capito is facing opposition from the powerful anti-tax Club for Growth.

In a statement, club president Chris Chocola pointed to numerous votes that make Capito unpalatable to the conservative economic group, including her support for campaign finance reform, the auto bailout, “Cash for Clunkers,” a deal to raise the debt ceiling, and No Child Left Behind.

“Congresswoman Capito has a long record of support of bailouts, pork, and bigger government,” Chocola said. “That’s not the formula for GOP success in U.S. Senate races.” He compared Capito to establishment Republicans who fell short in November — Rep. Denny Rehberg in Montana, Rep. Rick Berg in North Dakota and former Rep. Heather Wilson in New Mexico.

Democrats have long had a lock on statewide office in West Virginia, despite its conservative lean. Capito, the daughter of former West Virginia governor Arch Moore (R), has long been considered the GOP’s best hope to break that hold.

It remains to be seen whether Sen. John D. Rockefeller IV (D-W.Va.) will run again, but a recent poll suggests Capito would give him a very tough race.

Salem Indiana

A three-year-old Indiana boy killed his father after finding his loaded handgun and accidentally shooting him.

Police say Michael A Bayless, 33, was watching TV with two of his three children when the three-year-old discovered the pistol on Friday night.

When emergency crews arrived at the house in Salem, Indiana, Mr Bayless was already dead, having passed away in front of his family.

Mr Bayless and his family are from Martinsville, an Indiana town 80 miles to the north, the Louisville Courier-Journal reports.

He was at the home in Salem to do remodeling work on it.

It is unknown where Mr Bayless left the gun that his young son had access to it.

No one else was injured in the shooting and police have ruled it accidental, the newspaper reports.

The incident occurred about 10pm after Mr Bayless finished work on the house for the day.

Police say a 3-year-old boy accidentally shot and killed his father after finding the man’s loaded handgun in a southern Indiana home.

Indiana State Police Sgt. Jerry Goodin says the 33-year-old Martinsville man had brought his gun with him Friday to a home he was remodeling in Salem, about 25 miles northwest of Louisville, Ky.

Goodin says the man, his wife, their three children and a juvenile relative were at the home when the 3-year-old boy apparently found the gun and it accidentally discharged, fatally wounding the man. No one else was injured.

Goodin says the case remains under investigation and prosecutors will determine if any adult should face charges. He calls the case a “tragic accident and a tragic mistake” of leaving a gun within a child’s reach.

A West Virginia man is accused of torturing his wife for nearly a decade, keeping her as a “slave” in their home, burning her flesh with a hot iron and frying pans, and keeping her shackled while she delivered a still-born baby, according to police.

Peter Lizon, 37, will be charged Friday with malicious wounding. He is currently in jail awaiting a hearing on $300,000 bond and has yet to enter a plea.

“This appears to go beyond abuse to what I would consider torture,” Jackson County Chief Sheriff’s Deputy Tony Boggs told The Associated Press.

Lizon was arrested after his wife, Stephanie Lizon, 43, fled her husband on July 2 while the two went to return a roto-tiller at an equipment rental store in Parkersburg. Stephanie sought refuge in the store’s back office and employees there offered to call police. She refused their help in contacting the authorities, but accepted their help in finding a battered women’s shelter.

According to the criminal complaint, confirmed by police, officials at the shelter described Stephanie as “gaunt and filthy” and covered in scars and burns, including one in the shape of a clothes iron on one breast. She had “mutilated and swollen feet,” according to a witness interviewed by police.

Stephanie told officials she was treated like a “slave” and made to kneel before Lizon each time she entered a room for nearly 10 years since the couple moved to West Virginia from Maryland.

She said she was shackled to a bed when she delivered a still-born baby, which Lizon later buried on the property of their farm in Leroy, W.Va.

The date of that delivery is currently unknown. The couple also has a 1-year-old son, who was born under similar circumstances, officials said.

According to police records, Stephanie’s burns and wounds were photographed at the shelter. Police says they have 45 images depicting abuse. On July 5, officers executed a search warrant of the couple’s home and seized items that included a Sunbeam iron.

Jackson County sheriff deputies said neither member of the couple had police records in West Virginia, but they were arrested together in Maryland in 2004, after shredding a Bush-Cheney campaign sign with a bayonet, according to reports.

“The allegations are heinous, but the real question is whether the allegations are meritorious,” said Lizon’s defense attorney Shawn Bayless. “The allegations are a fabrication, levied by a third party and everyone is rushing to judgment.”

“A domestic battery charge is noticeably absent. The facts will bear out what did or did not happen,” he said.

County prosecutors would not comment on the charges until the hearing.

More than 2 million people are without power today in triple-digit heat after a ferocious storm pummeled the mid-Atlantic region.

The storm caused power outages from Indiana to New Jersey and was blamed for the deaths of at least nine people, including at least six in Virginia.

Among the deaths were two peopl in Springfield — a 90-year-old Virginia woman who was killed in her bed after a tree fell on her home, and Khiet Nguyen, 27, whose car was hit by a falling tree as he was driving, police said. He was pronounced dead at the scene.

“We have six confirmed fatalities, because of the storms last night, we have about a million customers without power, within Virginia and obviously we’re looking at extremely high temperatures today, and that’s our big concern,” Virginia Department of Emergency Management spokesman Bob Spieldenner said.

The storm raced across 12 states and brought tremendous downpours, lightning and wind gusts that topped 90 mph in some spots.

Spanning 700 miles, this long line of thunderstorms is called a “derecho.” “Derechos” plow everything in their path and are characterized by a long line of wind gusts of at least 60 mph.

West Virginia Gov. Earl Ray Tomblin declared a state of emergency after half a million residents were left without power. The state has set up cooling shelters for its residents.

Jimmy Gianato, the director of the Homeland Security and Emergency Management Department in West Virginia, urged residents to check on their neighbors with triple digit temperatures expected again today.

“Our greatest concern is the pending heat wave that’s to be here … with 102 degree temperatures. We’re looking at the contingencies we need to make tonight to make sure that we can take care of our citizens tomorrow,” he said Friday night.

Paul Howard, director of operations at the West Virginia Division of Homeland Security and Emergency Management, said there are “in the neighborhood of 600,000 to 700,000 customers” without power in the state.

The storms left two-thirds of Ohio without power, and a state of emergency has been declared as stifling heat is in the forecast for today.

“We know the temperatures are going to climb,” said Tamara McBride of Ohio’s Emergency Management Agency. “So, recognizing that power outages are the factor at this point, we’re working with local communities to identify cooling shelters that either have back-up generators or areas that did not lose power.”

Nearly 300,000 residents were without power in the state.

Washington, D.C., also felt the brunt of the storm. After a day of intense heat, 400,000 people were reported to have lost power.

“We have more than half our system down,” Pepco spokeswoman Myra Oppel told The Associated Press. “This is definitely going to be a multi-day outage.”

Twenty states are under some kind of heat warning or advisory today, mostly from the Mid-Atlantic through the south and into parts of the Midwest.

Pastor who died handling rattlesnake in West Virginia crossed the line one too many times

I’m trying to imagine my reaction when my husband comes through the door and asks, “Honey, could I use the spare bedroom for the poisonous snakes?”

That’s apparently what Mack Wolford did. And after more than a decade of using snakes as part of religious ceremonies, the 44-year-old West Virginia Pentecostal pastor died from a rattlesnake bite this week after being bitten in the thigh.

“Just eight or so,” my husband would say. “Rattlesnakes, copperheads and water moccasins.

“And don’t worry. We’ll just feed them mice and rats.”

“Of course darling. Whatever.”

In running a religion Web site one has to be pluralistic. On Faith features people from all faiths and no faith. I hardly count anybody out and I am rare to judge.  Life is hard. There are many things that get people through the night, many things that give us meaning. So long as nobody gets hurt, then believe or don’t believe what you want.  I don’t understand bigotry or discrimination. There is no existing religion that doesn’t sound crazy to somebody.

However, I draw the line at snake handling.

Snake handling is illegal in most states but it is legal in West Virginia, where Wolford practiced.  Believe it or not, snake handling is just a little over a hundred years old, though the reasoning cited for the practice is as old as the New Testament of the Bible.

Mark 16:18: They shall take up serpents; and if they drink any deadly thing, it shall not hurt them; they shall lay hands on the sick, and they shall recover.

Luke 10:19: Behold, I give unto you power to tread on serpents and scorpions, and over all the power of the enemy: and nothing shall by any means hurt you.

According to a 2011 Washington Post Magazine profile of Wolford, he was 15 when he watched his father die at age 39 from a rattlesnake bite. Not only did that image not discourage him from snake handling, it eventually urged him on.  “I promised the Lord,” he told The Post, ”I’d do everything in my power to keep the faith going. I spend a lot of time going a lot of places that handle serpents to keep them motivated. I’m trying to get anybody I can get involved.”

That’s got to be a hard sell: “Come join our church and risk dying an excruciatingly painful death (venom attacks the nervous system), or watch your friends and family suffer the same fate.” There are understandably not too many converts to snake handling. It is passed down from family to family (though children are not allowed to handle snakes). Yet we watch — in horrified fascination.

I was stunned to read that Wolford passed a yellow timber rattlesnake to a church member and the man’s mother (hismother!) during Wolford’s last ceremony.   Wolford’s sister told The Post, “He laid it on the ground and he sat down next to the snake and it bit him on the thigh.” He was taken to a medical center where he died about 9.5 hours later.

Certainly, not everyone who handles snakes gets bitten. When they do, most survive. Snake handlers are known to have scars, bitten fingers and even atrophied hands from bites.

But if the Gospel promises, “nothing by any means shall hurt you,” were Wolford, his father and others who have died handling snakes being tricked? Were the words not supposed to be taken literally? Is a person who dies evil, or a sinner, and therefore being punished?

I don’t think it matters.

Americans who criticize other religions, especially those abroad where followers are oppressed or punished barbarically for errant behavior, should look carefully at religious practices in this country where people are harmed.

Snake handling is a barbaric and dangerous practice, which should be outlawed.  You can’t stop people from committing suicide but you can stop it from being ritualized, legally sanctioned and where it puts others in harms way.  There’s not much difference between snake handling and drinking Kool-Aid with Jim Jones. People die.

It’s hard to define what religion really is.  But I know it when I see it. Snake handling ain’t it.
