Special Agents from Immigration and Customs Enforcement identified and arrested two suspects in a child pornography cases less than 24 hours after releasing photos of the alleged abusers to get the public’s help in finding them.

Federal agents and officers of the Los Angeles Police Department took Letha Mae Montemayor, 52, into custody on Thursday night after identifying her by both her facial appearance and her tattoos, which were present in the photographs depicting alleged child abuse. Montemayor was arrested hours after ICE placed photos of “Jane Doe” on line.

ICE officials say the incriminating photos of the suspect had been widely circulated and are believed to have been taken approximately 11 years ago. According to court records, the photos depict the suspect and an unidentified male allegedly abusing a young girl believed by authorities to be about 13 years old.

The images first surfaced in a 2007 investigation by ICE agents in Chicago, but agents had run out of leads to identify the alleged perpetrators and their victim before asking for the public’s help.

On Friday afternoon, 43-year-old Lance Robert Fries of Tucson, was taken into custody at his attorney’s Arizona office by special agents with ICE’s Homeland Security Investigations (HSI). Fries faces potential federal charges of production of child pornography and is expected to make his initial appearance in federal court today.

His arrest came after HSI released photographs Thursday of an unidentified man sought in connection with a child pornography case that involved the sexual exploitation of a pre-pubescent boy by an adult male. The images were first discovered in 2006. Just after 11:15 p.m. Thursday, special agents received a call to the ICE tipline regarding the suspect’s possible identity.

At 11:15 p.m. Thursday, HSI special agents received a call to the ICE Tip Line regarding the suspect’s possible identity.

Investigators were also able to identify the victim and confirm that the boy is now safe.

“This is truly a remarkable turn of events and it again demonstrates the collective power that can be brought to bear when law enforcement and the public team up to combat the sexual exploitation of children,” said ICE Director John Morton. “Those who produce and trade child pornography over the Internet believe they’re protected by the anonymity of cyberspace. Through our collective efforts, we’re proving these predators wrong and gaining justice for their innocent victims.”

ICE is still seeking help in identifying two additional John Does suspected of sexually abusing young children. Those suspects, whose photos were also released Thursday, are still at large.

In December, less than 24 hours after asking for the public’s help in identifying and arresting another “Jane Doe” suspected of producing child pornography, federal officials arrested a suspect and rescued a child who was allegedly shown in an exploitative video.

Corrine Danielle Motley of Okaloosa County, Florida faces federal charges for the production and distribution of child pornography. Motley, 25, was arrested on Dec. 19 by Northwest Florida Internet Crimes Against Children Task Force members and Homeland Security Investigations special agents.

abc sydney spies jef 120106 wblog Sydney Spies, Racy Yearbook Photo Teen, Arrested With Mom

August 14, 2012                4:13pm

The Colorado teenager who made national headlines when her racy senior picture was rejected by the editors of her high school yearbook was arrested along with her mother Monday after police broke up an alleged underage drinking party at the family’s home.

Sydney Spies, 18, was charged with obstructing a police officer while her mother, Denise “Miki” Spies, 45, was arrested on suspicion of contributing to the delinquency of a minor, a felony, and obstructing a police officer and resisting arrest, according to Durango County police.

The two made a run for it after police discovered a crowd of “numerous” teens drinking and partying at Spies’ Durango, Colo., home late Sunday night, authorities allege.

Sydney Spies first attempted to block police from entering the front door and, when placed under arrest, tried to jump out of the backseat of a police car, according to an incident report filed by police and confirmed to ABCNews.com by Durango Police Sgt. Geary Parsons.

“She nearly kicked me in the groin,” officer Darrell Robertson wrote in the arrest report, according to the  Durango Herald.

When police entered the home, Miki Spies led them on a chase to her bedroom where she tried to slam the door before police caught her and handcuffed her amidst a struggle, according to the incident report.

She also reportedly refused to give police her name, identification and date of birth.

If convicted on all counts, Miki Spies, who identifies herself as a self-employed “Lifestylist” on her Facebook page, faces up to six years in prison and a maximum $500,000 fine. Her daughter, Sydney, could face 12 months in jail and a $1,000 fine, according to Sgt. Parsons.

Both mother and daughter were released early Monday morning on bail and are scheduled to appear in court later this month, authorities said.

Sydney Spies made headlines in January when she was notified by administrators at Durango High School that a photo she submitted of herself posing in a short yellow skirt midriff and shoulder-exposing black shawl would not be allowed to be used as her senior portrait.

Spies fought back, holding a protest with her mother and other students outside the school and meeting with administrators who, she said, banned her photo because it violated dress code.

Spies’ appeal, including the threat of a lawsuit and national media coverage, did not sway the school and, after three more photos submitted by Spies were all rejected, the school used her school ID photo instead.

At the time, Miki Spies commented on the situation on her own Facebook page.

“This whole yearbook photo has me thinking again. A lot of people are questioning my parenting skills. My kids tell me everything and I try to guide them as best as I can. But in the end I allow them to make their own decisions resulting in their own successes or failures,” she wrote.

Following the controversy, Spies landed a small role in an upcoming movie, “American Horror House,” scheduled to air on the SyFy channel on Halloween.

Her mother, Miki, was arrested June 24 on suspicion of trespassing, resisting arrest and obstructing a police officer in a case in which she and another woman were reported being loud and refusing to leave private property.  She was scheduled to appear in court today for those charges, the Herald reports.

A 32-year-old woman was arrested for having sex with a boy under the age of 16 in a park bathroom.

Destiny Ruth Witte, from Lakeland, Orlando, is believed to have kissed the child before taking him to a bathroom and having sex with him.

She was arrested on Wednesday after the teenager told police about their alleged relationship and let him listen in on a phone call.

It was first discovered this week when a relative of the teeanger became concerned about how close the pair had become and invited Witte to the family home for a talk.

Few details have been revealed about the meeting but according to the Orlando Sentinel, Witte arrived wearing ‘provocative clothes’ and embraced the teen in a ‘passionate’ manner during the ‘awkward’ meeting.

During the phone call between Witte and the teen which led to her arrest, when one of the detectives broke into the conversation, the 32-year-old agreed to meet with them.

She later said she felt ‘sick to her stomach and realized what she had done was wrong…and would be willing to get counseling or do anything to “make this right”,’ according to the arrest report.

She has been charged with one count of lewd battery on a child under 16 and two counts of lewd conduct with a child under 16, both second-degree felonies.

The Supreme Court has ruled that two Secret Service agents are shielded from a lawsuit filed by a man they arrested after a confrontation with then-Vice President Dick Cheney.

The 8-0 decision Monday comes in a case that began with the arrest of Steven Howards following a chance encounter with Cheney at a shopping center in Colorado in 2006. Howards claimed he was arrested because he expressed his anti-war views.

The agents and the Obama administration asked the court for broad protection against claims of retaliatory arrests. The justices did not grant that wish.

But Justice Clarence Thomas said in his opinion for the court that the agents could not be sued in this instance because of uncertainty about the state of the law concerning such arrests.

12:10 PM EDT         Tuesday May 29, 2012

Imagine going to the internet to search your name only to find a mug shot from years ago posted on multiple websites. There are publications and websites whose sole purpose is to feature police booking photos. Some make a profit selling advertising around the photos, while other websites are offering, for a price, to remove or hide these images permanently. Donald Andrew McMahon learned about the mug shot business the hard way.

In 2003, McMahon woke up one morning covered in blood, with stab wounds and evicted from his home. McMahon was fired from his job and slept in a gas station bathroom that night. McMahon knew his life was in need of a change. At the time, the then-bartender was dealing with the deaths of his best friend and sister within months of each other, along with a family history of drug abuse.

McMahon started using cocaine at age 12 and lived in a drug-induced haze until he was 23. During those tumultuous years, McMahon was arrested several times, including two instances for driving under the influence of alcohol.

These days, McMahon is a happily married, churchgoing father who works at the Centers for Disease Control and Prevention in Atlanta. His wife, Andrea McMahon, is a part-time student at the University of Georgia earning a master’s in social work. When they’re not working, life for the McMahons revolves around their 2-year-old daughter, Gemma. It is a much different existence than McMahon once had.

“I’ll be outside watching them and a bag of bricks hits me,” McMahon said at his Norcross, Georgia, home while watching “Dora” with the family. “This is me now compared to eight years ago when I was living in a bar.”

On paper, McMahon is the quintessential American family man, but his past haunts him in publications and on websites that are using it for profit.

Mug Shots Inc.

As part of his recovery, McMahon went to the Internet to check his online image after he read that employers use Google to search the names of potential employees. Having served the time for his crimes, McMahon was shocked to find his mug shot still posted on a website along with others. He contacted the site to have the image removed. He paid a another site to have the mug shot removed only to see his photo show up in four other places.

Andy McMahon, with his family at Disneyworld last year, found his seven-year-old mug shot in an online publication
Andy McMahon, with his family at Disneyworld last year, found his seven-year-old mug shot in an online publication

“It’s like killing one flea and then saying, ‘OK the flea problem is done,'” McMahon said.

His frustration built when he contacted the website Reputation.com, which said for $7,500 it could not get rid of his image, but could “bury” it in Internet purgatory.

McMahon is not alone in finding his murky past displayed for the public.

Caught Up is a Tennessee-based weekly that dubs itself a “crime-fighting publication.” It features police booking photos. Found primarily in smaller communities throughout Tennessee, Georgia, Florida, Indiana, and Kentucky, the publication showcases people’s names and alleged crimes listed below their mug shots.

Caught Up and other similar papers collect mug shots, which are public record, from sheriffs and local police departments, who hand over the information with the names listed in alphabetical order, detailing the criminal charges. These photos are also featured and archived on the publication’s website caughtuplive.com. Caught Up will feature anyone. One issue included OutKast’s Big Boi on the cover after he was arrested on a cruise in late 2011.

“Sometimes I say I’m the most popular woman of the small counties because police departments are so grateful,” said Lori Broderick, the media liaison for Caught Up. Broderick is involved in the publication of every paper, which puts out more than 25,000 copies weekly.

Broderick, who is also a paralegal, joined the Caught Up team in December 2010. She feels the mission of the paper is to give people the ability to keep an eye on their communities.

She recalls one woman who wanted some extra help with her lawn over the summer. The woman saw a picture of a man listed as a sex offender in Caught Up. It was the same man she was planning to hire to work at the home she shares with two teenage daughters. Broderick said the woman told her it was the best $1 she had ever spent.

The flip side is how the publication affects the people showcased. Broderick recalled a man who was a sex offender and had finished serving his sentence. The man was trying to rejoin the community but felt he couldn’t with his mug shot in the paper and online. Broderick said she and her team discussed the issue, but ultimately felt their need to inform was more important than helping the man overcome his past.

“When you’re talking about the safety of the community and the safety of children and seeing as how these are already public records, we just made the determination that it was in the best interest of the public to have this information available,” Broderick said. “The lack of knowledge was not a chance that we were ready to take.”

Mug shots: Informative vs. slander?

Caught Up consists mostly of mug shots with a few related written pieces and various games that it calls “informative fun.” There also is some local advertising.

Caught Up Vice President Geoffrey Bar-Lev said in today’s economy the profit margin for this business is relatively low. However, the demand for the publication in smaller communities has remained the same.

The business makes money even if the lives of the people who make up its content have changed, which leaves someone like McMahon out of luck.

Several clients have asked Kavan Singh-Grover, an Atlanta-based criminal defense attorney, about removing their mug shots from the sites and about what legal action can be taken.

“They are using a person’s image for commercial gain without their permission,” said Singh-Grover. “To me, its extortion, maybe not legally, but the common use of that term.”

Singh-Grover said legally, there is nothing that can be done. The only thing that could stop the publications and websites is legislation that forbids them. That legislation does not exist.

Caught Up’s Broderick said she understands the concerns and said other publications might have a lower standard, but their purpose is to encourage safety in communities, not promote public humiliation.

“People think we are in the business to mock,” Broderick said. “They believe that we have photos of a person who has been arrested to allow the community to thumb their nose at and that’s not our purpose. If people find some of the mug shots amusing, that’s more or less a side effect.”

McMahon isn’t laughing.

“But that’s the main way they make profit, right,” he said. “We can read a paper without looking at a picture and know that seven people were arrested for DUI — we don’t need the picture. It just — to me — seems like the way that they’re making money is because the pictures are pathetic or sometimes funny.”

RemoveSlander.com is a website that erases mug shots from the Web once a person has been legally cleared. The site said it uses “trade tools” to eliminate the mug shot. Spokesperson Philip Lee said he does not feel RemoveSlander.com should be “affiliated with the mug shot website.”

RemoveSlander.com via ImageMax Mugshot Removal said it is the first reputation management firm to offer the service. For $399, RemoveSlander.com allows a customer to specify one website from which to have a mug shot deleted. For $699.00, the mug shot is removed from three sites. Remove.Slander.com has 14 business days to remove the mug shot from the website and Google or the customer gets their money back. If a customer has multiple arrests with more than one booking photo, that costs more.

In his suburban Atlanta home, McMahon seems at peace with his new life and everything that comes with it. However, he’s eager to talk about his past if it means more people are aware of publications like Caught Up and sites like RemoveSlander.com.

“I’m human, I made a couple of mistakes — it’s not a secret I made more than one,” McMahon said. “Everyone has a past. It’s just unfortunate that mine is exploited for profit.”

Police have identified 23-year-old James Bajkor as the victim of a fatal shooting in central Hamilton Monday.

A 34-year-old man wounded in the shooting survived in what police describe as life-saving surgery at Hamilton General Hospital.

Det. Sgt. Matt Kavanagh said police have no suspects but several persons of interest. Kavanagh said it was not a random shooting.

The investigation is continuing and Kavanagh said police expect an arrest soon.

Hamilton Police spokeswoman Terri-Lynn Collings said the death is the second homicide in the city this year.

Hamilton’s first homicide this year happened on April 6. Michael Swistak was shot and killed in the playground at Cathy Weaver Elementary School. A 19-year-old man was arrested in connection with that incident.

About 6 p.m. Monday police arrived at a house north of Barton Street east of Sanford Avenue.

Hamilton General Hospital confirmed that two patients arrived at the hospital in critical condition.

At the scene of the shooting Hamilton Police superintendent Warren Korol said, “we have a number of witnesses. No arrests have been made.”

Neighbours say they saw a man and a woman taken away by police in handcuffs.

Kavanagh told the news conference this morning that the woman was released.

A woman who lives next door to the violence said her husband was at home at the time of the shooting.

She said her husband heard a loud noise and then moaning coming from the backyard. When he went outside, he found a man with gunshot wounds in his backyard.

Local resident Michael Baldasaro said he isn’t surprised by the shooting.
