The grieving mother of Chinese university student Jun Lin says her son viewed Canada as a place that was welcoming and safe for immigrants, but his brutal killing and dismemberment have left her with a starkly different view of the country.

“We still believe that most people here are very kind, but this heinous crime happened in Canada. It’s made me reconsider what kind of place this is,” Zhigui Du told the CBC’s Mark Kelley in an interview for The National on Monday.

Lin’s parents have been treated with “kindness” by the federal government, she said, and people here have shown the couple sympathy and support since they arrived in Montreal following their son’s grisly slaying in late May.

But his death, the brutal nature of which garnered headlines around the world, has shattered the idealistic view of Canada that Du’s 33-year-old son had impressed on her.

Before moving to Montreal from Beijing to study in a computer engineering program at Concordia University, Lin had done extensive research online about Canada.

His mother said he had the impression that it was “a peaceful place with great respect for multiculturalism,” and that there was no reason to worry about his safety.

Luka Rocco Magnotta, a small-time adult-film actor originally from the Toronto area who had cultivated a strange assortment of personae online, has pleaded not guilty in the case. He has been charged with five criminal offences including first-degree murder, harassing politicians and posting obscene material to the web.

Today, Du says, when she walks down the street sometimes she feels like “everyone looks like Magnotta. I live with so much fear.”

Anxiously awaiting trial

Magnotta, 29, was arrested in Berlin on June 4 following an international manhunt, and was extradited to Canada on board a military aircraft two weeks later. He made a brief court appearance in Montreal on June 21 where he requested a trial by judge and jury.

Lin’s parents flew to Montreal last month to collect their son’s remains and mourn his death, holding a private memorial service that drew between 50 and 100 friends and family.

In an emotional two-hour-long interview, the couple spoke of their struggle to come to terms with Jun Lin’s killing and their anxiety over the court case, which is still months away.Pretrial motions will begin in March 2013.

Asked whether the Canadian legal system will be able to deliver justice in his son’s death, Jun Lin’s father, Diran Lin, said, replied, “I hope so … I can only wish for it.”

Looking back on son’s life

Jun Lin was born in the city of Wuhan, in central China. His mother said the family lived in a remote area, “poor with material things, but we were a happy family.”

To get around, the three of them would pile on a single bicycle, Jun Lin on the front, Du on the back, his father in the middle pedalling them along “bumpy village roads.”

Going to Canada was Lin’s dream, his mother said, but after arriving in Montreal he stayed in touch with his family almost every day.

They lost contact with him on the evening of May 24, and his mother then got a phone call from one of her son’s classmates in Montreal saying that his friends also had not heard from him.

“When I heard that, my heart almost stopped beating,” Du said. “I couldn’t breathe.”

She eventually learned of Jun Lin’s death from a TV news report, and said she fainted.

Coping with grief

Jun Lin’s death has put a strain on the couple, and the suggestion that his slaying has allegedly been posted online has only heightened their anguish.

“What a disaster and huge pain for our family,” Du said, sobbing.

“The most unbearable pain for me is that the video got posted on the internet. People watched it over and over. It’s like my son is being murdered again and again.”

Diran Lin said he doesn’t believe his son had a relationship with Magnotta, although his apartment was the site of Jun Lin’s murder.

“I’m confident to assure you on that,” he said, adding that testimony at trial may clarify whether the two men knew one another.

While they wait for the trial to begin, Jun Lin’s parents are also trying to decide where to lay their son’s remains to rest.

They had planned to have the burial in Montreal because, his mother said, he loved it so much there.

But the couple is facing mounting pressure from family to lay his remains to rest in the country where he was born and raised.

“We Chinese have an old saying: ‘Fallen leaves must go back to the root of the tree,'” Du said. “We’re caught in the middle and really don’t know what to do.”

Luka Rocco Magnotta, accused of killing and dismembering Chinese student Jun Lin, has appeared in person at the Montreal courthouse for a possible psychiatric evaluation request.

Only seven journalists were granted access to the courthouse Thursday afternoon, and they had to pass through a metal detector.

The accused has pleaded not guilty to first-degree murder and four other charges in the grisly killing in late May of Lin, a 33-year-old Concordia University student.

Magnotta, 29, is accused of mailing Lin’s body parts to different places including the Ottawa offices of the Conservative Party of Canada, the Liberal Party of Canada and two Vancouver schools. He is also accused of posting a video of the events on the internet.

The charges he faces include defiling Lin’s corpse, harassing Prime Minister Stephen Harper and members of Parliament, and publishing and mailing obscene material.

After Magnotta’s highly publicized Tuesday arraignment, his lawyer Pierre Panaccio said he’d weigh the option of requesting a psychological assessment, ahead of any trial proceedings.

If his lawyer does request a psychological assessment and the court accepts, Magnotta would be transferred to a psychiatric institution, likely Montreal’s Pinel Institute, for a maximum of 30 days.

Magnotta wasextradited from Germany to Montreal aboard a Canadian Forces aircraft on June 18, accompanied by a heavy security detail that included local police investigators, RCMP officers and Canadian Border Services authorities.

His extradition came two weeks after his June 4 arrest in Berlin at a cybercafé, where an employee recognized him from photos issued by Interpol.

The international police agency orchestrated a global manhunt for Magnotta after Montreal police issued a warrant for his arrest.

His other hand and foot were discovered by staff opening packages at two schools in Vancouver several days later.

The victim’s family have kept a low profile since their arrival in Canada. Earlier this month they published an open letter in which they said their son was the family’s “pride and joy.”

Luka Rocco Magnotta has pleaded not guilty to the multiple charges against him, including first-degree murder, in the death and dismemberment of Chinese student Jun Lin.

Magnotta appeared via video link at the Montreal courthouse Monday afternoon before Justice Lori-Renée Weitzman, in a brief hearing that lasted about three minutes.

Standing impassive and under guard watch, Magnotta pleaded not guilty through his lawyer Pierre Panaccio.

The case returns to court on Thursday, again by video, to discuss a motion requesting psychiatric evaluation.

Panaccio told his client that he hoped to speak with him later Tuesday, and said Magnotta could call him at home.

“I’d be pleased to talk about this,” Panaccio said. “Okay,” Magnotta responded, before being led away to detention.

Crown prosecutor Louis Bouthilier said Magnotta’s eventual trial would be based on the first-degree murder count, as “the other charges are accessory to this one.”

Bouthilier will try the case along with Crown prosecutor Hélène Di Salvo.

Suspect extradited Monday on military plane

Magnotta, 29, was flown from Germany to Quebec’s Mirabel airport aboard a military plane on Monday evening, in a highly controlled and secretive extradition operation orchestrated to minimize media attention on his return.

Magnotta was taken to a police operational centre in the north end of Montreal, where he was held overnight. He will likely be transferred to one of the city’s high-security detention centres, now that he’s been formally charged.

Magnotta is suspected of killing and dismembering Lin, a 33-year-old Chinese citizen and permanent resident in Canada who was attending Concordia University.

Last month, Lin’s torso was found in a suitcase outside an apartment in Montreal, the same day his hand and foot were mailed to the Ottawa offices of the federal Conservative and Liberal parties. His other hand and foot were discovered by staff opening packages at two separate schools in Vancouver several days later.

An international warrant for his arrest listed five charges, including first-degree murder, committing an indignity to a human body, posting obscene material, mailing obscene material and criminal harassment of Stephen Harper and other members of Parliament.

Montreal police Cmdr. Ian Lafrenière said investigators have begun their interrogation process, and their priority is to locate Lin’s severed head.

Lafrenière said DNA samples will be taken from Magnotta to explore possible links to other homicide cases.

Widespread media coverage

Lin’s family arrived in Canada earlier this month and posted an open letter saying the 33-year-old was their “pride and joy.” They also expressed gratitude for the outpouring of support and assistance they have received.

Police believe Lin was killed sometime around the evening of May 24 or early May 25. Video that allegedly captured some of the act was posted to an online gore site on May 25 and circulated on the web for several days.

The discovery of Lin’s remains prompted an international manhunt for Magnotta, who fled first to France and later to Germany. He was arrested in a Berlin cybercafé on June 4.

The brutal details of Lin’s death have drawn widespread media coverage both here in Canada and abroad. Lafrenière said the massive amount of public attention garnered by the case necessitated the secretive operation to get Magnotta back into Canada.

And a Montreal defence lawyer says that will make it difficult for Magnotta to receive a fair trial.

“The trial judge will have to make sure with each and every juror that there’s no bias,” Jeffrey Boro said.
